NO. 715
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A
SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN STREET SPRINKLING DISTRICTS
OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN,
STATE OF MONTANA, TO DEFRAY SEVENTY-
FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING

DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1951.
WHEREAS,
the City Council and the Commission of the City of Bozeman have heretofore
duly and regularly passed Council and Commission Resolutions creating Street Sprinkling
Districts within the City of
Bozeman and defining the boundaries thereof and providing
for the assessment of the cost
of sprinkling the same as set forth in Resolutions here-
inafter referred to;
and
WHEREAS, the streets within the boundaries of said Street Sprinkling Districts have
been sprinkled during the year
1951, as contemplated in said Resolutions,
in accordance
with the terms and conditions
thereof; and
WHEREAS, the Street Sprinkling Districts and the Resolutions creating the same,
the
total frontage of the property
within said district to be assessed, the total cost of
said sprinkling within said
districts and the proportion thereof chargeable to the prop-
erty therein is hereinafter
set forth.
NOW, THEREFORE, pursuant to the provisions of Section 5272 to 5277 inclusive,
Pol-
itical Code, R.C.M.,
1935, and Ordinance No.
295 and said Council and Commission Reso-
lutions creating said Stre~t'Sprinkling
Districts.

BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF
BOZEMAN, STATE OF MONTANA:
Section 1.
That for the year 1951, the City of Bozeman
has, waived the sprinkling
assessments of the following
districts: 130, 131,
132, 133,
134, 135, 136,
137, 138,
139,
140, lL.l, lL+2,
143, lL4, 160,
161, 162. 163, 16L., 192,
193, 19L~, 195, 196, 197, 198,
199,
2oL~ , 216,217. 218,
219, 220, 232,
233, 234, 235, 236,
237, 238, and 256; that for
the year 1951,
the City of Bozeman has defrayed the cost
($1429.80) of sprinkling streets
in the several Street Sprinkling
Districts pursuant to Resolutions creating the same,
and that seventy-five percent
of the entire cost thereof ($1072.35)
exclusive of the
cost of sprinkling parks and
public places. The total number of linear feet of property
to be assessed,
and the rate per linear foot, is as follows,
to-wit:
Sprinkling District No.1, created by Council Resolution No. 424t, Main Street from
Wallace Ave. to Fourth Ave., a total frontage of 9363.4. ft., the sum of $1072.35,
being 75% of the entire amount, or at an approximate rate per front foot of
$O.11L6175.
Section 2. That to defray seventy-five percent of the cost of sprinkling streets
within said street sprinkling
districts for the year 1951, there be,
and there is hereby
levied and assessed a tax upon
all property in front of and bordering on said street
I sprinkling districts
as set forth in Schedule One hereto attached and made a part hereof;
that a particular description of each lot and parcel of land with the name of the owner
and the sum assessed against him or it,
is set forth in the assessment list hereto
attached, marked "Schedule
One" and made a part hereof; that the several sums
set oppo-
site the names of the owners,
and the described lots and parcels of land be,
and the
same are hereby levied and
assessed upon and against said lots and parcels of land;
that the several sums be collected
from the respective owners of said lots and parcels

of land described in the said assessment lists, Schedule One, as required by law; that
saJ.d sums shall be paid and the collection thereof shall be made in the manner and in
accordance with the law governing the collection of special improvement taxes: that
failure to pay such assessments when the same shall become due and payable shall make
such persons and such lots and parcels of land liable to the penalties provided by I
law relative to delinquent taxes.
Section 3. 'rhat the regular session of the Commission of the City of Bozeman
to be held on the 3rd day of October, 1951, at the Commission Chamber, City Hall
Building, be, and the same is hereby designated as the time and place at which objec-
tions to the final adoption of this Resolution will be heard by the Commission.
Section LI_. That the Clerk of the Commission be, and he is hereby ordered and
directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and
published in the said City of Bozeman, a Notice signed by the Clerk of the Commission,
and stating that a Resolution levying a special assessment of taxes to defray seventy-
five (75) per cent of the cost of sprinkling streets in the said Street Sprinkling
Districts for the year 1951, is on file in the office of the Clerk of the Commission,
subject to inspection for a period of five ~ys; that said Notice shall state the time
and place at which objections will be heard by the Commission to the final adoption
of this Resolution; that it shall be published at least five days before the date set
by the Commission for hearing objections, and the final adoption of this Resolution. I
Provisionally passed and adopted by the Commission of the C:l.ty of Bozeman at a
regular session thereof held on the 26th day of September, 1951.

of Bozeman held on the 26th day of September,
1951, Commission Resolution No.
715 was
duly passed and adopted:
that said Commission Resolution No. 715 levies and assesses
a special assessment of taxes
upon all the property in street Sprinkling Districts of
said city to defray seventy-five
percent of the cost of sprinkling streets within said
Street Sprinkling Districts
for the year 1951.
That said street Sprinkling Districts, and the Resolutions creating the
same, and
the amount of the assessments

that Wednesday, the 3rd day of October,
1951, at 1:00 o'clock

of said day at a regular session of the Commission of the City of Bozeman,

sion Room,
City Hall Building, has been designated as the time and
place when and where
said COUl.r:1ission will hear
and pass upon any and all objections that may be made to the

Commission Resolu.tion No. 715,
and the levying of said assessment;
and that said Resolution will be finally passed and adopted at said regular session of
said Commission,
subject to such corrections and amendments as may be made upon objec-
tions made and filed within
five days limit as provided by law.
