COMMISSION RESOLUTION NO. 1002 A RESOLUTION OF THE COr~~ISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. ill IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT I NO. 416 WHEREAS, The City Commission of The City of Bozeman, did on the 16th day of March 19~, duly and regularly pass Commission Resolution No. 97U, entitled: A RESOLUTION OF TI-IE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL DiPROVE- MENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 416 OF 'llHE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVE- MENT PROJECT ON SOUTH CYPRESS AVENUE FROM EAST BABCOCK STREET TO EAST CURTISS STREET, ON SOUTH McADOW AVENUE FROM EAST OLIVE STREET TO EAST CURTISS STREET, ON EAST OLIVE STREET FROM SOUTH CYPRESS AVENUE TO SOUTH McADOW A VENUE AND ON EAST CURTISS STREET FRmlI SOUTH CYPRESS A VENUE TO THE NORTH-SOUTH ALLEY AS PLATTED BETWEEN BLOCK A AND BLOCK D, MARWYN REARRANGEMENT OF BLOCKS 13, 14, 15, 18, 19, 2U AND ADJACENT VACATED STREETS OF THE NORTHERN PACIFIC ADDITION TO BOZEMAN, MONTANA, SAID PROJECT TO INCLUDE THE CONSTRUCTION AND INSTALLATION OF COMBINATION CONCRETE CURBS AND GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, BITUMINOUS SURFACE COURSE AND OTHER WORK INCIDENTAL THERETO and thereafter, after due and Legal proceedings had, the Commission of the City of Bozeman did on the 6th day of April , 1960, &lly pass Commission Resolution No. 972,-eEtitled: A RESOLUTION OF THE CITY COMrnSSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 416 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCT- ING AND INSTALLING A PAVE~NT PROJECT ON SOUTH CYPRESS AVENUE FROM EAST BABCOCK STREET TO EAST CURTISS STREET, ON SOUTH McADOW AVENUE FROM EAST OLIVE STREET TO EAST CURTISS STREET, ON EAST OLIVE STREET FROM SOU~{ CYPRESS AVENUE TO SOUTH McADOW AVENUE AND ON EAST CURT- I ISS STREET FROM SOUTH CYl'RESS AVENUE TO THE NORTH-SOUTH ALLEY AS FLA TTED BETWEEN BLOCK A AND BLOCK D, MARWYN REARRANGEMENT OF BLOCKS 13, 14, 15, 18, 19, 20 AND ADJACENT VACATED STREETS OF THE NORTHERN PACIFIC ADDITION TO BOZEMAN, MONTANA which Commission Resolutions Nos. 9'70 and 972, passed as aforesaid, are hereby referred to and made a part of this resolutIOn for further particuLars in respect to the boundaries of said district, the character of the improvements to be con- structed therein, the estimated cost of said improvements and the method of as.sess- ing the cost against the property within said district; and WHEREAS, said improvements as contempLated in said Commission Resolutions Nos. 970 and 9'12 ha ve been cons truc ted and compLe ted in accordance wi th the terms and condi tionsof Commission Resolu tions Nos. 970 and 9'/2, and the total cos t of said improvements so constructed is the sum of~hirty-eight thousand seven hundred one and 03/1uOths dollars ($38,'/Ul.03) NOW, THEREFORE, pursuant to the provisions of Sections 11-2201 to 11-2287 and 11-33ul, R. C. M., 1947 and amendments thereto, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Sec tion 1. Tnat to defray the cost and expense of constructing and making the improvements in said Special Improvement District No. 416, there be, and there is hereby levied and assessed a tax amounting to the-slim of Thirty-eight thousand seven hundred one and 03/100ths dollars ($38,701.03) upon all the property in said Special Improvement District No. 416, that a particular descrip- tion of each 10\ J.nJ. ...k,~ t;el of land wi th the name Of the owner and the sum assessed against him or it for such improvements and the amount of each partial payment to I be made and the day when the same shall be delinquent is set forth in detail in the assessment lis t hereto a ttached, marked Schedule "A"', and made a part hereof; tha t the several sums set opposite the names of the owners and the described lots and parcels of land be, and the same are hereby respectively Levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the improvements within said District; tha t the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, ScheduLe "A~, as required by law; that the payment of said sums shall be made in twenty installments and the payment of said installments shall extend over a period of nineteen years; that the payment of the respective annual installments shaLl be made on or before the 30th . day of November of each year until payment of all instaLlments together with the interGst thereon, sha 11 be made; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the ,1~ll collection of special improvement taxes; that failure to pay such assessments when the same become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. ~hat the regular session of the Commission of The City of Bozeman to be held in the COI1U11ission Chamber in the City Hall of said City on the ~ day of October , 196u, at l:OU otclock P.M., be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution Will be heard by said Commission. Section 3. That the Clerk of the Commission of The City of Bozeman be, and I he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of taxes" to defray the cost and expense of constructing and making the improvements in the said Special Improvement District No. 416 is on file in the office of the Clerk of the Commission subject to inspection for a period of five (5) days; that said Notice shall state the time and place at which objections will be heard by the Connnission to the final adoption of this Resolu- tion; that it shall be published at least five (5) days before the day set by the Commission for the hearing of objections and the final adoption of this Resolu tion. Swanson I Mayor At te s t : ~tr' . .. t# 4/ Clerk o{~ t €o1tmission - - - - - - - - - - - - - - - - NOT ICE ------ HEARING, FINAL ADOPTION OF COMMISSION RESOLUTION NO. lU02, LEVYING ASSESSMENT SPECIAL IMPROVEMEwr DISTRICT NO. 416, City of Bozeman, PAVEMENT ON SOUTH CYPRESS AVENUE FROM EAST BABCOCK STREET TO EAST CURTISS STREET, ON SOUTH McADOW AVENUE FROM EAST OLIVE STREET TO EAST CURTISS STREET, ON EAST OLIVE STREET FROM SOUTH CYPRESS A VENUE TO SOUT McADOW A VENUE AND ON EAST CURTISS STREET FROM: SOUTH CYPRESS A VENUE TO THE NOR'I'H -SOUTH ALLEY AS PLATTED BETWEEN BLOCK A AND BLOCK D, MARWYN REARRANGEMENT OF BLOCKS 13, 14, 15, 18, 19, 20 AND ADJACENT VACATED STREETS OF THE NORTHERN PACIFIC ADDI- TION TO BOZEMAN, MONTANA NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of The City of Bozeman held on the 13th day of Oct., 196u, Cow~ission Resolution No. 1U02 was provisionally passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon all the property in Spe- cial Improvement District No. 416 in said City, to defray the cost and expense of constructing and making the improvements within said District, to-wit: I '* Beginning at the point of intersection of the West line of South '" Cypress Avenue with the South line of East Babcock Street, thence in an easterly direction along the south line of East Babcock Street to a point 125 feet east of the east line of South Cypress Avenue; thence in a southerly direction, 125 feet east of and parallel to the east line of South Cypress Avenue to a point 125 feet north of the north line of East Olive Street; thence in an easterly direction 125 feet north of and parallel to the north line of East Olive Street and con- tinuing 125 feet east of and parallel to the east line of South McAdow Avenue to a point of intersection with the north line of East Curtiss Stree t; thence in an easterly direction across East Curtiss Street to a point on the South line of East Curtiss Street, said point being the southwest corner of Lot 1, Block C, Marwyn; thence southerly along a , . --...--.---- ,195 line perpendicular to the tangent of the curve of East Curtiss Street as said point, a rtlstance of 125 feet; thence in a southwesterly and westerly direction, 125 feet south of and parallel to the south line of East Curtiss Street to a point 125 feet west of the west line of South Cypress Avenue; thence in a northerly direct- ion 125 feet west of and parallel to the west line of South Cypress Avenue to a point on the South line of East Babcock ~treet produced; thence in an easterly direction along the south line of East Babcock Street to the point of beginning. The t, said Commission Resolution No. 1002 is now on file in the office of the Clerk of the Commission, subject to inspecmi1 for a period of five (5) days by I any persons interested. That Wednesday the 19th day of October 1960 at 1:00 o'clock P.M., of said day at the regular session of the said Commission of The City of Bozeman, at the Commission hoom, in the City Hall Building of said City, has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and 8dontlon of said Resolution No. 1002, and the levying of said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 970, de- claring it to be the intention of the Commission to create Special Improvement District No. 416, and Commission Resolution No. 972, creating Special Improvement District No. 416, for constructing and making the improvements therein.
