A RESOLUTION OF THE CITY COIAMISSION OF THE CITY OF' BOZEMAN. MONTANA. AUTHORIZING THE MAYOR
01" THE CITY 01" BOZE.'MAN TO EXECUTE AN APFLICATION FOR AN UNDERTAKING ON ATTACHMENT FOR AND
ON BEHALF 01" THE SAID CITY OF' BOZEMAN. IN THE MATTER OF THE CITY OF BOZEMAN. PLAINTIFF. VS.
DONALD L. HENRY. ALSO KNOWN AS D. L. HEli"RY. ALSO IrnOWN AS AND DOING BUSINESS AS NORTHWEST
CONSTRUCTION AND EQUIPMENT COMPANY AND MONTANA EQUIPMENT COMPANY. DEFENDANT.
WHEREAS, Donald L. Henry. Cashier and Water Collector of The City of Bozeman. Montana, has unlaw-
I fully taken and carried
away funds belonging to The City of Bozeman in the amount of approximately
Sixty-six Thousand Dollars ($66.000.00); and
WHRREAS, It is necessary
and desirable that The City of Bozeman attach any and all assets in
the State of Montana belonging
to the said Donald L. Henry; and
VffiEREAS, Under the statutes of the State of Montana. made and provided. the maximum bond to be
furnished by an attaching Plaintiff
is in the amount of Ten Thousand Dollars ($10.000.00).
NOW THEREFORE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That W. A. Secor, Mayor of The City of Bozeman, be and he is hereby authorized and directed to
make and execute for and upon
behalf of the said City of Bozeman. the necessary application for the
aforementioned undertaking
on attachment and to make and execute any and all other papers or documents
necessary to effect the attachment
and detention of any assets within the State of Montana belonging
to one Donald L. Henry. and
the Clerk of the City Commission is hereby authorized and directed to make
and execute the necessary Certificates
as to the passage and adoption of this Resolution.
Section 2
I
This Resolution shall be in force and effect immediately from and after its passage and adoption.
Passed and adopted
by the Commission of The City of Bozeman at a regular session thereof held
on July 15, 1953.
