WHEREAS, The City Commission of The City of Bozeman, did on the 9th day of June 1954, duly and regularly pass Commjssion Hesolution No. 763, entitled: I A HESOL1JTION OF THE CITY COMMISSION OF THE CI'ry OF BOZEMAN DECLARING IT 'ro BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIS'rHICT NO. 379 OF THE CITY ')F 30ZEMAN FOR THE "PURPOSE OF CONSTRUCTING AND INSTALLING A P1PIEMENT PROJECT ON NORTH Wr,LSON A VENUE FROM WEs'r LAMME STREE'r TO WEs'r VILLARD STREET, SAID PAVF~ENT PROJECT TO INGL tIDE THE INSTALLATION OF CRUSHED GRAVEL BASE COURSE, CHRUSHED GRAVEL CUSHION COURSE, BIU'rMINOUS SURFACE COURSE, AN_') CONCRETE CURBS WHERE NOT ALREADY PLACED AND IN SATISF'AC'rORY CJNDITION. and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did on the 7th day)f July, 19\;4, duly pass Commission Resolution No. 764, entitled: A RESOLUTION OF THE Cr'rY '~OMMISSION OF 'THE CI'EY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DIS'rRIC'r 'ro 3E ~(NO'NN AS SPECIAL T',1PROVEMENT DISTftICT NUMBER 379 OF 'THE CI'rY OF BOZEMAN FUR T'-IE PURPOSE OF CONSTRUCTING AND INSTALLING A PA VEMENT PROJECT ON NORTH 1NILLSON AVEIfUE PROIA: w~~s'r LAMME STREET 'ro WES'r \TILT,ARD srrREET IN SAID CITY. which Commission Resolutions Nos. 763 and 764, passed as aforesaid, are hereby referred to and made a part of this resolution for further particulars in respect to the boundaries of said district, the character of the improvements to be constructed therein, the estimated cost of said improvements and the method of assessing the cost against the property within said district; and WHEREAS, said fmprovements as contemplated in said Co~ission Resolutions Nos. 763 I and 764 have bee constructed and completed in accordance with the terrns and conditions of Commission Resolutions Nos. 763 and 764, and the total cost of said improvements so constructed is the sum of Eight Thousand Twenty-two Dollars and thirty-eight Cents ($8,022.39). NOW, THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5 and 5~8S, R. c. M., 1935 and amendments thereto, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMNrISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That to defray the cost and expense of constructinG and making the improvements in said Special Improvement District No. 379, there be, and there is hereby levied and assessed a tax amounting to the sum of Eight Thousand twenty-two Dollars and thirth-eight cents ($8,022.38) upon all the property in said Special Improvement District No. 379, that a particular description of eachlot and parcel of land with the name of the owner and the s urn assessed against him or it for such improvements and the amount of each partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule "A", and made a part hereof; that the several sums set opposite the names of the owners and the descr:l.bed I 10 ts and parcels of land be, and tne sa'ne are here by respec ti vely 1 evied and as ses sed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the improvements within said District; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, Shceudle "A", as required by law; that the paymetn of said sums shall be ::lade In twenty installments and the payment of said'insta11ments shall I 474 extend over a period of nineteen years; that the payment of the respective annual installments shall be made on or before the 30th day ov November of each year Imtil payment of all installments together with the interest thereon, shall be made; that said sums shall be paid and the colection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when the same become due and paya~le shall make such persons and said lots I and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. 'rhat th.e regular session of the Commission of The City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 27th day of October, 19t:4, at l:OOo'clock P.M., be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by said Co nmission. Section 3. 'rhat the Clerk of The Commission of 'rhe City of dozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily C111"oni<:le, a daily newspaper printed and published in the said City of dozeman, a notice signed by the Clerk of the Commission and stating that a Resoluti'::m levying and assessj_ng a special assessment of taxes to defray tile cost and expense of construGting and making the improvements in the said Special Improvement District No. 379 is on file in the office of the Clerk of the Commission subject to inspection for a period of five ( 5) days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five ( 5) days before the day set by the Co~~ission for the hearing of objections and the final I adoption of this Resolution.
