HomeMy WebLinkAboutResolution 779 Taxes for SID 377 470 COMMISSION RESOLUTION NO. 779 A RESOLUTION OF THE COMMISSION OF 'rHE CI'rY OF BOZEMAN, MON'rANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF' TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DIS'rRICT NO. 377 IN THE CI'I'Y OF 80 ZEMAN , COUNTY OF GALLATIN, STA'rE OF MO~TTNA, TO DEFRAY 'rHE COST OF CONSTRUCTING AND MAKING THE HJIPROVEMENTS WITHIN SAID SPECIAL IMPROVm~ENT DISTRICT NO. 377 WHEREAS, The City Commission of The City of Bozeman, did on the 17th day of February 1954, duly and regularl'y pass Commission Hesolution No. 756, entitled: A RESOLU'rIm~ UF THE CI'rY COMMISSION OF THE CITY JF BOZEMAN DECLARING 1'1' TO BE I THE INTENTION OF THE CITY JF BOZEMAN '1'0 CRBIT SA SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMEwr DISTRICtI' NO. 377 OF THE CIffY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING BI'rUMINJ1JS PAVEMEN'r IN nIT;; ALLEY RUNNING THROUGH BLOCK A OF ALDERSON I S ADDI'rrON TO THE Grry 01'" BOZEMAN, MOmTTANA, AND EX'rENDING FROM WES'r OLIVE STREET TO WEST BABCOCK STREET, IN SAID CITY. and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did on the 175h day of March, 1954, duly pass CommissionReso1ution No. 761 entitled: A RESOLUTION OF THE GI'rY GOiTIITISSION)F THE CITY OF BOZEMAN CRSATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 377 OF THE CITY OF BOZ8MAN FOR THE PURPOSE OF Ci)NS'l'RUC'rING AND INSTALLING BrrUMINOUS PAVEMENT IN THE ALLEY RUNNING THROUGH BLOCK A OF ALDERSON'S ADDITION TO THE CITY OF BOZEMAN, MONTANA, AND EXTENDING FRJM WEST OLIVE S'rREET TO WES'r BABCOCK STREET, IN SAID CITY. which Commission Resolutions Nos. 756 and 761, passed as aforesaid, are hereby referred to and made a part of this resolution for further particul ars in respect to the boundaries of said district, the character of the improvements to be constructed therein, the estimated cost of said improvements and the method of assessing the cost against the property within said district; and WHEREAS, said improvements as contemplated in said Commission Resolutions Nos. 756 and 761 have been constructed and completed in ac~,ordance wi th the terms and I conditions of Commission Resolu.tions Nos. 756 and 761, and the total cost of said improvements so constructed is the sum of Three Thousand Nine Hundred Twenty Dollars and 27/100, ($3,920.27) . NOW, THER3FORE, pursuant to the provisions of Sections 5225 to5277.5 and 5485 R.C.M., 1935 and amendments thereto, BE IT RESOLVED AND IT IS HERgSY ORDER.ED BY 'rHE COMMISSION OF 'rHE CITY OF BOZElVIAN, STJ\. TE OF MON'I'JiNA : Section 1. 'rha t to defray the cost and expense of constructing and making the improvements in said Special Improvement District No. 377, there be, and there is hereby levied and assessed a tax amounting to the sum of Three Thousand Nine Hundred Twenty Dollars and 27/100 ($3,920.27). upon all the property in said Special Improvement District No. 377, that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improvements and the amount of each partIal payment to be made and the day when the same shall be delinquent is set forth indetail in the assessment list hereto attached, marked Schedule "A", and made a part hereof; that the several sums set opposite the names of the I owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the imprc)vements within said District; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, Schedule "A", as required by law; that the payment of said sums shall be made in ten installments and the payment of said installments shall extend over a period of nine years; that the payment of the ". -- respective annual installments shallbe made on or before the 30th day of November 471 of each yet-r until payment of all installments together with the interest thereon, shall be made; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; tbat failure to pay such assessments when the same become due and payable shall make such persons and said lots and parcels of land I liable to the penalties provided by law relative to delinquent taxes. Section 2. 'rhat the reeular session of the Commission of The C1 ty of Bozeman to be held in the Commission Chamber in the City lIall of said City on the 27th day of October, 195Lt , at 1:00 o'clock P.M., be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by said Commission. Section 3. That the Clerk of the vommissionof The City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Conmission and stating that a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and making the improvements in the said dpecial Improvement District No. 377 is on file in the office of the Clerk of the Commission subject to inspection for a period of five ( 5) days; that said Notice shall state the time and place at which objections will be heard by the Comnission to the final adoption or this Resolution; that it shall be published at least five CS) days before the day set by the Commission for I the hearing of' objections and the final adoption of this Resolution. Attest: ~g:~ cle~rf~ NOTlfE HEARING, FI'rIJAL ADOPTIOn OJ" COMMISSliN Rt<:SOLTJTION 779, LEVYING ASSESSMENT SPECIAL IMPROVEMENT DISTRICT NO. 377, CITY OF BOZEMAN, PA VING THE ALLEY IN BLOCK "A" OF ALDERSON'S ADDITION NOTICE IS HEREBY GIVEN, that at a regular session !)f the Commission of The I City of BozAman held on the 20th day of 6otober, 1954, Commission Resolution No. 779 was provisionally passed and adoptedj that said Commission Resolution levies and assesses a special assessment of taxes upon all the ;)roperty in Special Improvement District No. 3T( in said City, to defray the cost and expense of constvucting and making the improvements within said District, to-wit: Beginning at the Northeast corner of Block A, of Alderson's Addition to the City of Bozeman, Mobtana, thence westerly along the South line of West Babcock Street to the Northw~st Corner of said Block Aj thence Southerly along the East line of South Willson Avenue to a point located 10 feet Northerly from the Southwest Corner of Lot Fourteen (14) of said Bloclc A; thence Easterly 10 feet distant from Resol utlon N~. 779 472 and parallel to the South line of said Lot Fourteen (lh) a distance of 75 feet; thence Southerly 75 feet distant from and parallel to the East line of South Willson Avenue to a point on the North Line of West Olive Street; thence Easterly along the North line of West Olive Street to the ~outheast Corner of said Block A' thence Northerly along the West line of South Tracy Avenue to the point of , beginning. . That Wednesday, the 27th day of October, 1954, at 1:00 o'clock P.M., of said day at the regular session of the said Commission of fhe City of bozeman, at the I Commission Room, in the City Hall Building of said City, has been designated as the time and pla.ce when and where the said Co,nmission willhear and pass upJn any and all objections that may be made to the final passage and adoption of said Resolution lfo. 779, and the levying of said assessment, and that said Resoluti~m will be finally passed and adopted at said regular session.
