A RESOLUTION OF THE COMMISSION
OF THE CITY OF' BOZEMAN LEVYING AND ASSESSING A SPE-
CIAL ASSESSMENT OF TAXES
UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN. COUNTY OF
GALLATIN. STATE OF MONTANA.
TO DEFRAY 'fHE COST OF CONSTRUCT ING AND INSTALLING AND/
OR REPAIRING MISCELLANEOUS
SIDEWALKS AND CURBS DURING THE YEAR 1964
WHEREAS. the Commission of the City of Bozeman. pursuant to the provisions of Ordinance No.
561.
entitled:
I "AN ORDINANCE COVERING THE
CONSTROCTION AND INSTALLATIO:N OF CONCRETE CURBS AND
SIDEWALKS IN THE CITY OF BOZEMAN. PROVIDING PENALTIES
FOR THE VIOLATION OF THIS
ORDINANCE AND REPEALING ORDINANCES NOS. 365. 374.
425. 447, 449. AND 461. AND ALL
OTHER ORDINAJH':ES AND PARTS OF ORDINANCES OF
THE CITY OF BOZEMAN IN CONFLICT HERE-
WITH" ,
and the provisions of Section 11-2226. Political Code. R. C. M. 1947. provided for the construction
of
sidewalks and curbs in the City of Bozeman during the year 1954. without the formation of a
Special
Improvement District;
WHEREAS. prooeedings were had for the oonstruction and installation and/or repair of Miscellaneous
Sidewalks and Curbs in the City of Bozeman for the year 1954, and
WHEREAS. Miscellaneous Sidewalks and Curbs were constructed and installed and/or repaired border-
ing on various properties in the City of Bozeman. pursuant to Ordinance No. 561. Section 11-2226.
Political Code. R. C. M.. 1947. which are hereby referred to and made a part of this Resolution.
and
WHEREAS. the said Miscellaneous Sidewalks and Curbs have been constructed and completed and/or
repaired in accordance with the terms and conditions of said proceedings. and the City Engineer
has
duly certified to the Commission a Schedule showing the Sidewalks and Curbs which have been
constructed
and installed and/or repaired. and the properties which are subject to assessment thereunder
and the
total cost of said construction and installation and/or repairing is the sum of Two Thousand
One
I Hundred Seventy-eight and 39/100 Dollars ($2,178.39) which Schedule. marked Schedule "A". is
hereto
attached and made a part hereof.
NOW. 'l'HEREF'ORE. PURSUANT to
the provisions of Ordinance No. 661 as aforesaid. and Section 11-2226.
Political Code. R. C. M. 1947. as aforesaid.
BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF EOZEMAN. MONTANA:
Section 1. That to defray the
cost of constructing and installing and/or repairing Miscellaneous
Sidewalks and Curbs as set forth in Schedule "A". hereto attached and made a part hereof. there
is
hereby levied and assessed a tax amounting to the sum of Two Thousand. One Hundred Seventy-eight
and
39/100 Dollars ($2.178.39).
Secti on 2. That a particular
description of each lot and parcel of land with the name of the
owner and the sum assessed against him or it for such construction and installation and/or
repair and
the amount of each payment to be made and the day when the same shall become delinquent is
set forth in
the assessment list hereto attached marked Schedule itA" and made a part hereof; that the several
sums
set opposite the name of the owner and the description of the lots and paroels of land be.
and the
same are hereby respectively levied and assessed upon said lots and parcel s of 1 and to defray
the cost
I and expense of constructing and installing and/or repairing said Sidewalks and Curbs; that
the several
sums so assessed be collected from the respective owners of said lots and parcels of land described in
said assessment list as required by law; that the payment of said sums shell be made in six install-
ments;that the payment of said installments shall be made on or before the 30th day of November
of
each year until payment of all installments together with the interest thereon. shall be made;
that
said sums shall be paid and the collection thereof shall be made in the manner and in accordance
with
the law governing the collection of Special Improvement taxes; that failure to pay such assessments
when the same shall become due and payable shall make such persons and said lots and parcels
of land
liable to the penalties provided by law relative to delinquent taxes;

Seotion 3. That the regular session of the Commission of the City of Bozeman to be held
in the
Commission Chamber in the City Hall of said City on the 22nd day of Deoember, 1954, at 1:00 o'olock
F. M., be, and the same is hereby designated as the time and place at whioh objeotions to the final
adoption of this Resolution will be heard by said Commission.
Section 4. That the Clerk of the Commission of the City of Bozeman be, and he is hereby
ordered
and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in
the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution

levying and assessing a special assessment of taxes to defray the cost and expense of constructing and
installing and/or repairing Sidewalks and Curbs in the City of Bozeman for the year 1954 is on file in
the office of the Clerk of the Commission subjeot to inspection for a period of five (5) days; that said
Notice shall state the time and place at which objections will be heard by the Commission to the final
adoption of this Resolution; that it shall be published at least five (5) days before the date set by
the Commission for the hearing of objections and the final adoption of this Resolution.
Provisionally passed and adopted by the Commission of the City of Bozeman at a regular session
thereof, held on the 16th day of Decemberj 1954. L7

HEARING, FINAL ADOFTION COMMISSION
RESOLUTION NO. 784 l.EVYING ASSESSMENT TAXES, CON-
STRUCTION AND INST.ALL,ATION AND/OR REPAIR MISCELLANroUS SIDEWALKS AND CURBS IN THE CITY
OF BOZEMAN DURING '!HE YEAR 19-54.
NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on
Wednesday, the 15th day of December, 1954, Commission Resolution No. 784 was provisionally passed and
adopted; that said Commission Resolution levies and assesses a special aSsessment of taxes upon certain
lots and parcels of land in front, or on the side of which, sidewalks and curbs have been constructed
and/ or repaired pursuant to the provisions of Ordinance No. 561 end Section 11-2226, Poli tioal Code,
R. C. M., 1947, to defray the cost and expense of constructing and installing and/or rel'airing; said
Sidewalks and Curbs.
That said Commission Resolution is now on file in the office of the Clerk of the Commission,
subjeot to inspeotion for a period of five (5) days by any persons interested; that WednesdaYj the

22nd day of December, 1954, at 1:00 o'olock P. M. of said day, at the regular session of the said
Commission of the City of Bozeman at the Commission Chamber, City Hall Building of said City, has been
designated as the time and place when and where the said Commission will hear and pass upon any and all
objeotions that may be made to the final passage end adoption of said Resolution No. 784 end the ~vy-
ing of said assessment, and that said Resolution will be finally passed and adopted at said regular
session.
All persons interested are referred to said Ordinance No. 561, and the Commissioner's proceedings
