A RESOLUTI )N OF 'FHE COMMISSION OF THE CITY OF BOZEMAN, MONTANA LEVYING
AND ASSESSTNG A SPECIAL ASSESSMENT OF TAXES UPON ALL W:AL PROPERTY r~' 'THE

WHICH CARBAG-E WAS~OLLgCTED AND REMOVED DURING THE YEAR 1954, TO DEFRAY
THE COST AND EXPENSE OF COLLECTING AND DISPOSING OF GARBAGE UNDER' THE
PROVISIONS OF ORD INAf'TCE No. 696 OF TIm CITY OF HOZEMAN.
1':JHEREAS, the City vommission of the City of Bozeman did on the 8th day of
January, 19~-O, duly and regularly
pas Ordinance No. 6y6, entitled:
AN ORDINANCE DEFINING GARBAGE FOR T~{E PURPOSE OF THIS ORDINANCE: PROVIDING
FOR THE COLLI~CTION AND DISPOSITION THEREOF BY AND UNDER 'rEE SUPERVISION AND
CONTROL OF TTtE DEPARTMENT OF PUBLIC WELFARE A"JD FOR DEFRAYING 'TUE cos'r OF
SUCH COLLECTION AND DISPOSI'rION BY SPECIAL ASSESSMENT AGAINST THE PROPERTY
'1'0 WHICH SUCH SERVICE IS RENDERED, AND PROVIDING PE~NATLTIES FOR VIOLATION
OF THIS ORDINANCE,
which Ordinance No. 696, passed as aforesaid is hereby referred to and made a part
of this Resolution for further partiG1Jlars in respect to trie basis and method of
I assessing the cost against the property herein assessed,
and
WHEREAS, said expense incurred by said City in the
collection and disposition
of garbage in aceordance with said Ordinance is hereby estimated bv the Commission
of the City of Bozeman to be the sum of Twenty-eight Thousand Two Hundred Eighty-
nine Dollars & Two Cents
($28,209.02) for the year 1954, over and above all moneys
collected from business and professional concerns, or combined residence and
business, or residence and professional business concerns in accordance with said
Ordinance No. 696, and
WHEREAS, in order to raise
said sum to defray the said cost, it is necessary
to establish the basic unit rate as defined in said Ordinance No. 696 at Nine Dollars
(~'9.00) .
NOW, T'-rSR~FORE, pursuant to the provisions of said Ordinance No. 696, and the
laws of the State of Montana,
BE IT RESOLVED A~ID IT IS Hr.;p:~BY ORDERED BY TTlE COMMISSION OF THE CITY OF
BOZEMAN, STA'rE OF M01JTANA:
Section 1. That to defray the
estimated cost and expense of collecting and
I disposing. of garbage in the City of Bozeman for the pear 1954, there is herby levied
and assessed against the property and the several lots, pieces and parcels of land
thereof within the City of Bozeman as set forth in Schedule "A", which is attached
hereto and made a part hereof, a tax; that
a particular description of each lot and
parcel of land with the name of the owner and/or owners and the sum assessed against
the seme is set forth in the assessment list in said Schedule "A";
that the several
sums set opposite the names of said owners and the described lots and parcels of
land, be, and the same are hereby levied and assessed uponand against said lots and

parcels of land for said purpose; that the several sums be collected
from the respective
owners of said lots and parcels of land described in said assessment list and owned by
them; that the said sums
shall be paid and the collection thereof be made in the manner
and in ac~ordance with Ordinance No. 696 of the City of Bozeman, M("\ntana,
and the laws
of the State of Montana governing the collection of special improvement taxes;
that
failure to pay such assessment when the same shall become due an,l payable shall make such
pers)ns and such lots and parcels of land liable to the penalties provided by law relative

to del:tnQuent taxes.
Section 2.
That the regular session of the 0ommission of the City of
Bozeman,
Montana, to be held in theCommission Chamber in the City Hall of said City on the 6th
day of c!ctober, 1954,
at 1:00 l'clock P.M. be, and the same is hereby designated as the
time and place at which objections to the final adoption of this Resolution will be
heard by said Commission.
Section 3.
That the Clerk of the Cammi. ssion of the City of Dozeman be, and
he is hereby ordered and directed to pu.blish in the Bozeman Daily Chronicle,
a daily news-
paper printed and published in said City of Bozeman, a notice
signed by the Clerk of the
Commission, stating that a resolu.tion levying and assessing a special assessment
of
taxes to defray the cost and expense )f the collection and disposition
of garbage in the
City of Bozeman for the yelr 19 5~"
against the property to which sucn service was rendered,
is on file in the office of the Clerk of the Commission,
subject to inspection for a
period of five days; that said Notice shall state the time and place at
which objections
will be helrd by the ~ommission to the final adoption of this Resolution;
and that said
Notice shall be published at least five days before the date set by the Commission for
I
hearing of objections and the final adoption of this Resolution.
Provisionally passed and
adopted by the Commission of the City of Bozeman
at a reg\Dar session thereof held on the 29th day of September,
1954.

that at a regular session of the Commission of the

Commission Resolution No. 774.
was provisionally passed and adopted; that said Resolution levies
and assesses a apecial
assessment of taxes to defray the cost of collection and disposition of garbage in the
City of Bozeman, for the year 1954,
upon all property to which such service was rendered.
That said Commission Resolution No. 774 is nowon file in the office
of the Clerk of the
Commission of the City of Bozeman, subject to inspection of all
persons interested, for
Resolution No. 774.

that Wednesday the 6th day of October, 1954,

of said day at a regular session of the Commission of the City of
Bozeman, in the Commiss Lm
Room, in the City Hall Building, has been designated as the
time and place when and where said Commission will hear and passupnn any and all
objections that may be made to the final passage and adoption of said Commission
Resolu.tion No. 774 and
the levying of said assessment; and that said Resolution will
I be finally passed and adopted at said regular session of said ComMission,
subject to
such corrections and amendments that may be made up.)n objections made and filed with
