HomeMy WebLinkAboutResolution 763 Create SID 379 North Willson 427 COMMISSION RESOLUTION NO. 763 A RESOLUTIO~ OF 'fHE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREtTE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 379 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON NORTH WILLSON AVENUE FROM WEST LAMME STREET TO WEST VILLARD S'fREE'f, SAID PAVEMENT PROJECT TO INCLUDE THE INSTALLATION OF CRUSHED GRAVEL BASE COURSE, CRUSHEDGRAVEL CUSHION COURSE, BITUMINOUS SURFACE COURSE, AND CONCRETE CURBS WHERE NOT ALREADY PLACED AND IN STAISFACTORY I CONDITION. WHEREAS: There has been filed with the Clerk of the City Commission of The City of Bozeman, MOntana, a petition in due form of certain owners of properties situated on North Willson Avenue from West Lamme Street to West Villard Street in said City asking that a special improvement district be created for the purpose of constructing and installing a pavement project to include the installation of curshed gravel base course, crushed gravel cushion course, bituminous surface course, and concrete curbs where not already placed and in satisfactory condition: WHEREAS: That at a regular meeting of the City Commission of The City of Bozeman held on the 9th day of Jt/~n!, 1954, the aforesaid petition was respectively considered and granted; '...' now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1. DECLARA'fION OF INTENTION. That it is hereby declared to be the intention of Th~Ci ty of Bozeman to create a special improvement district to be known and designated \ as Spe~ial Improvement District No. 379 of The City of Bozeman for the purpose of con- structing and installing a pavement project on NOrth Willson Avenue from West Lamme I Street to West Vollar~ Street, said pavement project to include the installation of crushed gravel base course, crushed gravel cushion course, bituminous surface course, and concrete curbs where not already placed and in staisfactory condition. Section 2. BOUNDARIES. The boundaries of said Special Improvement District No. 379 are described as follows: Beginning at the Southwest Corner of Block A of Tracy's Third Addition to the City of Bozeman, Montana, thence Easterly along the North Line of West Lamme street a distance of 131 feet; thenceNortherly 131 feet Easterly from and parallel to the East Line of North Willson Avenue to a point of inter- section with the South Line of West Beall Street; thence Northerly across West Beall Streetto a point on the South Line of Block Three (3) of Ball's '" Third Addition to the City of Bozeman, Montana, located 131 feet Easterly from the East Line of North Willson Avenue; thence Northerly 131 feet East- erly from and aprallel to the East Line of North Willson Avenue to a point on the South Line of West Villard Street; thence Westerly along the South Line of West Villard Street to a point 131 feet Westerly from the West Line of North Willson Avenue; thence Southerly 131 feet Westerly from and parallel to the West Line of North Willson Avenue to a point on the North Line of West Beall Street; thence Southerly across West Beall Street to a point on the North Line of Block B of the said Tracy's Third Additionlocated 131 feet Westerly from the Northeast Corner of said Block B; thence Southerly 131 feet Westerly from and aprallel to the West Line of North Willson Avenue to a point on the North Line of West Lamme Street; thenceEasterly along the North Line of West Lamme Street to the point of beginning. Section 3. CHARACTER OF TI1PROVEMENTS. Construction of a pavement project on I North Willson Avenue from West Lamme Street to West Villard Street, said pavement project to include the construction and installati,m of crushed gravel base course, crushed gravel cushion course, bituminous surface course, and concrete curbs where not already placed and in staisfactory condition. Section 4. Estimated Cost. The preliminary estimate of cost if Twelve thousand seven hundred seventy-one and 60/100 dollars including all street excavation, all materials, in- stal1B. tion costs, engineering and incidentals. -.......-...-..- ....----.. -...-.----....-. -----.-..- ._.~- 428 Section 5. METHOD OF ASSESSMENT. The preliminary estimate of cost set forth above is to be assessed agsinst the property within said District on an area basis as :fbllows: Costs of the .project will be assessed on an area basis, with the first 25 feet of each lot next adjacent to the improvement being recorded at double its actual area in computing the assessable area of each lot. On this basis the assessable area of the dis- trict is 154,798.8 square feet and the estimated cost per square foot is $0.0825045. The I cost per square foot includes the cost of new curbs for the entiredistrict, but where curbs have already been placed along the frontage of Bny particulfJr props rty and are in satisfactory condition, these curbs will be left i~ place, and when assessments are made, the assessments for that particular piece of property will be credited by an amo1Z1t equal to the cost of new curbs along the frontage of that particular piece of property. Section 6. ACTUAL AREA OF DISTRICT. The total actual area of all property within Special Improvement District No. 379, exclusive of streets, avenues and alleys, is 129,991.3 square feet, which is the area on which all protests will be decided. Sect:!.on 7. PAYMENTS. That payments for said improvements shall be made in twenty ( 20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 379, as authorized by law. Such bonds will be in denominationsof $100.00 each and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as I Special Improvement District No. 379 Fund of The City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of thei~ registration, whenever funds are available for that purpose in said Special Improvemen t District No. 379. Said bonds shall draw a simple interest from the date of their regis- tration until called for payment, at a rate not exceeding six (6%) per cent per annum, which interest shall be chargeable as a part of the cost of the construction and instal- lation of said improvement. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 19h7, re- lating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 8. PROTESTS AND NOTICE. That the regular session of the City Commission of The City of Bozeman, to be held at the Commission Chabmer, City Hall BUilding, Bo zeman, Montana, on Wednesday, the 30th day of June, 1954, , at the hour of one o'clock P.M. of said day, are the time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said pro- I posed Special Improvement District No. 379, the improvement proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and he is hereby directed to give notice in the manner and for the tirre as by law required, of the adoption of this Resolution of Intention. Adopted by ithe Commission of The City of Bozeman, Montana, at a regular and stated session of said Commission held on the 9th day of June A. Notice is hereby given that on the 9th day of June, A. That Wednesday, the 30th day of June, A.D. 1954, at one o'clock P.M. at the Commission Room of the City Hall, Bozeman, Montana, is designated by said R.esolution No. 763 as the time and place for hearing objections to the action proposed to be taken by said resolution, and when and where any and all persons whose property is within said proposed Special Im- provement District No. 379 on North Willson Avenue from West Lamme Street to West Villard Street in said City may appear and show cause, if any they have, against said proposed improvement. Objections must be made in writing and filed with the Clerk of the City Gommission not later than fifteen (lS) days after the date of the first publication of th is Not ice. An approximate preliminary estimate of the cost of doing such work and making such inprovement wi thin said District, including all street excavation, all materials, instal- I lation costs, engineering and incidentals, which is to be specially assessed against the property within said District, is $12,771.60. The total assessable area of all property within the said District, exclusive of streets, avenues and alleys with the 25 feet adja- cent to the improvement taken at double its actual area, is 154,798.8 square feet. The Cost per square foot includes the cost of new curbs for the entire district, but wherecurbs have already been placed along the frontage of any particular property and are in satisfactory condition, these curbs will be left in place, and when assessments are made, the assessments for that particular piece of property will be credited by an amount equal to the cost of new curbs along the frontage of that particular piece of property. Payment for the improve- ments is to be made in twenty (20) annual installments over a period of nineteen ( 19) years with interest on the deferred payments not to exceed six (6%) percent per annum, payable annually, but this shall not be construed to prevent payment in full at any regular pay- ment date by any property owner.
