WHEREAS:
'rhere has been filed with the Clerk of the City Commission of The Ci ty
of Bozeman, Montana,
a petition in due form of certain property owners on North Tracy
Avenue from Short Street to
Peach Street, asking that a special improvement
district be
created for the purpose of
constructing and installing a pavement project on North 'rracy
Avenue from Short Street to
Peach Street, said pavement project to
include the installation
of crushed gravel base course,
crushed gravel cushion course and bituminous
surface
course:
and
WHEREAS: That at a regular meeting of the City Commission of the City of Bozeman
held on the 28th day of July,
195LI , the aforesaid petition
was considered ang granted;
now,
THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION
JF THE CI'rY OJ<' BOZEMAN:
Section 1- DECLARA'rION OF IN'rEN'rION.
That iit is hereby declared to be the inten-
tion of The City of Bozeman
to create a special improvement district to be known and
designated as Special Improvement
District No. 380 of The City of Bozeman for the purpose
of constr~ting and installing
a pavement project on North Tracy Avenue from Short Street
I to Peach Street,
said pavement project to include the installation of Cur shed Gravel Base
Course, Curshed
Gravel Cushion Course and Bituminous Surface Course.
Section 2.
BOUNDARIES. The boundaries of said Special Improvement District No.
380
are described as follows:
Beginning at
the Southwest Corner of Block F of Beall's Second Addition
to The City of Bozeman,
thence Easterly along the North Line of Short
Street to a point on the West Line
of the N0rth and South alley in said
Block F;
thence Northerly along the West Line of said alley to a point
on the South Line of Peach Street;
thence Westerly along the South Line
of Peach Street to a point on the East
Line of the N rth and South alley
in Block One (1), of Beall's Third Addition
to The City of Bozaman;thence
Southerly along the East Lin e of the
alley in said Block One (1) to a
point on the Nnrth Line of Short Street;
thence Easterly along the NQrth
Line of Short Street to the point of
beginning.
Section 3. CHARACTER OF IMPROVEMEN'rS.
The character of the improvements to be made
within said Special Improvement
District No. 300 is:
The construction and installation
of a pavement project on North
Tracy Avenue from Short Street to Peach Street, said pave-
ment project to
include the installation of curshed gravel base course,
crushed gravel
cushi,on course and bituminous
surface course.
Section ~. ESTIMATE OF COST. The
preliminary estimate of the cost of said improve-
I ments,
lncluding all street excavation, materials,
installation costs, engineerIng and
incidentals is Five Thousand. Eight Hundred Sixty-nine and70/100 Dollars
($5,869.70).
Section S.
MET'.IOD OF ASSESSMENT. The preliminary estimate of cost of
said improve-

men ts,
inc 1 ud ing all street excava ti on, na terIals , installation costs,
engineering and
indidentals as set forth above,
is to be assessed against the property within said Dis-
trict on a front foot basis.
The estimated rate of assessment is $9.8485 per front foot.
Section 6. ACTUAL FRONTAGE OF DISTRICT.
The tctal actual frontage of all property
within said proposed Special
Improvement District Number 380 is 596 feet, which is the

frontage on which all protests will be received,
considered and determined.
Section 7.
PAYMENTS. That payments for said improvements shall be made
in twenty
(20) equal annual installments
extending over a period of nineteen (19)
ye ar s , but thi s
shall not be con s trued to prevent pavmen t in full a t any regular payment de.t e by any prop-
erty owner who desires to do so.
It is proposed to pay the entire cost and expense of the
cons truc t ion and
installation of said improvements with cash to be obtained from the sale
of bonds of said Special Improvement District No.
380, as authorized by law.

F1md Jf The City of Bozeman. The bonds will be redeemable at
the option of the City,
singly or in multiples, and in the order of their registration,
whenever funds are available for that purpose in said Special Improvement District No.
380. Said bonds shall
draw a simple interest from the date of their registration until
called for payment,
at a rate not exceeding six (6%) per cent per annum,
which interest
shall be chargeable as a part of the cost of the construction and installation of said
improvemen t. The bonds
will be issued and sold in accordance with the provisions of Sec-
tion 11-2232 and 11-2271,
Revised Codes of Montana, 19L(7,
and all other applicable provi-
sions of Title 11 of the Revised Codes of Montena,
19L 7 , relating to
spe cia 1 improvement
districts in citites
and towns, and any amendments
thereof or thereto.

the regular session of the City Commission of

upon all protests duly and regularly made and filed against the creation of saidproposed
Special Improvement District No.

or either thereof; and the Clerk of the City Commission be,
and he is hereby directed to give notice in the manner and for the tine as by law required,
of the adoption of this Resolution of Intention.

Bozeman, Montana, is designated by said Resolution No.
767 as the

time and place for hearing
objections to the action proposed to be taken by said resolu-
tion,
and when and where any and all persons whose property is within said proposed Special
Improvement District No.
380 on North Tracy Avenue from Short Street to Peach Street,
in
said City may appear and show
cause, if any they have,
against said proposed improvement.
Objections must be made in
writing and filed with the Clerk of the City Commission not
I later
than fifteen ( IS)
days after the date of the first publication of this N~tice.
An approxlmate andpreliminary
estimate of the cost of doing such work and amking such
lmprovement within said District,
including all street excavation, materials, installation
costs, engineering and incidentals,
which is to
be specially assessed against the property
within said District,
is *5,869.70. The total actual frontage of all
property within the
proposed District,
exclusive of streets, avenues,
and a lleys is 596 feet. Payment
for
the improvements
is to be made
in 20 annual installments over a period of 19 years with
interest on the deferred payments
not to exceed six (6%)
percent per annum, payable an-
nually,
but this shall not be construed to prevent payment in full at any regular payment
date by any property owner.
