SUBJECT: Public Street & Utility Access Easement for Story Mill Road – Story Mill
Neighborhood Annexation (#A-07003)
Consent Agenda Item
MEETING DATE: Monday, September 17th 2007
RECOMMENDATION: The City Commission makes a motion authorizing the City Manager to
sign the easement document.
BACKGROUND: A Public Street & Utility Easement is enclosed to provide future extension of
Story Mill Road across lands of the Story Mill Neighborhood Annexation. The developer was
required to provide the easement as a condition of annexation approval. Engineering staff has
reviewed the document and has found it to be acceptable.
UNRESOLVED ISSUES: The Department of Planning is not aware of any unresolved issues for
the proposed development at this time.
FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased
property tax revenues from annexation of the property, and costs from additional service demand.
ALTERNATIVES: As suggested by the City Commission.

PUBLIC STREET AND UTILITY EASEMENT
BLUE SKY DEVELOPMENT, WAKE UP INC. AND CLIFFORD AND SALLY FRANKLIN
CHRISTIE, GRANTORS, in consideration of $ 1.00 and for other and valuable considerations,
receipt of which is acknowledged, grants to The City of Bozeman, a municipal corporation of the
State of Montana, with offices at 411 East Main, Bozeman, Montana 59715, GRANTEE, its
successors and assigns, a perpetual street and utility easement for the use of the public, in,
through, and across a strip of land situated in Gallatin County, Montana, 90 feet wide to be
located on the following described real property:
An area of land located in Section 31 and Section 32, Township 1 South, Range 6 East,
and in Section 5 and Section 6, Township 2 South, Range 6 East, Principal Meridian
Montana (P.M.M), City of Bozeman, Gallatin County, Montana being more particularly
described as follows:
BEGINNING at a calculated position from which the southeast corner of said
Section 31, bears South 00° 48' 33" East a distance of 494.64 feet;
thence South 89° 10' 05" East a distance of 29.94 f eet to a calculated position;
thence South 89° 24' 27" East a distance of 15.11 f eet to a calculated position;
thence South 00° 48' 17" East a distance of 344.55 feet to a calculated position;
thence south a distance of 224.27 feet along a tangential curve concave east having
a radius of 655.00 feet, a central angle of 19° 37' 06", a chord bearing of
South 10° 36' 50" East and a chord length of 223.18 feet to a calculated position;
thence South 20° 25' 23" East a distance of 100.18 feet to a calculated position;
thence south a distance of 244.32 feet along a tangential curve concave east having
