HomeMy WebLinkAboutResolution 762 Vacate a Portion of East Main Street u..._.._ 425 COMMISSION RESOLUTION NO. 762 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE A PORTION OF EAST MAIN STREET IN SAID CITY OF BOZEMAN WHEREAS, a portion of East Main Street in The City of Bozeman, is no longer in use by virtue of the relocation of East Main Street to conform with U. S. Highway No. 10; and I WHEREAS, The City Commission has determined that the same may be vacated without detriment to the public interest and should be vacated in the public interest. NOW, THEREFORE, BE IT R~SOLVED BY TI{E COMMISSION OF THE CITY OF BOZEMAN: Section l. DECLARATION OF INTENTION. It is hereby declared to be the intention of the Commission of 'rhe Ci ty of Bozeman to vacate the following described portion of East Main Street in the said City of Bozeman: ALL THA'r PART OF Eas t Main Street of the City of Boz eman, Mont ana, included within the following metes and bounds, to wit: Beginning at the intersection of the North Line of Main Street with the West Line of Aylsworth Avenue, as originally platted in the Northern Pacific Addition to the City of Bozeman, said point of beginning being also the Southeast Corner of Block Twenty- eight (28) of said addition, thence from said point of beginning Westerly alonr the North Line of Main Street 276 feet, more or less, to a point one 1) foot West of the Southeast Carner of Lot Twenty-eight (28) of said Block Twenty-eight ( 28) ; thence Southerly parallel to the West Line of Aylsworth Avenue a distance of 90 feet, more or less, to a point of inter- section with the $outh Line of Main Street; thence Easterly along the South Line of Main Street (said South Line being also the North Line of Block Twenty-three (23) of said addition: 276 feet, more or less to a point of intersection with the West Line of Aylsworth Avenue, said point of intersection being the Northeast Corner of said Block Twenty-three (23) ; thence northerly along the West Line of Aylsworth Avenue 90 feet, more or less, to the point of beginning. subject to objection of owners of property affected by such proposed vacation, in accord- I ance with the provisions of Section 11-3310 of the Revised Codes of Montana, 1947. Section 2. TIME OF OBJECTION. That the regular meeting of the Commission of The City of Bozeman to be held on Wednesday the 9th day of Juen, 19.54, at the hour of 1:00 o'clock P.M. of said day, at the Commission Room in the City Hall Building, Bozeman, Montana, is the time when and the place where the City Commission will consider and pass upon objections to said proposed vacation and the City Manager is directed to give notice thereof in the manner and for the time as provided in said Section 11-3310 of the Revised Codes of Montana, 194.7 . I NOTICE IS HEREBY GIVEN: That the Commission of The City of Bozeman has adopted a resolution declaring it to be the intention of said Commission to pass an ordinance va- cating that portion of East Main Street in said City described as follows: All that part of East Ma~n Street of the City of Bozeman, Montana, in- cluded within the following metes and bounds, to-wi t: Beginning at the in- tersection of the North Line of Main Street with the West Line of Aylsworth Avenue, as originally platted in the Northern Pacific Addition to the City of Bozeman, said point of beginning beiftg'slso the Southeast Corner of Block Twnety-eight (28) of said addition, thence from said point of beginning Wes- terly along the N~rth Line of Main Street 276 feet, moreor less, to a point one (1) faot West of the Southeast Corner of Lot Twenty-eight (28) of said --_.._.~._-- ~26 Block Twenty-eight ( 28) ; thence Southerly parallel to the West Line of Aylsworth Avenue a distance of 90 feet, more or less, to a point of intersection with the South Line of Matn Street; thence Easterly along the South Line of Main Street (said SouthLine being also the North Line of Block Twenty-three (23) of said addition) 276 feet, more or less to a point of intersection with the West Line of Aylswort~ Avenue, said point of intersection being the Northeast Corner of said Block Twenty-three ( 23) ; thence Northerly along the West Line of Aylsworth Avenue 90 feet, more or less, to the point of begin~ing, the City Commission being of the opinion, after due consideration, that said -petition I may be granted without detriment to the public interest and should be granted in the public interest. And notice is f1~ther hereby given that any and all objections to the passage and adoption of such an ordinance of vacation will be heard and considered by the City Com- mission at its regular meeting to be held on Wednesday, the 9th day of Juen, 1954. , at the hour of one o'clock P.M. at the Commis s i::m Room in the City Hall Building, Bozeman, Montana.
