HomeMy WebLinkAboutResolution 991 Special Assessment of Taxes for Garbage .1t)t) COMMISSION RESOLUTION NO. 991 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CI'I'Y OF BOZEMAN, COUNTY OF GALLA TIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REMOVED DURING THE YEAR I 1960, TO DEFRAY THE COST AND EXPENSE OF COLLECTING AND DISPOSING OF GARBAGE UNDER THE PROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN. WHEREAS, the City Commission of the City of Bozeman did on the 8th day of January, 1940, duly and regularly pass Ordinance No. 696, entitled: AN ORDINANCE DEFINING GARBAGE FOR THE PURPOSE OF THIS ORDINANCE, PROVIDING FOR THE COLLECTION AND DISPOSITION THEREOF BY AND UNDER THE SUPERVISION AND CONTROL OF THE DEPARTMENT OF PUBLIC WELFARE AND FOR DEFRAYING THE COST OF SUCH COLLECTION AND DISPOSITION BY SPECIAL ASSESSMENT AGAINST THE PROPERTY TO WHICH SUCH SERVICE IS RENDERED, AND PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE, which Ordinance No. 696, passed as aforesaid is hereby referred to and made a part of this Resolution for further particulars in respect to the basis and method of assessing the cost against the property herein assessed, and WHEREAS, said expense incurred by said City in the collection and dispostion of garbage in accordance with said Ordinance is hereby extimated by the Commission of the City of Bozeman to be the sume of Fifty-weven thousand three hundred fift -five & 34 100ths Dollars (57 355.34) - - for the year 1960, over and a ove a moneys co ec e rom s nesa an pro essional concerns, or combined residence and business or residences and professional business concerns in accord- ance with said Ordinance No. 696, and WHEREAS, in order to raise said sum to defray the said cost, it is necess- ary to establish the basic unit rate, as defined in said Ordinance No. 696, at Seventeen Dollars ($17.00) NOW THEREFORE, pursuant to the provisions of said Ordinance No. 696, and the I laws of the state of Montana, BE IS RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF YHE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That to defray the estimated cost and expense of collecting and dis- posing of garbage in the City of Bozeman for the year 1960, there is hereby levied and assessed against the property and the several lots, pieces and parcels of land thereof within the City of Bozeman as set forth in Schedule "A", which is attached hereto and made a part hereof, a tax; that a particular description of each lot and parcel of iand with the name of the owner and/or owners and the sum assessed against the same is set forth in the assessment list in said Schedule "A"; tha t the several sums set opposi te the names of said owners and the des- cribed lots and parcels of iand, be, and the same are hereby levied and assessed upon and against said lots and parcels of land for said purpose; that the several sums be collected from the respective owners of said lots and parcels of land described in said assessment list and owned by them; that the said sums shall be paid and the collection thereof be made in the manner and in accordance with Ordinance No. 696 of the City of Bozeman, Montana, and the iaws of the State of Montana governing the collection of special improvement taxes; that failure to pay such assessment when the same shall become due and payable shall make such persons and such lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. That the regular session of the Commission of the City of Boze- man, Montana, to be held in the Commission Chamber in the City Hall of said City on the 28th day of ~tember, 1960, at l:Ov o'clock P.M. be, and the same is here- by designated as the ime and place at which objections to the final adoption of this Resolution wiil be heard by said Commission. Section 3. That the Clerk of the Commission of the City of Bozeman, be, and I he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in said City of Bozeman, a notice signed by the Clerk of the Commission, stating that a resolution levying and assessing a special assessment of taxes to defray the cost and expense of the collection and disposition of garbage in the City of Bozeman for the year 1960, against the property to which suoh service was rendered, 1s on file in the office of the Clerk of the Commission, subject to inspection for a period of five days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; and that said Notice shall be published at least five days before the date set by the Commission for hearing objections and the final adoption of this Resolution. ..--------- .If.7 Provisionally passed and adopted by the Commission of the City of Bozeman at a regular session thereof held on the 21st day of September, 1960. sf Arnold M. NOTICE IS HEREBY GIVEN, that at a reguLar session of the Commission of the City of Bozeman held on the 21st day of September , 1960, Commission Reso- lution No. 991 was provisionally passed and adopted; that said Resolution levies and assesses a special assessment of taxes to defray the cost of collection and disposition of garbage in the City of Bozeman, for the year 196u, upon all pro- perty to which such service was rendered. That said Commission Resolution No. 991 is now on file in the office of the Clerk of the Commission of the City of ~eman, subject to inspection of all persons interested, for a period of five days; that Wednesday the 28th day of September, 196U, at 1:00 o'clock P.M. of said day at a regular sesSIOn of the Commission of the City of Bozeman, in the Commission Room, in the City Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Commission Resolution No. ~ and the levying of said assessment; and that said Resolution will be final- ly passed and adopted at said regular session of said Commission, subject to such corrections and amendments that may be made upon objections made and filed with the Clerk of the Commission within the five days limit as provided by law.
