COMMISSION RESOLUTION NO. 732
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA
DECLARING IT TO BE THE INTENTION OF SlID COMMISSION TO ABANDON Crry OF BOZ-
EMAN SPECIAL IMPROVEMENT DISTRICT NO. 151 AND TO ABANDON THE MAINTE-
NANCE OF STREET PARKINGS THEREUNDER, AND DIRECTING THE CLERK OF 'rHE
CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION, ALL PURSUANT TO
THE STATUTES IN SUCH CASES MADE AND PROVIDED.
WHEREAS, A petition was filed with the City of Bozeman on January 28, 1953,
by
I owners of sixty-nine
and 8/10 percent (69.8%) of the property in Special Improvement Dis-
trict No. 151 of the City of Bozeman, praying for the abandonment of said District,
and
WHEREAS, it appears
for the best interests of the City of Bozeman and the property
owners within said Special
Improvement District No. 151 that said District be abandoned.
NOW, THEREFOR.E, BE rrr RESOLVED BY THE COMMISSION 0 F THE CITY OF BOZEMAN:
Section 1. DECLARA'rION OF INTENTION.
It is hereby declared to be the intention of
the City Commis sion of theCi
ty of Bo zeman, Bo zeman, Mont ana, to abandon Special Im-
provement District No.
151 of said City and to abandon the maintenance of any street
parking maintenance therein.
Section 2. BOUNDARIES OF DISTRICT.
The b01.U1daries of said Special Improvement Dis-
trict No.
151 are as follows:
Beginning at a point in the center line of Olive street where the same
1s intersected by the center line of Fifth Avenue; thence east along
the center line of said Olive Street to its intersection with the ex-
tended east line of Lot 3 of Cox's Rearrangement of DIock 13 of Park
Addition; thence south along the east line of said Lot 3 and the east
line of Lot 9 of said Cox's Rearrangement of Block 13, along the center
line of the vacated alley in Block 16 of said Park Addition, the same
extended to the center line of Koch Street, thence west along the cen-
ter line of said Koch Street to its intersection with the center line

of said Fifth Avenue; thence north along the center line of said Fifth
Avenue to the place
of geginning.
Section 3.
BENEFITS DECLARED. It is hereby declared by the Coinmission of the City
of Bo~eman that all of the
land within the boundaries of said Special Improvement Dis-
trict No.
151 will be specially benefited by such abandonment and thatit is to the best
interests of the City of Bozeman
and the owners of property within the said District
that the District be abandoned.
Section 4. EFFECTS OF ABANDONMENT.
Should said Special Improvement District No.
151 be abandoned in conformance
to thE Resolution and the Notice to be published pur-
suant thereto,
it shall be the duty of the owners of the property abutting on the prop-
erty involved to maintain the
same after such abandonment, and such abandonment shall
not relieve said property owners
from the assessment and payment of a sufficient amount
to liquidate all charges existing
against said District prior to the date of abandonment.
Section 5. TIME FOR PROTESTS. That
the regular session of the City Commission of
the City of Bozeman to be held
at the Commission Chamber, City Hall Building, Bozeman,
Montana, on Wednesday-,--the
18th day of February, A.D. 1953, at the hour of 1:00 O'CLOCK
P.M.
of said day, are the time and' place when and where the City Commission will hear
I and pass upon all protests
duly and regularly made and filed against the abandonment of
said proposed Special Improvement District No.
15l.
Section 6.
CLERK TO GIVE NOTICE. That the Clerk of the City Commission be~

directed to give notice in the manner and for the time as by law required,
of the adoption of this Resolution
of Intention.

151 are as follows:

Bozeman, Montana, is the dEte,
time and place set for
the hearing of protest against the abandonment of said Special Improvement District No.
151 and for the passage of the Resolution of abandonment.

District No. 151 file written
protest with the Clerk of the City Gommissi.m before the
above specified date and time,
a Resolution of abandonment of sald Special Improvement
District No. 151 will be,
by the City Commission, passed.
That should said Special Improvement District No.
