SUBJECT: Ordinance 1715 revising the effective dates of the annual residential
parking permits for the MSU parking district
MEETING DATE: August 13, 2007
BACKGROUND: Ordinance 1377, which originally established the residential parking
district near MSU provided for an annual permit year beginning August 1. Over time, changes to
the startup dates for fall semester and the increasing number of summer programs at MSU have
made this effective date inconvenient for permitees and parking administrators. Changing the
annual effective date to September 1, will better accommodate the needs of the users of the
program.
RECOMMENDATION: Adopt Ordinance 1715
FISCAL EFFECTS: None
ALTERNATIVES: As suggested by the City Commission.

ORDINANCE NO. 1715
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, PROVIDING THAT THE BOZEMAN MUNICIPAL
CODE BE AMENDED BY AMENDING SUBSECTION E OF SECTION
10.32.395 PERTAINING TO THE EFFECTIVE DATE OF THE ANNUAL
PERMIT IN THE MONTANA STATE UNIVERSITY RESIDENTIAL
ON-STREET PARKING PERMIT REGULATION PROGRAM TO
ESTABLISH THE BEGINNING OF THE ANNUAL PERMIT YEAR AS
SEPTEMBER 1 PURSUANT TO 10.32.350.B.4 WHICH REQUIRES THAT
THE EFFECTIVE DATES OF ANNUAL PERMITS BE DESCRIBED BY
ORDINANCE.
WHEREAS, the Bozeman City Commission has adopted Ordinance No. 1345 and Ordinance No.
1376 creating a procedure for the establishment of a residential on-street parking permit regulation program;
and
WHEREAS, the Montana State University Residential On-Street Parking Permit Regulation
Program was established in Ordinance 1377, and
WHEREAS, the beginning dates of fall semester at Montana State University have been
modified since the passage of Ordinance 1377, and
WHEREAS, Montana State University has increased the number of program offering since the
passage of Ordinance 1377, and
WHEREAS, an adjustment of the effective dates of annual permits to reflect these changes in the
cycles of parking demand would provide greater convenience to permittees and residential parking program
administrators alike.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF BOZEMAN, MONTANA:
Section 1
That the Montana State University Residential On-Street Parking Permit Regulation Program is
hereby amended by revising the effective date of the annual permit as provided in Section 2.
Section 2
That the Bozeman Municipal Code be amended by amending Subsection E of Section 10.32.395,
so that such section shall read as follows:
"10.32.095 Montana State University residential on-street parking permit regulation program

E. Permits shall be issued for an annual permit year beginning August September 1st.”
Section 3
Repealer: All resolutions, ordinances, and sections of the Bozeman Municipal Code inconsistent
herewith are hereby repealed.
Section 4
Severability: If any provisions of this ordinance or the application thereof to any person or
circumstances are held invalid, such invalidity shall not affect the other provisions of this ordinance which
may be given effect without the invalid provision or application, and, to this end the provisions of this
ordinance are declared to be severable.
Section 5
Effective Date: This ordinance shall be effective thirty (30) days after second reading and final
adoption as provided by law.
PROVISIONALLY PASSED AND ADOPTED by the City Commission of the City of Bozeman,
Montana, at a regular session thereof held on the _______ day of August 2007.
