HomeMy WebLinkAboutResolution 998 Taxes for SID 406 - -. .\80 co~mISSION RESOLUTION NO. 998 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 406 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVE- MENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 406 WHEREAS, The City Commission of The City of Bozeman, did on the 30th I day of April 1958, duly and regularly pass Commission Resolution No. 898, en ti tIed: A RESOLUTION OF THE CITY CO~~ISSION OF THE CITY OF BOZEMAN DECLAR- ING IT TO BE THE INTENTION OF THE CITY OF nOZEMAN TO CREATE A SPEC- IAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIST- RICT NO. 406 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCT- ING AND INSTALLING A PAVEMENT PROJECT ON DELL PLACE FROM EAST STORY STREET EXTENDING IN A SOU~iERLY DIRECTION A DISTANCE OF 520 FEET, SAID PROJECT TO INCLUDE THE CONSTRUCTION AND INSTALLATION OF COM- BINATION CONCRETE CURBS AND GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, BITLmINOUS SURFACE COURSE, AND OTHER WORK INCIDENTEL THERETO and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did on the ~ day of May, L958, duly pass Commission Resolution No. 906, entitled: A RESOLUTION OF THE CITY COM~JUSSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPE- CIAL INPRO~ffiMENT DISTRICT NO. 406 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PRO- JECT ON DELL PLACE FROM EAST STORY STREET EXTENDING IN A SOUTHERLY DIRECTION A DISTANCE OF 520 FEET TN SAID CITY which Commission Resolutions Nos. 898 and 906, passed as aforesaid, are hereby referred to and made a part of this resolu1IOn for further particulars in respect to the boundaries of said district, the character of the improvements to be con- structed therein, the estimated cost of said improvements and the method of assess- ing the cost against the property within said district; and I WHEREAS, said improvements as contemplated in said Commission Resobltiona Nos. 898 and 906 have been constructed and comnleted in accordance with the terms and conditionS'Of Commission Resolutions No.s.'898 and 906, and the total cost of said improvements so constructed is the sum of Ten thousand nine hundred sixty- seven and 85/1UUths dollars ($10,96'7.85) NOW, THEREFORE, pursuant to the provisions of Section ll-22ul to 11-2287 and 11-3301, R. C. M., 1947 and amendment.s thereto, BE rf RESOLVED AND IT I,]' HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STA1~ OF MONTANA: Section 1. That to defray the cost and expense of constructing and making the i~provements in said Special Improvement District No. 4u6, there be, and there is hereby levied and assessed a tax amounting to the-SUm of Ten thousand nine hundred sixty-seven and 85/1uuths ($lU,967.85) upon all the property in said Special Improvement District No. 406, that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improvements and the amount of each partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment List hereto attached, marked Schedule "A":, and made a part hereof; that the several sums set opposite the names of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the improvements within said District; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, Schedule "Aft, as required by law; that the payment of said sums shall be made in Twenty installments and the payment of said installments shall extend over a period of Nineteen years; that the payment of the respective annual install- ments shall be made on or before the 30th day of November of each year until I payment of all installments together with the interest thereon, shall be made; that said sums shall be paid and the collection thereof shaLl be made in the man- ner and in accordance with the law governing the collection of special improve- ment taxes; that failure to pay such assessments when the same become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. That the regular session of the Commission of The City of Boze- man to be held in the Commission Chamber in the City Hall of said City on the 19th day of October, 1960, at l:OU o'clock P.M., be, and the same is hereby designated as the time ana-place at which objections to the final adoption of th.is Resolution will be heard by said Commission. ..--..- .181 Section 3. That the Clerk of the Commission of The City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice Bianed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and making the improvements in the said Special Improvement District No. 406 is on file in the office of the Clerk of the Commission subject to inspection for a period of five (5) daysj that said Notice shaL~ state the time and place at which objections will be heard by the Commission to the final adoption of this Resolu- I tion; that it shall be published at least five (5) days before the day set by the Commission for the hearing of objections and the final adoption of this Resolu tion. - Provisionally passed and adopted by the Commission of The City of Bozeman at a regular session thereof held on the 13th day of October, 1960. HEARING, FINAL ADOPTION OF COMMISSION RESOLUTION NO. 998 LEVYING ASSESSMENT SPECIAL IMPROVEMENT DISTRICT NO. 406, City of Bozeman, --- PAVEMENT PROJECT ON DELL PLACE FROM EAST STORY STREET EXTENDING IN A SOUTHERLY DIRECTION A DISTANCE OF 520 FEET IN SAID CITY NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of The City of Bozeman held on the 13th day of Oct. 1960, Commission Resolution No. 998 was provisionaLly passed and-aaQptedj that said Commission Resolution Levies ana-- assessed a special assessment of taxes upon all the property in Special Improve- ment District No. 406 in said City, to defray the cost and expense of construct- ing and making the improvements within said District, to-wit: Beginning at a point on the South line of East Story Street, said point being 95.41 feet West of the West line of Dell ~Lace, thence Southerly 95.41 feet west of and parallel to the West line of Dell PLace a distance of 520.0 feetj thence easterly along the North line of Lot G Guy's 2nd Addition, and said line produced, to a point 95.41 feet East of the East line of Dell Placej thence Northerly 95.41 feet I East of and parallel to the East line of DeLl Place 520.0 feet, more or less, to a point on the South line of East Story Streetj thence Westerly along the South line of East Story Street to the point of be- ginning. That, said Commission Resolution No. 998i8 now on file in the office of the Clerk of the Commission, subject to inspection for a period of five (5) days by any persons interested. That Wednesday , the 19th day of October, 1960 at 1:00 o'clock P.M., of said day at the regular session of the said Commission of The City of Bozeman, at the Commission Room, in the City Hall Building of said City, has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final ---- \s') '.l_~ passage and adoption of said Resolution No. 998 , and the levying of said assess- ment, and that said Resolution will be finaily passed and adopted at said regular session. .
