CO~1I3SION RESOLUTION NO. 994
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN
DECLARING IT TO BE THE BEST INTEREST OF THE CITY OF
BOZEMAN AND THE INHABITANTS THEREOF AND OF THE INHABI-
TANTs OF TRACTS OF LAND CONTIGUOUS TO THE SAID CITY
OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO
EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO

AS TO INCLlIDE THE SAID CONTIGUOUS TRACTS WITHIN THE
CORPORATE LIMITS THEREOF
WHEREAS, there has been presented to the City Commission of the City of
Bozeman verbal requests petitioning the said City Commission to extend the bound-
aries of the City of Bozeman so as to include ceptain contiguous tracts of land
within the boundaries of the City of Bozeman and having presented to the City of
Bozeman proposed plats or certificates of survey of said lands; and
WHEREAS, the proper legal descriptions of said contiguous tracts are as
follows:
A tract of land lying in the West Half of the Northwest Quarter (WtNWt)
of Section Twelve (12), Township Two (2) South, Range Five (5) East,
M.P.M., enclosed within the following metes and bounds, to-wit:
Begin-
ning at a pOint on the North line of the South Half of the West Half
of the Northwest Quarter (St.WtNWt) of Section Twelve, Township Two South,
Range Five Eastt said point being 30.0 feet west of the Northeast cor-
ner of said stw NWt, said point also being the west line of North 15th
Avenue as platted and of record as Cleveland Subdivision, Gallatin
County, Montana, thence from said point of beginning and in a southerly
direction along the west line of said North 15th Avenue, a distance of
951.95 feet, more or less, to a point of intersection with the northerly
right-of-way line of U. S. Highway #191; thence in a westerly direction
along the northerly right of way line of said U. S. Highway #191, a dis-
tance of 700.0 feet; thence in a northerly direction 70U feet west of
and parallel to the west line of North 15th Avenue, a distance of 667.60
feet; thence in a northeasterly direction and at a bearing of N 67051' E.
a distance of 764.15 feet, more or less, to the point of beginning,
said tract containing 13.01 acres, more or less, a Certificate of Survey
of said tract having been filed in File 3 of Plats, and a Deed thereof I
to the. present owner being recorded in Book 134 of Deeds at page 285 in
the office of the Clerk and Recorder of Gallatin County, Montana;
All of Cleveland Subdivision, a portion of the Southeast Quarter of the
Northwest Quarter (SEtNWt) of Section Twelve (12), Township Two (2)
South, Range Five (5) East, M.P.M., a plat of which is on file and of
record in the office of the Clerk and Recorder of Gallatin County,
Man tans, in Book "E" of Plats;
All that part of the Northeast Quarter of the Northwest Quarter
(NEtNWt) of Section Twelve (12), Township Two (2) South, Range Five (5)
East, M.P.M., describsd as follows: Commencing at a point which is
1341.74 feet North 88 59' West of the North quarter corner of said sec-
tion, said quarter corner being marked by a 6'x6' stone buried about
one foot below the surface of Durston Road; thence 679.8 feet South
1032.5' West to the point of beginning of the tract hereby conveyed;
thence Sout 88059' East a distance of 281.26 feet; thence South 0046'
West a distance of 640.26 feet; thence North 89036.5' West a distance
of 289.97 feet to a point, said point being the center of the North-
west Quarter (NWt) of said Section Twelve (12), thence North 1032.5'
East a distance of 643.43 feet to the point of beginning, said tract
containing 4.21 acres, more or less, subject to an existing easement
for an irrigation ditch and flume over and across the South 6' of the
land; a Deed thereof to the present owner being recorded in Book 124
of Deeds at page 431 in the office of the Clerk and Recorder of Gallatin
Coun ty, Man tana ;
A tract of land in the Southeast Quarter of the Northwest Quarter
(SEtNWt) of Section Twelve (12), Township Two (2) South, Range Five
(5) East, more particularly described as follows: Beginning at the
point of intersection of the centerline of U. S. Highway #191 with the I
East line of the NWt of said Section 12, said point being 376.0 feet
North of the center section corner, thence in a Northerly direction
along the Ea'S t line of said NWt a distance of 98'7.5 feet, more or less,
to the Northeast corner SEtNWt Section 12; thence in a Westerly direction
along the North line of the SetNWt a distance of 1183.0 feet to a point
169.0 feet East of the NW corner SetNWt Section 12; thence in a south-
erly direction a distance of lU04.l feet more or less to a point on the
centerline of U. S. HighwaI #191, said point being l7U.0 feet east of
the west line of the Se%NW4; thence in an easterly direction along
said centerline a distance of 1189.1 feet, more or less, to the point
of beginning, a Certificate of Survey of said tract having been filed
in File 3 of Plats in the office of the Clerk and Recorder of Gallatin
County, Montana.
WHEREAS, it will be for the best interest of the City of Bozeman and the

inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore
described to extend the boundaries of the City of Bozeman so as to include the
said contiguous tracts hereinbefore described within the corporate limits of the
said City of Bozeman.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1. That pursuant to the provisions of Chapter 4, Section 11-403,
Subsection 2, Revised Codes of Montana, 1947, it is hereby declared to be to the
1 best interest of the City of Bozeman and the inhabitants thereof and of the
inhabitants of the contiguous tracts hereinbefore described that the boundaries
of the said City of Bozeman be extended so as to include the contiguous tracts
hereinbefore described within the boundaries and corporate limits of the City of
Bozeman, Montana.
Passed and adopted by the Commission of the City of Bozeman at a regular
session held on the 5th day of October A. D. 1960.

NOTICE IN RE
COMMISSION RESOLUTION NO. 994 OF THE CITY OF BOZEMAN
STATING THE INTENTION OF THE CITY COMMISSION TO EX-
TEND THE BOUNDARIES OF SAID CITY OF BOZEMAN TO EMBRACE
AND INCLUDE CERTAIN TRACTS OF LAND ADJOINING SAID CITY
I Notice is hereby given that on the 5th day of October A. D. 1960, at a
regular meeting of the Commission of the City of Bozeman, the said Commission
duly and regularly passed and adopted Commission Resolution No. 994 entitled:
A RESOLUTION OF THE COMMISSION OF THE CrIT OF
BOZEMAN DECLARING IT TO BE THE BEST INTEREST
OF THE CITY OF BOZEMAN AND THE INHABITANTS
THEREOF AND OF THE INHABITANTS OF TRACTS OF
LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN
AND HEREIN MORE PARTICULARLY DESCRIBED TO
EXTEND THE BOUNDARIES OF THE SAID CITY OF
BOZE~~N SO AS TO INCLUDE THE SAID CONTIGUOUS
TRACTS WITHIN THE CORPORATE LINITS THEREOF
Notice is hereby further given that Wednesday, the 2nd day of November,
A. D. 1960, at 1:00 o'clock p.m., at the Commission Room of the City Hall,
Bozeman, Montana, is designated as the time and place for hearing objections to
the action proposed to be taken in said Resolution No. 994, and when and where
any and all persons whose property is within said tracts may appear and show
cause if any they have against said proposed addition of said tracts to the City
of Bozeman. Objections must be made in writing and filed with the Clerk of the
City Commission not later than twenty (20) days after the date of the first pub-
lication of this notice.
For a description of the boundaries of saId tract, reference 1s nereby made
to Commission Resolution No. 994 of the City of Bozeman which is on file in the
office of the undersigned Clerk of said Commission in the City Hall of said City
of Bozeman, and open for inspection to all interested parties and the public
generally.
This notice is given pursuant to the provisions of Chapter 4, Section 11-403,
1- Revised Codes of Montana, 1947.
