LEVYING AND
ASSESSING A SPECIAL ASSESSMEN'r OF 'l'AXES UPON ALL REAL PHOPER'rY IN rl'HE CITY OF
BOZEMAN, COUN'ry OF GALLATIN,
STATE OF MONTANA, SERVICED AND FFWM WHICH GARBAGE
WAS COLLECTED AND REMOVED DURING THE YEAR 1951, TO DEFRAY THE COST AND EXPENSE
OF COLLECTING AND DISPOSING OF GARBAGE 111iDER THE PROVISIONS OF ORDINANCE NO. 696
OF THE crry OF' BOZEMAN.
WHEREAS, the City Commission of the City of Bozeman did on the 8th day of January,

duly and regularly pass Ordinance No. 696, entitled:
"AN ORDINANCE DEFINING GARBAGE FOR THE PEUPOSE OF THIS ORDINANCE: PROVIDING
FOR
THE COLLECTION AND DISPOSITION THEREOF BY AND UNDER THE SUPERVISION AND CON'rROL
OF THE DEPAR'rMENT OF PUBLIC WELFARE AND F'OE DEFRAYING THE cos'1' OF SUCH COLLsc'rION
AND DISPOSITION BY SPECIAL ASSESSMEN'r AGAINST 'rHE PROPER'ry '1'0 WHICH SUCH SERVICE
IS RENDERED, AND PROVIDING PENALrrIES FOR VIOLATION OF 'nrIs ORDINANCE,
which Ordinance No. 696, passed
as aforesaid is hereby referred to and made a part of
this Resolution for further
particulars in respect to the basis and method of asses sing
the cost against the property
herein assessed, and,
WHEREAS, said expense incurred by said City in
the collection and disposition of
garbage in accordance with
said Ordinance is hereby estimated by the Commission of the
City of Bozeman to be the sum
of Twenty Three Thousand Six Hundred Thirty Three Dollars
and Sixteen Cents
(:$ 23,633.16) , for the year 1951,
over and above all moneys collected
from business and professional
concerns, or combined residence and business,
or residence
and professional business concerns
in accordance with said Ordinance No. 696,
and,
WHEREAS, in order to raise s aid sum to defray the said cost,
it is necessary to
establish the ba:sic unit rate
as defined in said Ordinance No. 696 at Eight Dollars
($8.00) .

NOW, THEREFORE, pursuant
to the provisions of said Ordinance No. 696,
and the laws
of the State of Montana,
BE 1'.1' RESOLVED AND IT IS HEREBY ORDERED BY 'rHE COllJIMISSION OF THE CITY OF BOZEMAN,
STATE OF MONTANA:
See t ion l. That to
defray the estimated cost and expense of collecting and dispos-
ing of garbage in the City
of Bozeman for the year 1951, there is hereby levied and
assessed against the property
and the several lots, pieces and parcels of land thereof
within the City of Bozeman
as set forth in Schedule "A", which is attached hereto and
made a part hereof,
a tax; that a particular description of each lot
and parcel of land
with the name of the owner
and/or owners and the sum assessed against the same is set
forth in the assessment list
in said Schedule "A"; that the several sums set opposite
the names of said owners and
the described lots and parcels of land, be, and the same
are hereby levied and assess~d
upon and against said lots and parcels of land for said
purpose;
that the several sums be collected from the respective owners of said lots and
parcels of land described in
sa.id assessment list and owned by them; that
the said sums
shall be paid and the collection
thereof be made in the manner and in accordance with I
Ordinance No. 696 of the City
of Bozeman, Montana, and the laws of the State of Montana
governing the collection of
special improvement taxes; that failure to pay such assess-

ment when the same shall become
due and payable shall make such person and such lots
and parcels of land liable
to the penalties provided by law relative to delinquent taxes.
Section 2. That the regular session of the Commission of the City of Bozeman,

to be held in the Commission Chamber in the City Hall of said City on the 3rd

day of October, 1951, at 1:00 o'clock P.M. be, and the same is hereby designated as
the time and place at which objections to the final adoption of this Resolution will
be heard by said Commission.
Section J. That the Clerk of the Commission of the City of Bozeman be, and he is
I hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily news-
paper printed and published in said City of Bozeman, a notice signed by the Clerk of
the Commission, stating that a resolution levying and assessing a special assessment
of taxes to defray the cost and expense of the collection and disposition of garbage
in the City of Bozeman for the year 1951, against the property to which such service
was rendered, is on file in the office of the Clerk of the Commission, subject to in-
spection for a period of five days; that said Notice shall state the time and place at
which objections will be heard by the Commission to the final adoption of this Resolu-
tion; and that said Notice shall be published at least five days before the day set
by the Commission for hearing of objections and the final adoption of this Resolution.
Provisionally passed and adopted by the Commission of the City of Bozeman at a
regular session thereof held on the 26th day of September, 1951. 7 ~)

No'rICE IS HEREBY GIVEN, that at a regular session of the Commission of the City

of Bozeman held on the 26th
day of September, 1951,
Commission Resolution No. 716 was
provisionally passed and adopted;
that said Resolution levies and assesses a special
assessment of taxes to defray
the cost of collection and disposition of garbage in the
City of Bozeman,
for the year 1951, upon all property to which
such service was render-
ed.
That said Commission Resolution No. 716 is now on file in the office
of the Clerk
of the Commission of the City
of Bozeman, subject to inspection of all persons
interest-
ed,
for a period of five days; that Wednesday,
the 3rd day of October, 1951,
at 1:00
o'clock P.M.
of said day a regular session of the Commission of the City of Bozeman,
in the Commission Room,
in the City Hall Building, has been
des igna ted as the time
and place when and where said
Commission will hear and pass upon any and all obJec-
tions that may be made to
the final passage and adoption of said Commission Resolution
No.
716 and the levying of said assessment; and that said Resolution will
be finally
passed and adopted at said
regular session of said Comm:1.ssion, subject to such correc-
tions and amendments that may
be made upon objections made and filed with t he Clerk
of the Commission within the
five days limit as provided by law.
