Kukulski, City Manager SUBJECT: Breaking of the 2-2 tie vote on Cr. Kirchhoff’s motion to approve Aspen Park Major Subdivision Preliminary Plat with conditions in the Planning Board Resolution and the addition of a new condition prepared by the applicant's representative and the Middle Creek Ditch Company (condition 39) MEETING DATE: September 10, 2007 RECOMMENDATION: Cr. Jacobson, after reviewing the record and stating such, should vote on the motion as transcribed below: Motion: It was moved by Cr. Kirchhoff, seconded by Cr. Becker, to approve Aspen Park Major Subdivision Preliminary Plat with conditions in the Planning Board Resolution and the addition of a new condition prepared by the applicant's representative and the Middle Creek Ditch Company (condition 39). Vote: Those voting Aye being Cr. Becker and Mayor Krauss. Those voting No being Crs. Rupp and Kirchhoff. Those absent being Cr. Jacobson. The vote ties 2-2. BACKGROUND: On September 4, 2007 a motion was made by Cr. Steve Kirchhoff related to the September 4, 2007 Agenda item G 7 [Aspen Park Major Subdivision Preliminary Plat #P-07027] to approve Aspen Park Major Subdivision Preliminary Plat with conditions in the Planning Board Resolution and the addition of a new condition prepared by the applicant's representative and the Middle Creek Ditch Company (condition 39). Cr. Kaaren Jacobson was absent from the proceedings and therefore did not cast a vote at the September 4, 2007 meeting. The vote resulted in a 2-2 tie and therefore Commissioner Jacobson should cast a vote on the motion transcribed above. ALTERNATIVES: As suggested by the City Commission.
