A RESOLUTION OF THE COMMISSION
OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPJiJCIAL
ASSESSMl'}.TT OF' TAXES UPON
ALL THE P'OOPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 366 IN THE CITY

SPECIAL IMFROVEMENT DISTRICT NO. 366.
WHEREAS. The City Commission
of The City of Bozeman, did on the 3rd day of September. 1952. duly
and regularly pass Commission
Resolution No. 720, entitled:

DESIGNATED AS "SPECIAL IMProVEMENT DISTRICT NO. 366 OF THE C lIT OF BOZEMAN" F'OR TIlE PURPOSE OF
CONSTRUCTING AND INSTALLING A SANITARY SEWER IN THE NORTH AND SOUTH ALLEY IN BLOCKS ONE (l), TWO
(2). THREE (3) AND FOUR (4), OF THE NORTH SEVENTH ADDITION TO THE CITY OF BOZEMAN, AND THE
EXTENSIONS OF SAID ALLEY BETWEEN
A POINT LOCATED DUE EAST FROM THE SOUTHEAST CORNER OF LOT FIVE
(5) OF' SAID BLOCK ONE (l)
AND THE MANHOLE AT STATION 47 PLUS 35 OF THE WEST SANITARY TRUNK
SEWER, SAID MANHOLE BEING LOCATED
5 FEET SOUTH OF THE NORTH CITY LIMITS OF THE CITY OF BOZEMAN.
AND TO SPECIALLY ASSESS THE
COST OF SUCH CONSTRUCTION AND INSTALLATION AGAINST TEE PROPERTY
WITHllJ THE BOUNDARIES OF SAID
SPECIAL IMPROVEMENT DISTRICT SO CREATED ON .AN AREA BASIS, PURSUANT
TO THE STATUTES IN SUCH CASES
MADE AND PROVIDED.
and thereafter. after due and
legal proceedings had, the Commission of The City of Bozeman did on the 1st
day of Ootober. 1952. duly
pass Commission Resolution No. 726, entitled:

OF' THE CITY OF' BOZEMAN. MONT., CREATING A SPECIAL IMPROVE-
MENT DISTRICT OF SAID CITY
TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NO. 366
FOR THE PURrOSE OF CONSTRUCTING
AND INSTALLING A SANITARY SEWER IN THE NORTH .AND SOUTH ALLEY
IN BLOCKS ONE (l). TWO (2),
TEREE (3) AND FOUR (4) OF TIlE NORTH SEVENTH ADDITION TO THE CITY
OF BOZEMAN, .AND THE EXTENSIONS
OF' SAID ALLEY BETWEEN A POINT LOCATED 150 FEET SOUTH OF THE
SOUTH LINE OF WEST ASPEN STREET
AND THE MANHOLE AT STATION 47 PLUS 35 OF THE WEST SANITARY
TRUNK SEWER. SAID MANHOLE BEING
LOCATED 5 FEET SOUTH OF mE NORTH CITY LIMITS OF' THE CITY OF
BOZEMAN, .AND TO SFECIALLY
ASSESS THE COST OF SUCH CONSTRUCTION AND INSTALLATION AGAINST THE
PROPERTY WITHIN THE BOUNDARIES
OF SAID SPECIAL IMPROVEMENT DISTRICT SO CREATED ON AN AREA
BASIS, PURSUANT TO THE STATUTES
IN SUCH CASES MADE MID PROVIDED .AND l'URSUANT TO .AND IN CON-
FORMITY WITH COMMISSION RESOLUTION
NUMBER 720 OF SAID CITY COMMISSION AS PASSED AND ADOPTED
BY SAID CITY COMMISSION ON
THE 3RD DAY OF SEPTEMBER. A. D., 1952.
which Commission Resolutions
Nos. 720 and 726. passed as aforesaid, are hereby referred to and made a
I part of this resolution
for further particulars in respect to the boundaries of said district. the
character of the improvements to be constructed therein, the estimated cost of said improvements
and the
method of assessing the cost against the property within said district; and
WHEREAS. said improvements
as contemplated in said Commission Resolutions Nos. 720 and 726 have been
constructed and completed in
acoordance with the terms and oonditions of Commission Resolutions Nos. 720
and 726, and the total cost
of said improvements so constructed is the sum. of Eight Thousand Three
Hundred Ninety Four and 63/l00th
Dollars ($8,394.63).
NOW. THEREFORE, pursuant to
the provisions of Sections 5225 to 6271.6 and 5485. R. C. M., 1936 and
amendments thereto.
BE IT RESOLVED AND IT IS HEREBY
ORDERED BY THE COMMISSION OF THE CITY o:r BOZEMAN.
STATE OF' MONTANA:
Section 1.
That to defray the cost and expense of constructing and making the improvements in said
Special Improvement District
No. 366, there be, and there is hereby levied and assessed a tax amounting
to the sum of Eight Thousand
Three Hundred Ninety Four end 63/100 Dollars ($8394.63) upon all the property
in said Speoial Improvement
District No. 366. that a particula.r description of each lot and parcel of
lend with the name of the owner
and the sum assessed against him or it for such improvements and the
amount of each partial payment
to be made and the day when the same shall be delinquent is set forth in
I detail in the assessment
list hereto attached, marked Schedule !fA", and made a part hereof; that the
several sums set op~osite the names of the ownerS and the described lots and parcels of land be,
and the
same are hereby respeotively levied and assessed upon and against said described lots and parcels
of land
to defray the cost and expense
of oonstructing and making the improvements wi thin said District; that the
several sums so assessed be
collected from the respective owners of said lots and paroels of land
described in said assessment
list, Sohedule "AIf, as required by law; that the payment of said sums shall
be made in ten installments
and the payment of said installments shall extend over a period of nine years;
that the payment of the respeotive
8.nnua1 installments shall be made on or before the 30th day of

of November of each year until payment of all installments together with the interest thereon, shall
be
made; that said sums shall be paid and the oollections thereof shall be made in the manner and in
accordance with the law governing the oollection of special inprovement taxes; that failure to pay
such
assessments when the same beoome due and payable shall make such persons andsaid lots and parcels of
land liable to the penalties provided by ~w relative to delinquent taxes.
Section 2. That the regular
session of the Commission of The City of Bozeman to be held in the
Commission Chamber in the City Ball of said City on the 1st day of July, 1953, at 1:00 o'clook P. M.,

be, and the same is hereby designated as the time and place at which objections to the final adoption
of
this Resolution will be heard by said Commission.
Section 3. That the Clerk
of the Commission of 1he City of Bozeman be, and he is hereby ordered and
directed to publish in the Bozeman Daily Chroniole, a daily newspaper printed and published in the
said
City of Bozeman, a notioe signed by the Clerk of the Commission and stating that a Resolution levying
and
assessing a speoial assessment of taxes to defray the cost and expense of constructing and making the
improvements in the said Speoial Improvement Distriot No. 366 is on file in the offioe of the Clerk
of
the Commission subject to inspeotion for a period of five (5) days; that said Notioe shall state the
time
and plaoe at whioh objeotions will be heard by the Commission to the final adoption of this Resolution;
that it shall be published at least five (5) days before the day set by the Commission for the hearing
of
objections and the final adoption of this Resolution.
Provisionally passed and adopted by the Commission of The City of Bozeman at a regular session thereof'
held on the 24th day of June, A. D. 1953.

DISTRICT NO. 366, CITY OF BOZEMAN, SANITARY SEWER IN THE NORTH MD SOUTH ALLEY IN BLOCKS ONE,
TWO, THREE AND FOUR OF' THE
NORTH SEVENTH ADDITION TO THE CITY OF BOZEMAN, AND THE EXTENSIONS OF
SAID ALLEY BETWEEN A FOINT 150 FEET SOUTH OF TEE SOUTE LINE OF WEST ASPEN STREET AND TEE MANHOLE
AT STATION 47 PLUS 35 OF THE WEST SANITARY TRUNK SEWER.
NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on
the 24th de.y of June, 1953, Commdssion Resolution No. 740 was provisionally passed and adopted; that
said
Commission Resolution levies and assesses a speoial assessment of taxes upon all the property in Speoial
Improvement Distriot No. 366 in said City, to defray the cost and expense of constructing &nd making
tho
improvements within said District, to-wit:
Beginning at the Southwest oorner of Lot Nine, Blook One, of the North Seventh Addition; thence

Northerly along the west lines of Blooks One, Two, Three and Four to the Northwest corner of
said Block Four; thence oontinuing Northerly along the prolongation of the West line of said
Block One to the North City Limits of the City of Bozeman; thence Easterly along the North City
Limits of the City of Bozeman to its point of intersection with the Northerly prolongation of
the East Line of the North and South Alley in said Block One; thence Southerly along the
Northerly prolongation of the East Line of the North and South Alley in said Blook One to the
Northwest corner of Lot Fifteen, of said Block Four; thenoe Easterly along the North lines of
Lots Fifteen and Pourteen of said Block Four to the Northeast corner of said Lot Fourteen;
thence Southerly along the east lines of Lots Fourteen and Seven, of said Block Four~ Lots
Fourteen and Seven of said Blook Three, Lots Fourteen and Seven of said Block Two, and Lot
Twenty-four of said Block One~ to the Southeast corner of said Lot Twenty-four; thence continu-
ing Southerly on the prolongation of the East line of said Lot Twenty-four to its intersection

That. said Commission Resolution No. 740 is now on file in the off'iae of the Clerk of the
Commission, subjeot to inspection
f'or a period of f'ive days by any persons interested. That Wednesday,
the 1st day of' July, 1953.
at 1:00 o'clock P. M. of said day at the regular session of the said
Commission of the City of Bozeman,
at the Commission Room, in the City Hall Building of said City, has
I been designated as the
time and plaoe when and where the said Commission will hear and pass upon any and
all objections that may be made to the final passage and adoption of said Resolution No. 740. and
the
levying of said assessment, and that said Resolution will be finally passed and adopted at said regular
Session.
All persons interested are referred to Commission Resolution No. 720, declaring it to be the
intention of the Commission
to create Speoial Improvement Distriot No. 366, and Commission Resolution No.
726, oreating Special Improvement
District No. 366, for constructing and making the improvements therein.
