REPORT TO: Honorable Mayor and City Commission

SUBJECT: CFT Office Building CUP, #Z-07017
MEETING DATE: Tuesday, September 4th, 2007 (Continued from August 27th)
RECOMMENDATION: That the City Commission considers the removal of Condition of
Approval #1 regarding the connection of Opportunity Way from Application No. Z-07017 as
outlined in the attached submittal materials.
BACKGROUND: On Monday, May 7th, 2007 the City Commission approved this Conditional
Use Permit (CUP) application to permit the construction of a 3-story, 72,000 square foot office
building, and related site improvements, on 4.81 acres of property located NE of the intersection of
South 11th Avenue & Opportunity Way. At this hearing, the City Commission added a condition
regarding the connection of Opportunity Way; this condition states that “An acceptable connection
of Opportunity Way must be worked out with the City Engineer and the owners of the Allison
Subdivision prior to Final Site Plan approval”. Upon review of this condition, the applicant has
indicated that it is not reasonable to extend Opportunity Way across the subject property (see
attached correspondence from applicant dated June 19, 2007 and July 17, 2007). Thus, the applicant
has requested the City Commission remove this Condition of Approval from this Conditional Use
Permit (CUP) application.
On Monday, August 27th, the City Commission considered the applicants request to remove
Condition of Approval #1 from the above referenced project. After much discussion, it was
concluded that more specifics regarding the Allison Subdivision Preliminary Plat and relevant
conditions were needed. The hearing was open and continued to the next possible City Commission
date. Attached, please find three (3) exhibits that include both the subject property and the Allison
Subdivision Preliminary Plat. The applicant has proposed to grant a Right-of-Way easement across
the southwest corner of Lot 1 of the CFT property. Furthermore, additional research into the exact
motion language from the Allison Subdivision Preliminary Plat hearing has found it to read “to
extend Opportunity Drive to Salgado Circle and connect the cul-de-sac at Salgado Circle and
Drobnyk Circle through to Opportunity Way”.
UNRESOLVED ISSUES: The Department of Planning is not aware of any additional unresolved
issues for the proposed development at this time.
ALTERNATIVES: As suggested by the City Commission.
