HomeMy WebLinkAboutResolution 724 Taxes for Street Sprinkling Districts 326 COMMISSION RESOLUTION NO. 724 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESS- ING A SPECIAL ASSESSMENT OF TAXES UPON ALL 'rHE PROPERTY IN STREET SPRINK- LING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONT- ANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1952. WHEREAS, the City Council and the Commission of the City of Bozeman have heretofore duly and regularly passed Countil and Commission Resolutions creating Street Sprinkling I Districts within the City of Bozeman and defining the bound~ries thereof and providing for the assessment of the cost of sprinkling the same as set forth in. Resolutions here- inafter referred to; and WHEREAS, the streets within the boundaries of saidStreet Sprinling Districts have been sprinkled during theyear 1952, as contemplated in said Resolutions, in accor'dance with the terms and conditions thbreof; and WHEREAS, the street Sprinkling Districts and the Resolutions creating the same, - the total frontage of the property within said district to be assessed, the totEl cost of said Sprinkling within said districts and the proportion thereof' chargeable to the property therein is hereinafter set forth. NOW, THEREFORE, pursuant to the provisions of Sections 5272 to 52Tr hwlusive, Political Code, R. C. M, 1935, and Ordinance No. 295 and saidCouncil and Commission Reso- lutio~s creating said Street Sprinkling Districts; BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That for the year 1952, the City of Bozeman has waived the sprinkling I assessments of the following districts: 130, 131, 132, 133, 134, 135, 136, 137, 138, 139, 1~0, 1[!1, Ih2, 1~3, 1~1!, 160, 161, 162, 163, 164, 192, 1)~, 195, 196, 197, 198, 199, 204, 216, 217, 218, 219, 220, 232, 233, 234, 235, 236, 237, 238, and 256; that for the year 1952, the City of Bozeman has defrayed the cost ($1438.7B) of sprinkling streets in the several street sprinkling districts pursuant to Resolutions creating the sa~e, and that seventy-five percent of the entire cost thereof ($1,079.09) exclusive of the cost of sprinkling parks and public places, the total number of' linear feet of property to be assessed, and the rate per linear foot, is as follows, to-wit: Sprinkling District No.1, created by Gouncil Resolution No. 424~, Main Street from Wallace Ave. to Fourth Ave., a total frontage of 9363.~-, the sum of $1,079.09, being 75% of the entire amount, or at an approximate rate per front foot of $0.1153379. Section 2. That to defray seventy percent of the cost of sprinkling streets within said street sprinkling districts for the year 1952, there be, and there is hereby levied and assessed a tax upon all property in front of and bordering on said street sprirld.ing districts as set forth in Schedule One hereto attached and made a part hereof; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it, is set forth in the assessment lists hereto attached, I marked Schedule "One" and made a part hereof; that the several sums set opposite the names of the owners, and the described lots and parcels of' land be, and the same are hereby levied and assessed upon and against said lots and parcels of land; that the several sums be collected from the respective owners of said lots and parcels of land described in the said assessment li~ts, Schedule One, as required by law; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay ..--"- -- .- 327 such assessments when the same shall become due and payable shall make such persons and such lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 3. That the regular session of the Commission of the City of Bozeman to be held on the8th day of October, 1952, at the Commission Chabmer, City Hall Building, be, I and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by the Commis s ion. Section 4. That the Clerk of the Commission be, andhe is hereby ordered and directed to publish in the Bo~eman Daily Chronicle, a daily newspaper printed and published in the said City of Bo zeman, a Notice signed by the Clerk of the Commission, and stating that a R......solution levying a special assessment of' taxes to defray seventy-five per cent of the cost of sprinkling streets in the said street Sprinkling Districts for the year 1952, is on file in the office of the Clerk of the Commission, subject to inspection for a period of five days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five days before the date set by the Commission for hearing objections, and the final adoption of this Resolution. provisionally passed and adopted by the Commission of the City of Bozeman at a regular sesslon thereof held on the 1st day of October, 1952. Att:?A~ Clerk of the ommission NOTICE HEARING FINAL ADOPTION COMMISSION RESOLUTION NO. 724 LEVYING ASSESSMENT OF SEVENTY-FIVE :PERCENT OF COST OF SPRINKLING STR3ETS, STREET SPRINKLING DIS- TRICTS FOR THE YEAR 1952. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the city of Bozeman held on the 1st day of October, 1952, Commission Resolution No. 724 was duly passed and adopted; that said Commission Resolutlon No. 724 levies and assesses a sp ec lal assessment of taxes upon all the property in Street Sprinkling Distriets of said City to defray seventy-five percent of the cost of sprinkling streets within said Street sprink- I ling Districts for the year 1952. That said Street Sprinkling Districts, and the Resolution creating the same, and the amount of the assessments are as follows: Street Sprinkling District No. 1, created by Resolution No. 424t in the amount of $1,079.09. That, said Resolution No. 724 is now on file in the office of the Clerk of the Com- mission of said City of BozemansubJect to inspection of all persons interested for a period of five days; that Wednesday, the 8th day of October, 1952, at 1:00 o'clock P.M. of said day at a regular session of the Commission of the City of Bozeman, Commis s ion Resolution No. 724. 328 Room, Ci t7r Hall Building, has been des ignated as the time and place when andwhere said Com- mission will hear and pass upon any and all objections that may be made to the final adoption of said Commission Resolution No. 715, and the levying of said assessment; and that said Resolution will be finally passed and adopted at said regular session of said Commiss:ton, subject to such corrections and amendments as may be made upon objections made and filed within five days limit as provided by law.
