A RESOLUTION OF THE CITY COMMISSION OF THE CIT{ OF BOZEMAN DECLARING IT TO BE THE
INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE
KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 382 OF' THE CI'IY OF BOZEMAN JiOR THE PUR-
POSE OF CONSTRUCTING AND INSTALLING A PAV'EMENT PROJECT ON NORTH WILLSON AVENUE
FROM VILLARD STREET TO SHORT STREET. SAID PAVEMENT PROJECT TO INCLUDE mE CON-
STRUCTION AND INST.AU.ATION OF CONCRETE CURBS. CRUSHED GRAVEL BASE, CRUSHED GRAVEL
CUSHION COURSE, BITUMINOUS SURFACE COURSE. AND O'lHER WORK INCIDENTAL THERETO.
I WHEREAS : There has been filed
with the Clerk of the City Commission of The City of Bozeman,
Montana, a petition in due fonn of oertain owners of properties situated on North Willson Avenue
trom Villard Street to Short Street in said City asking that a speoial improvement district be
created tor the purpose of construoting and installing a pavement projeot to include the construc-
tion and installation of concrete ourbs, crushed gravel base, crushed gravel cushion course,
bituminous surface course, and other work incidental thereto; and
WHEREAS : That at a regular
meting of the City Cormnission of The City of Bozeman held on the
13th day of April, 1955, the aforesaid petition was respectively oonsidered and granted; NOW,

BE IT RESOLVED BY THE CITY COMMISSION OF 'IHE CITY OF BOZEMAN,
Section 1
Declaration of Intention
That it is hereby deolared to be the intention of The City of Bozeman to oreate a special
improvement distriot to be known and designated as Special Improvement District No. 382 of
The City
of Bozeman for the purpose of oonstructing and installing a pavement project on North Willson
Avenue
from Villard Street to Short Street, said pavement projeot to inolude the construotion and
installa-
I tion of ooncrete curbs, c rushed gravel base, crushed gravel cushion course, bituminous surface
course, and other work incidental the reto.
Section 2
Boundaries
The boundaries of said Special Improvement District No. 382 are described as follo~a
Beginning at the intersection of the North Line of West Villard Street with the
East Line of North Willson Avenue, thence Easterly along the North Line of West
Villard Street a distance of 131 feet;
thence Northerly 131 feet Easterly from
and parallel to the East Line of North Willson Avenue to a point on the South
Line of West Short Street; thence Westerly along the South Line of West Short
Street to a point 131 feet Westerly from the West Line of North Willson Avenue;
thence Southerly 131 feet Westerly from and parallel to the West Line of North
Willson Avenue to a point on the North Line of West Villard Street; thence
Easterly along the North Line of West Villard Street to the point of beginning.
Section :5
Charaoter of Improvements
Construction of a pavement projeot on North Willson Avenue from the South Line of West Villard
to the South Line of West Short Street, said pavement project to include the construction and
installation of concrete curbs, crushed gravel base,
crushed gravel oushion course. bituminous
surface course. and other work incidental thereto.

Estimate of Cost
The preliminary estimate of cost is 'lllirteen Thousand Six-Hundred Ninety...two and 79/100
Dollars
including all street excavation, all materials, installation oosts, engineering and incidentals.
Section 5
Method of Assessment
The preliminary estimate of cost set forth above is to be assessed against the property within
said District on an area basis as follo~'

Costs of the project will be assessed on an area basis, with the first 25 feet of each lot
next
adjacen t to the improvement being reoorded at double its actual area in compu.ting the assessable
area
of each lot. On this basis the
assessable area of the district is 160,149.6 square feet and the
estimated oost per square foot is $0.0856.
Section 6
Actual Area of Distriot

The total actual area of all property within Special Improvement District No. 382, exclusive
of
streets, avenues and alleys, is 134,484.6 square feet, which is the area on which all protests
will be
decided.
Section 7
Payments
That payments for said improvements shall be made in twenty (20) annual installments extending
over a period of nineteen (19) years, but this shall not be construed to prevent payment in
full at
any regular payment date by any property owner who desires to do so.
lt is proposed to pay the entire
cost and expense of the construction and installation of said improvements with oash to be
obtained
from the sale of bonds of said Special Improvement District No. 382, as authorized by law.
Such bonds
will be in denominations of $100.00 each and fractions or multiples of $100.00 where necessary,
to be
issued and chargeable against a fund to be known and designated as Special Improvement Distriot
No.
382 Fund of The City 0 f Bo zeman .
'Ihe bonds will be redeemable at the option of the City, singly or
in multiples, and in the order of their reg istration, whenever funds are available for the.
t purpose
in said Special Improvement District No. 382. Sa
id bonds shall draw a simple interest from the date
of their registration until called for payment, at a rate not exceeding six (6) per cent per
annum, I
which interest shall be chargeable as a part of the cost of the construction and installation
of said
improvement. The bonds will be
issued and sold in accordance with the provisions of Section 11-2232
and Seotion 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of
Title 11
of the Revised Codes of Montana, 1947, relating to special imlrovement districts in oities
and towns,
and any amendments thereof or thereto.
Section 8
Protests and Notice
That the regular session of the City Commission of The City of Bozeman, to be held at the
Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 4th day of May,
1955, at
the hour of one o'clock P. M. of said day, are the time and plaoe, when and where the
City Commission
will hear and pass upon all protests duly and regularly made and filed against the creation
of said
proposed Special Improvement District No. 382, the improvement proposed to be made pursuant
thereto and
the extent and character thereof, or either thereof; and the Clerk of the City Commission be,
and he is
hereby, directed to give notice in the manner and for the time as by law required, of the adoption
of
this Resolution of Intention.
Adopted by the Commission of The City of Bozeman, Montana, at a regular and stated session
of I
said Commission held on the 13th day of April, A. D. 1956.

That Wednesday, the 4th day of May, A. D. 1955. at one o'olock P. M. at the Commission Room
of the City Hall. Bozeman. Montana. is designated by said Resolution No. 787 as the time and
place
for hearing objections to the action proposed to be taken by said resolution. and when and

any and all persons whose property is within said proposed Special Improvement Distriot No.
382 on
North Willson Avenue from Villard Street to Short Street in said City may appear and show cause.
if
any they have, against said proposed improvement.
Objections must be made in writing and filed with
the Clerk of the City Commission not later than fifteen (15) days after date of the first publication
of this Notice.
An approximate preliminary estimate of the cost of doing such work and making suoh improvement
within said District, including all street excavation, all materials,
installation costs, engineering
and incidentals, which is to be specially assessed against the property within said District.
