LEVYING AND ASSESSING AND ASSESSING A SPECIAL ASSESSlI/IE:'JT OF 'rAXES UPON ALL THE PROP2.:R'ry IN SPECIAL IMPROVEMENT ~1ISTRIc'r3 OF 'rIfE CITY JF BOZEMAN, COUNTY OF GALLATIN, 3'rATE OF MONTANA, FOR THE MAINTENANCE OF PARIUNGS TO DEFRAY 'rilE COST OF MAINTAINING THE PAR KINGS WITHIN SAID SPECIAL TMPROVEMENT DISTRICTS OF THE CI'rY OF BOZEMAN FOP THE YEAR 1954. I WHEREAS, the City Council and the Commission of the City of Bozeman have heretofore . duly and regularly passed Council and Commiss~on Resolutions creating Special Improvement Dis tricts wi thin the City of Bozeman, defining the :)oundaries thereof and providing for the maintenance of parkings therein, and for the assessment of the cost of maintaining the parkings as set forth in Resolutions hereinafter referred to; and 'NHEREAS, the parkings within the boundaries of said Special Improvement Districts have been cared for and maintained during the year 1~)54, as contemplated in said Resolutions, in accordance with terms and conditions thereof; and WHEREAS, said Apecial Improvement Districts for the maintenance of parkings and the Resolutions creating the same, the total frontage or the area, of the property within said districts to be assessed, the total cost of said maintenance within said districts and the amount chargeable to the property therein, is hereinafter set forth, NOW, THEREFOR1~, pursll.ant to the provisions of Section ll-222h" Political Code, R. C. M., 1947, and said Council and Commission Resolutions, creating said Special Improvement Districts, and providing for the maintenance thereof; BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF' 'rIIE CITY OF BOZEMAN, STATE OF MONTANA: I Section 1. 'fhat for the year 1954, the City of Boaeman has defrayed the cost ($5,366.88) of maintenance of parkings in the several Apecial Improvement Districts, pursuant to ResolutiLJns creating the same, and that the entire cost thereof, the total number of 1inea-l feet, or area, of the property to be assessed, and the rete per linear foot or square foot, is as follows, to-wit: Dist. That to defrey the eost of amintenance of parkinrs within sald Special I Improvement Districts for the year 1954, there be and there is hereby levied and assessed a tax upon all the property in front of and bordering on said Special Improve- ment Districts as set forth i~ Schedules one to nineteen inclusive, hereto attar:hed and made a part hereof; that a particular description of each lot and parcel of land with the name of the owner and the S1~ assessed aGainst him or it, ts set forth in the assess- ment lists hereto attached, marked "Schedule One (1) to Nineteen (19)" and made a part hereof; that the several sums set opposite the names of the o\vners and the described lots and parcels of land be, and the same are hereby levied and assessed upon and against the said lots and parcels of land; that the several sums be collected from the respective owners of said lots and parcels of land described in the said assessment lists, Schedules One to N1neteen inclusive, as required bv law; that said sums shall be paid and the collec- tion thereof shall be made in the manner and in accordance with the law governing the collection of Apecial Improvement taxes; that failure to pay such assessments when same shall become due andj)ayable shall make such person and such lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 3. That the regular session of the Commission of the City of Bozeman to be I held on the 29th day of September, 1954 at the Commission Chamber, City Hall Building, be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by the Commission. Section 4. That the Clerk of the Commission be, and he is hereby ordered and directed to publish i~ the Bozeman Daily Chronicle, a daily newpaper, printed and pub~ishe~ in the City of Bozeman, , " a notice signed by the Clerk of the C~mmission, and stating that a resolution levying a special assessment to taxes to defray the cost of maintenance of parkings in the said Special Improvement Districts for the year 1954, is on file in the office of the Clerk of the Co~mission, subject to inspection for a period of five days; that said notice shall state the time and pIce at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least; five days before the date set by the Commission for hearing objections, and the final adoption of this Resolution. Provisionally passed and adopted by the Commission of the City of Bozeman at a regular meeting of sai'd Commission, September ?2nd, 1954. NOTICE IS HEREiY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 22nd day of September, 1951.-1-, Commis s ion Resolution No. I 770 was duly passed and adopted;that said Commission Resolution No. 770 levies and assesses a special assessment of taxes upon all the property in Special Improvement Districts of said City to defray the cost of maintenance of parkings within said Special Improvement Districts for the year 1954. All persons interested are referred to the several ~ouncil and Commission Rp'solutions creating the aforesaid Special Improvement Districts, definlng the bO'LU1daries thereof, and providing for the assessment of the cost of said maintena.nce of parkings.
