HomeMy WebLinkAboutResolution 730 Taxes for Sidewalks and Curbs 1952 3~4 COMMISSION RESOLUTION NO. 730 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CER'rAIN PROPERTIES IN THE Crry OF BOZEMAN, COUNTY OF GALLA'rIN, STA'rE OF MONTANA, TO DEFRAY THE COST OF GONSTRU~TING AND INSrrALLING AND/OR REPAIRING MISCELLANEOUS SIDEWALKS AND CURBS DURING THE YEAR 1952. WHEREAS: 1. The Commission of the City of Bozeman, pursuant to the provisions of Ordinance No. 561, entitled: I "AN ORDINANCE COVERING THE CONSTRUC'rIJN AND INSTALLA'rION :>F CONCRE'rE CURBS AND SIDEWALKS IN THE CITY OF BOZEMAN, PROVIDING PENALTIES FOR 'rHE V lOT}. TION 0 F 'rRIS ORDINANCE AND REPEALING ORDINANCES NO'S 365, 37L~, 435, LIlt 7, Lh9, AND L6l, AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES OF 'rI-IE CITY OF BOZEMAN IN CONFLIc'r HEREWITHn, and the provisions of Section 5244, Poli tical Code , R.C.M. 1935, provided for the con- struction of sidewalks and curbs in the Clty of Bozeman during the year 1952, without the formation of a Special Improvement District. WHEREAS, proceedings were had for the construction end installation and/or repair of Mis ce11aneous Sidewalks and Curbs in the Ci ty of Boz eman for the year 1952, and WHEREAS, Miscellaneous Sidewalks and Curbs were constructed and installed and/or repaired bordering on various properties in the City of Bozeman, pursuant to Ordinance No. 561, Section 5244, Political Code, R.C.M., 1935, which are hereby referred to Bnd made a part of this Resolution, and WHEREAS, the said Miscellaneous Sidewalks and Curbs have been constructed and com- pleted and/or repaired in accordance with the terms and conditions of said proceedings, and the City Engineer has duly certified to the Commission a Schedule showing the Side- walks and Curbs which have been constructed and installed and/or repaired, and the I properties which are subject to assessment thereunder and the total cost of said con- struction and installation and/or repairing is the sum of Three Thousand Seven Hundred Ninety One and l2/100ths Dollars ($3,791.12) which Schedule, marked Schedule nAn, is hereto attached and made a part hereof. NOW. THEREFORE, pursuant to the provisions of OrdinBnce No. 561 as aforesaid, and Section 5241./., Political Code, R.C.M., 1935, as aforesaid, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, M:JN'I'ANA: Section 1. That to defray the cost of constructing and installing and/or repairing Miscellaneous Sidewalks and curbs as set forth in Schedule "Au, hereto attached and made apart hereof, there is hereby levied and assessed a tax amounting to the sum of Three . Thousand, Seven Hundred Ninety-one and 12/100ths Dollars ($3,791.12) . Section 2. That a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such construetion and installation and/or repair and the amount of each payment to be made and the day when the same shall be- come delinquent is set forth in the assessment list hereto attached marked Schedule "A" and I , made a pert hereof; that the several sums set opposite the name of the owner and the des- cription or the lots and parcels of land be, and the same are hereby respectively levied and assessed upon said lots and parcels of land to defray the cost and expense of con- structing and installing and/or repairing said Sidewalks and Cmbs; that the several sums so assessed be collected from the respective owners of said lots and parcels of land des- cribed in said assessment list as required by law; that the payment of said sums shall be made in six installments; that the payment of said installments shall De made on or 345 before the 30th day of November of each year until payment of all installments together with the interest thereon, shall be madej that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collec- tion of Special Improvement taxes; that failure to pay such assessments when the same shall become due and payable shall make such persons and said lots and parcels of land I liable to the penalties provided by law relative to delinquent taxes; Section 3. That the regular session of the Connnission of the City of Bozeman to be I held in the Commission Chamber in the City Hm I of said City on the 22nd day of October, 1952, at 1:00 o'clock P.M., be, and the same is hereby designated as the time and place at which objections to the fin? I adoption of this Resolution will be heard by said Commission. Section 4. That the .clerk of the Commission of the City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily new~paper printed and published in the said City of Bozeman, a notice signed by the C~rk of the Commission and stating that a Resolution Levying and assessing a special assessment of taxes to defray the c03t and expense of 00 nstructing and installing and/or repairing Sidewalks and Curbs in the City of Bozeman for the year 1952 is on file in the office of the Clerk of the Commission subject to inspection for a period of five ( 5) days; that said Notice shall state the time and place at which objectfuns will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five (5) days before the dat €I set by the Commission for the hearing of objections and I the final adoption of this Resolution. Provisionally passed and adopted by the Commission of the City of Bozeman at a re,gular session thereof, held on the 15th day of October, 1952. Attest: //#~ <<- tP~ Clerk of the Commission Mayor NOT ICE HEAR lNG, FINAL ADOPTION CONrMISSION RESOLU'rION NO. 730 LEVYING ASSESSMENT TAXES, CONS'I'RUCTION AND INSTALLATION AND/OR REPAIR MISCELLANEOUS SIDE- WALKS AND CURBS IN THE CITY OF BOZEMAN DURING THE YEAR 1952. NOTICE IS HER~Y GIVEN, that at a regular session of the Commission of the Clty of I Bozeman held on Wednesday, the 15th day of October, 1952, Commission Resolution No. 730 was provisionally passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon certain lots and parcels of land in front, or on the side of which, sidewalks and curbs have been constructed and/or repaired pursuant to the provisions of Ordinance No. 561 and Section 5244, Political Code, R.C.M., 1935, to defray the cost and expense of constructing and installing and/or repairing said Sidewalk~and Curbs. That said Commission Resolution is now on file in the office of the Clerk of the Com- Resolution No. 730 - -- 346 mission, subject to inspection for a period of five (5) days by any persons interested; that Wednesday, the 22nd day of October, 19,2, at 1:00 o'clock P.M. of said day, at the regular session of the said Commission of the City of Bozeman at the Commission Chamber, C it Y Hall Bui 1 din g 0 f sald City, has been designated as the time and place when and where the -said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of s~d Resolution No. 730 and the le vying of I said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to said Ordinance No. 561, and the Commissioner's proceedings for the construction and/or repair of Miscellaneous Sidewalks and Curbs, in front of or on the side of lots and parcels of land within the City ofrlozeman for the year 1952, without the formation of a Special Improvement District.
