SUBJECT: First Reading Ordinance No. 1718; HB Zone Map Amendment Z-05048
MEETING DATE: Tuesday, September 4, 2007
RECOMMENDATION: Adopt Ordinance No. 1718.
BACKGROUND: The City Commission previously approved annexation of land lying west of South
19th Avenue and north of Graf Street. The required annexation agreement has been returned and is
complete. This ordinance formally completes the necessary initial zoning as part of the annexation
process. The ordinance is in accordance with the Commission’s initial approval.
UNRESOLVED ISSUES: None identified at this time.
FISCAL EFFECTS: Additional revenues will be obtained from newly annexed land and additional
costs for services will be incurred.
ALTERNATIVES: As suggested by the City Commission.

ORDINANCE NO. 1718
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, AMENDING THE BOZEMAN’S OFFICIAL CITY
ZONING MAP’S ZONING DISTRICT DESIGNATIONS BY ESTABLISHING
A NEW ZONING DESIGNATION OF “R-4” (RESIDENTIAL HIGH
DENSITY DISTRICT) ON ~ 28 ACRES SITUATED IN A PORTION OF
SECTION 23, T2S, R5E, PMM, CITY OF BOZEMAN, GALLATIN COUNTY,
MONTANA, AND LOCATED WEST OF SOUTH 19TH AVENUE AND
NORTH OF GRAF STREET
WHEREAS, the proposed zone map amendment to establish a new zoning designation of
“R-4” (Residential High Density District) on ~ 28 acres has been properly submitted, reviewed and
advertised; and
WHEREAS, the City of Bozeman Zoning Commission held a public hearing on May 17,
2005, to receive and review all written and oral testimony on the request for a zone map amendment;
and
WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman
City Commission that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on June 20,
2005, to receive and review all written and oral testimony on the request for a zone map amendment;
and
WHEREAS, the City Commission has reviewed and considered the twelve zone change
criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, as
recommended by the Zoning Commission, to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on June 20, 2005, the City Commission found that the
proposed zone map amendment would be in compliance with the Bozeman 2020 Community Plan
and would be in the public interest.
WHEREAS, the City Commission has reviewed and considered the proposed zone map

amendment forwarded by the Zoning Commission
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of
Bozeman, Montana:
Section 1
That the zoning district designation of the following-described property is hereby
established as "R-4" (Residential High Density District):
A tract of land being Lot 2 of Minor Subdivision No. 235, located in the Northeast One-Quarter of
Section 23, Township 2 South, Range 5 East, Principal Meridian Montana, Gallatin County,
Montana, and being more particularly described as follows:
Beginning at the Northwest corner of said Lot 2;
thence South 88°54'02" East, a distance of 1295.45 feet to a point on the East line of said section 23;
thence South 00°34'15" West, along said East line a distance of 963.21 feet;
thence North 88°54'36" West, a distance of 1303.27 feet;
thence North 01°02'09" East, a distance of 963.39 feet to the Point of Beginning.
Said tract of land being 28.73 acres, along with and subject to any existing easements.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading, at a
