COMMISSION RESOLUTION NO. 990 A RESOLUTION OF ~lE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CON- STRUCTING AND INSTALLING AND/OR REPAIRING MISCELLANEOUS I SIDEWALKS AND CURBS DURING THE YEAR 1960. WHEREAS, the Commission of the City of Bozeman, pursuant to the provisions of Ordinance NO. 561, entitled: ttAN ORDINANCE GOVERNING THE CONSTRUCTION AND INSTALLATION OF CONCRETE CURBS AND SIDEWALKS IN THE CITY OF BOZEMAN, PROVIDING PENALTIES FOR ~E VIOLATION OF THIS ORDINANCE AND REPEALING ORDINANCES NOS. 365, 374, 425, 447, 449, AND 451, AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES OF THE CITY OF BOZEMAN IN CONFLICT HEREWITH", and the provisions of Section 11-2226, Political Code, R.C.M. 1947, provided for the construction of sidewalks and curbs in the City of Bozeman during the year 1960, without the formation of a Special Improvement District; WHEREAS, proceedings were had for the construction and installation and/ or repair of Miscellaneous Sidewalks and Curbs in the City of Bozeman for the year 1960, and WHEREAS, miscellaneous Sidewalks and Curbs were constructed and installed and/or repaired bordering on various properties in the City of Bozeman, pursuant to Ordinance No. 561, Section 11-2226, Political Code, R.C.M., 1947, which are hereby referred to and made a part of this Resolution, and I w NOW, THEREFORE, Pursuant to the provisions of Ordinance No. 561 as aforesaid, and Section 11-2226, Political Code, R.C.M. 1947, as aforesaid, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA; See tion 1. That to defray the cost of constructing and installing and/or repairing Miscellaneous Sidewalks and Curbs as set forth in Schedule "A", hereto attached and made a part hereof, there is hereby levied and assessed a tax amount- ing to the sum of Three thousand e1 ht hundred twent -ei ht and 98 luOths , dollars ($3,828.98 . Section 2. That a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such construet10n and installation and/or repair and the amount of each payment to be made and the day when the same shall become delinquent is set forth in the assessment list here- to attached marked Schedule "A" and made a part hereof; that the several sums set opposite the name of the owner and the description of the lots and parcels of land be, and the same are hereby respectively levied and assessed upon said lots and parcels of land to defray the cost and expense of constructing and installing and/or repairing said Sidewalks and Curbs; that the several Bums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list as required by law; that the payment of said sums shall be made on or before the 30th day of November of each year until payment of all installments together with the interest thereon, shall be made; tha t said sums shall be paid and the collection thereof shall be made in the manner and in accord- ance with the law governing the collection of Special Improvement taxes; that failure to pay s~ch assessments when the same shall become due and payable shall make such persons and said lots and parcels of land liable to the penalties pro- I vided by law relative to delinquent taxes. Section 3. That the regular session of the Commission of the City of Boze- man to be held in the Commission Chamber in the City Hall of said City on the 21st day of September, 1960, at 1:00 o'clock P.M. be, and the same is here desi- gnated as the time and piace at which objections to the final adoption of this Resolution will be heard by said Commission. Section 4. That the Clerk of the Commission of the City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Dally Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assess- ing a special assessment of taxes to defray the cost and expense of constructing and installing and/or repairing Sidewaiks and Curbs in the City of Bozeman for the year 1960 is on file in the office of the Clerk of the Commission subject to H _ - -..-...- - ---.- --.- .----- .1 f)Ll inspection for a period of five (5) days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adopt- ion of this Resolution; that it shall be published at least five (5) days before the date set by the Commission for the hearing of objections and the final adop- tion of this Resolution. HEARING, FINAL ADoprrION COMMISSION RESOLUTION NO. 99U, LEVYING ASSESSMENT TAXES, CONSTRUCTION AND INSTALLATION AND/OR REPAIR MISCELLANEOUS SIDEWALKS AND CURBS IN THE CI~Y OF BOZEMAN DURING THE YEAR 196U. NOTICE IS HEREBY GIVEN, tha t during a regular session of the Commission of I the City of Bozeman held on Wednesday, the la4th day of September, 196u, Commis- alon Resolution No. 99U was provisionally passed and adopted; that said Commis- sion Resolution levies and assesses a special assessment of taxes upon certain lots and parcels of land in front, Or on the side of which, sidewalks and curbs have been constructed and/or repaired pursuant to the provisions of Ordinance No. 561 and Section 11-2226, POlitical Code, R.C.M., 1947, to defray the cost and expense of constructing and installing and/or repairing said Sidewalks and Curbs. That said Commission Resolution is now on file in the office of the Clerk of the Commission, subject to inspection for a period of Five (5) days by any persons interested. That Wednesday the 21st day of September, 196v, at 1:00 P.M. of said day, at the regular session of the said Commission of the City of Bozeman at the Commission Chamber, City Hall Building of said City, has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Reso- lution No. 99U and the levying of said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persona interested are referred to said Ordinance No. 561, and the Commissioners' proceedings for the construction and/or repair of Miscellaneous Sidewalks and Curbs, in front of or on the side of lots and parcels of land with- in the City of Bozeman for the year 1960 without the formation of a Special Improvement District.
