April 1953, duly and regularly pass COnL.'1lission Resolution No. 736, entitled:

FROM GARFIELD STREE'f 'ro LINCOLN STREET, SAID PAVEMENT PROJECT TO INCLUDE THE
CONSTRUC'rIJN AND INS'rALLATION JF A STORM SEWER LINE FROM GARFIELD TO GRANT STREET,
COMBINED GDNCRETE CURBS AND GUTTERS, SELECT GRAVEL BASE, CRUS ED GRAVEL CUSHION

IN SAID CITY.
and thereafter, after due and legal proceedings had, the Commission of ~he City of
Bazeman did on the 15th day of JUly, 1953, duly pass Commission Resolution No. 738,
entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL
IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPRONEMENT DISTRICT NUMBER 372 OF
THE CITY OF BOZi!:MAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT
PROJECT ON SOUTH T-i'IFTH AVENUE FROM GARFIELD STREET TO LINCOLN STREET, SAID
PAVEMENT PROJECT TO INCLUDE THE CONS'F'RUCTION AND INSTALLATION OF A STORM SEWER
LINE FRUM GARFIELD STREET TO GRANT STREET, COMBINED C JNCRETE CURBS AND GUT'rERS,
SELECT GRAVEL BASE, CRUSHED GRAVEL CUSHION COURSE, AND BITUMINOUS SURFACE COURSE,
IN SAID CITY.
which Commission Resolutions Nos. 736 and 738, passed as aforesaid, are hereby
referred to and made a part of this resolution for further particulars In respect to
the boundaries of said district, the character of the improvements to be constructed
therein, the estimated cost
of said I~provemertts and the method of assessing the cost
against the property within said district; and
WHEREAS, said improvements as contemplated in said CommissionResolutions Nos.
736
and 738 have been cotl:1tructed and completed in accordance with the terms and conditions
I oD Commission Resolutions 736 and 738, and the total cost of said improvements so
constructed is the sum of Twenty-seven Thousand Three Hundred seventy-two and nO/lOa
Dollars, ($27,372.00).
NOW, THEREFORE, pursuant to the provisions of Sections 522.5 to 5277.5 end 5485,
R. C. M., 1935 and amendments thereto,
BE IT RESOLVED AND IT IS
HEREBY ORDERED BY THE COMMISSION OF 'rHE
CITY OF BOZEMAN, STA'rE JF MONTANA:
Sectlon 1. That to defray
the cost and e~Dense of constructing and making the

462 improvements in said Special
Improvement District No. 372,
there be, and there is
hereby levied and assessed a tax amounting to
the sum of 'rwenty Seven Thousand Three
Hundred Seventy-two and nO/IOO Dollars
($27,372.00) upon all the property in said Special
Improvement District No. 372,
that a oarticular description of each
lot and parcel of land
with the name of the owner and the sum assessed against him or it for
such improvements
and the amount of eaeh partial payment to be made and the day when the same shall be
delinquent is set forth in
detail in the assessment list hereto attached, marked

Schedule "A"-, and made
a part hereof; that the several sums
set opposite the names of
the ;)wners and the described lots and parcels of land be,
and the same are hereby respect-
ively levied and assessed upon and against said described lots and parcels of land to
defray the cost and expense of constructing and making the improvements within said
District; that the several
81ms so assessed be collected from the respective owners of
said lots and parcels of land described in said assessment list,
Schedule "A", as
required by law; that"
the payment of said St~s shall be made in twenty installments and
the payment of said installments
shallextend over a period of nineteen years; that the
payment of the respective annual
installments shall be made on or before the 30th day
of November of each year until payment of all installments together with the interest
thereon, shall be made;
that said sums shall be paid and the collection thereof shall be
made in the manner and in accordance
with the law governing the collection of special
improvement ta~es;
that failure to pay such assessments when the same become due and
payable shall make such persons and said lots and parcels of land liable to the penalties
provided by law relative to delinquent taxes.

Section 2.
'rhat the regu.lar session of the Commission of The Ci ty of Bozeman
to be held in the Commission Chamber in tile City Hall of said City on the 13th day
of October, 1954,
at 1:00 o'clock P.M., be,
and the same is hereby designated as the
time and place at which objections to the final adoption of this Resollltion will be
heard by said Commission.
Section 3.
"hat the Clerk of the Commission',)f The City of Bozeman be,
and he is
hereby ordered and directed to publish in the Bozeman Daily Ghronicle,
a daily newspaper
printed and published in the said City of Dozeman,
a notice signed by the Clerk of the
Commission and stating that a Resolution levying and assessing a special assessment of
taxes to defray the cost and expense
of constructing and making the inprovements
in the
said Special Improvement District
No. 372 is on file In
the office of the Clerk of the
Commission subject to inspection for a period of five
(5) days;
that said Notice shall
state the t:1.me and place at which objections will be heard by the Commission to the
final adoption of this Resolution;
that it shall be Pl1blished at least five (,5)
days
before the day set by the Commission for the hearing of objections and the final adoption
of this Resolution.

adopted by the Commission of The City of Bozeman at a
regular session thereof held on the 6th day of October,
1954.

of Bozeman held on the 6th day of October,
1954, Commission Resolution No. 776 was
provisionally passed and adopted;
that said COlmi ss ion Resol'J.tion levies and as se s ses
a special Fssessment of taxes upon allthe property in Special Improvement District
No. 372
in sD:!.d City, to defray the cost and expense of constructing and making the
improvements within said District,
to-wit:
BEGINNING, at the Northwest Corner of Lot One
(l) , of Block Thirty-five
{35}, of the Capitol Hill Addition to Bozeman, Montana, thence Souther-
ly along the East Line of the alley in Blocks Thirty-five (35), Forty-
six (4.6) , and Fifty-one (51), of said Addition, to the Southwest Corner
of Lot Sixteen (16) of said Block Fifty-one (51); thence Easterly along
the South Lines of said Lot Sixteen (16) and Lot Seventeen (17) of Block
Fifty (50) of said Addition (being also the North Line of Lincoln 0treet)
to a point located 143 feet Easterly from the Southwest Corner of said
Lot Seventeen (17); thence Northerly lL;3 feet distant from and parallel to
the East Line of ~outh Fifth Avenue to a point of intersection with the
North Line of Lot Twenty-foru (2L), of Blocl{ rrhirty..dour (34), of said
Addition, said point of inters'ectton being also on the South Line of
Garfield Street; thence Westerly along the North Line of said Lot Twenty-

That, said Commission Resolution No. 776 is now
on file in the office of the
Clerk of the Commission,
subject to inspection for a period of five ( 5)

persons interested.
That Wednesday, the 13th day of October,
195L. , at 1:00 o'clock
P.M., of said day at the regular
session of the said Co nmission Df The City of
Bozeman, at the Commission
Hoom, in the City Hall Building of said City, has been
designated as the time and place when and where the said Commission wtll hear and
pass upon any and all objections that may be made to the flnal passage and adoption
of said Resolution No.
776, and the levying of said assessment,
and that sa id
Resolution will be finally passed and adopted at said regular session..
All persons interested are referred to Co~mission Resolution No. 736,
declaring
it to be the intention of the Commission to create Special Improvement District No.
372, and Commission Resolution No.
738, creating Special Improvement District NO.372,
for constructing and making the improvements therein.
