SUBJECT: Public Street & Utility Access Easement for Griffin Drive – Story Mill
Neighborhood Annexation (#A-07003)
Consent Agenda Item
MEETING DATE: Monday, September 17th 2007
RECOMMENDATION: The City Commission makes a motion authorizing the City Manager to
sign the easement document.
BACKGROUND: A Public Street & Utility Easement is enclosed to provide future extension of
Griffin Drive across lands of the Story Mill Neighborhood Annexation. The developer was required
to provide the easement as a condition of annexation approval. Engineering staff has reviewed the
document and has found it to be acceptable.
UNRESOLVED ISSUES: The Department of Planning is not aware of any unresolved issues for
the proposed development at this time.
FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased
property tax revenues from annexation of the property, and costs from additional service demand.
ALTERNATIVES: As suggested by the City Commission.

PUBLIC STREET AND UTILITY EASEMENT
WAKE UP INC., GRANTOR, in consideration of $ 1.00 and for other and valuable
considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal
corporation of the State of Montana, with offices at 411 East Main, Bozeman, Montana 59715,
GRANTEE, its successors and assigns, a perpetual street and utility easement for the use of the
public, in, through, and across a strip of land situated in Gallatin County, Montana, 60 feet wide
to be located on the following described real property:
An area of land located in Section 31, Township 1 South, Range 6 East,
and in Section 6, Township 2 South, Range 6 East, Principal Meridian
Montana (P.M.M), City of Bozeman, Gallatin County, Montana being
more particularly described as follows:
BEGINNING at a calculated position from which the southeast corner of said
Section 31, bears South 88° 35' 12" East a distance of 340.31 feet;
thence South 88° 06' 19" East a distance of 241.97 feet to a calculated position;
thence east a distance of 67.25 feet along a non-tangential curve concave north having
a radius of 200.00 feet, a central angle of 19° 15' 57", a chord bearing of
North 82° 15' 42" East and a chord length of 66.93 feet to a calculated position;
thence south a distance of 60.10 feet along a non-tangential curve concave east
having a radius of 745.00 feet, a central angle of 04° 37' 20", a chord bearing
of South 13° 52' 12" East and a chord length of 60.09 feet to a calculated position;
thence west a distance of 83.76 feet along a non-tangential curve concave north
having a radius of 260.00 feet, a central angle of 18° 27' 26", a chord bearing

containing 1.144 acres, more or less.
The GRANTOR state that they possess the real property described above and that they
have a lawful right to grant an easement thereon.
The GRANTOR further agree that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
