HomeMy WebLinkAboutJAG Docs Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Mark Tymrak – Director of Public Safety - Police SUBJECT: Inter-local agreement between the City of Bozeman and the County of Gallatin for the 2007 Byrne Justice Assistance Grant (JAG) Program Award MEETING DATE: July 2, 2007 RECOMMENDATION: Authorize the Director of Public Safety – Police to sign the inter- local agreement between the City of Bozeman and the County of Gallatin for the 2007 Byrne Justice Assistance Grant (JAG) Program Award. BACKGROUND: On June 26, 2007 the Gallatin County Sheriff’s Office and Bozeman Police Department were notified that the agencies could jointly apply for grant funds to a maximum amount of $23,465.00 for the purchase of law enforcement related equipment through the Justice Assistance Grant (JAG) Program. The agencies have jointly participated in this and similar grant projects for the past nine years. The Bozeman Police Department and Gallatin County Sheriff’s Office jointly provide the services of a Special Response Team (SRT) for public safety response. The Special Response Team utilizes specialized equipment to support public and community safety that enhance the services provided by the department patrol divisions. The Gallatin County Sheriff’s Office and Bozeman Police Department have jointly identified needed equipment in the amount of $21,631.00 and Indirect costs of $1,804.00 for a total grant request of $23,435.00. There is no requirement for additional matching funds to qualify for this JAG assistance grant. Commission authorized the City to enter into the 2006 inter-local agreement with Gallatin County. This action will authorize the City to enter into the same inter-local agreement for the year 2007. FISCAL EFFECTS: none identified ALTERNATIVES: As suggested by the Commission. Kukulski, City Manager Attachments: (1) Inter-local agreement between the City of Bozeman and the County of Gallatin for the 2007 Byrne Justice Assistance Grant (JAG) Program Award; (2) Byrne Justice Assistance Grant Budget Worksheet and; (3) Byrne Justice Assistance Grant Narrative GMS Application Number: 2007-F6231-MT-DJ Contract Number: The State of Montana County of Gallatin County City of Bozeman Know all by these present INTERLOCAL AGREEMENT BETWEEN THE COUNTY OF GALLATIN, AND THE CITY OF BOZEMAN 2007 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD This Agreement if made and entered into this _____ day of _____, by and between the COUNTY of Gallatin, acting by and through its governing body, the Commissioners Court, hereinafter referred to as COUNTY, and the CITY of BOZEMAN, acting by and through its governing body, the City Council, hereinafter referred to as CITY, both of Gallatin County, State of Montana, witnesseth: WHEREAS, this Agreement is made under the authority of Montana Code Annotated 7-11-101 et.seq.; and WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party: and WHEREAS, each governing body finds that the performance of this Agreement is in the best interests of both parties, that the undertaking will benefit the public, and that the division of costs fairly compensates the performing party for the services or functions under this agreement: and WHEREAS, the CITY and COUNTY agree to jointly use the $23,435 from the JAG award towards the purchase of specialized equipment and indirect costs for the Special Response Team which is an equal collaborative effort by the CITY and the COUNTY: and WHEREAS, the CITY and COUNTY believe it’s in the best interests of the public to reallocate JAG funds. Nothing in the performance of this Agreement shall impose any liability for claims against COUNTY other than claims for which applicable Montana State Statutes may impose liability. Section 4. Nothing in the performance of this Agreement shall impose any liability for claims against CITY other than claims for which applicable Montana State Statutes may impose liability. Section 5. Each party to this Agreement will be responsible for its own actions in providing services under this Agreement and shall not be liable for any civil liability that may arise for the furnishing of the services by the other party. The parties to this Agreement do not intend to create any obligations express or implied other than those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto. Indirect Costs $ 1,804 FEDERAL SHARE $23,435 TOTAL PROJECT COST $23,435 GALLATIN COUNTY SPECIALIZED SRT EQUIPMENT PURCHASE PROGRAM NARRATIVE: Gallatin County and the City of Bozeman, Montana are jointly submitting this application for $23,435.00 in funding from the Justice Assistance Grant program (JAG) to facilitate the acquisition of specialized special response team equipment. The equipment purchase is a collaborative effort initiated by the Gallatin County Sheriff’s Office and the Bozeman City Police Department. Gallatin County is a rural area of 2,606 square miles with a 2004 population of 75,637. Not included in this total are the 12,250 students enrolled at Montana State University. These figures represent a population density with a low of 8 people per square mile in the rural areas, and a high of 1,743 per square mile in the City of Bozeman. Population has been increasing at the rate of 3.5% per year. The County is the fifth largest county in the state. The current County population is expected to approach 100,000 by the year 2010. Our rapid rate of growth has lead to an increase in the demand for services. Our ability to provide an acceptable level of service to local residents is also challenged because of our close proximity to Yellowstone Park and three major ski resorts. The area receives some 3.0 million tourists each year. Expanded recreational activities of our residents and tourists demand that emergency services cover the entire County on a year around basis. The coverage area includes extreme mountain topography further complicated by extreme weather. Growth has also resulted in a significant increase of persons employed in lower paying service related jobs. As these individuals seek affordable property and housing they are expanding into the outlying rural areas. With this rapid growth has come a significant increase in the types of events that require immediate response by specialized trained personnel. Throughout the County we are experiencing an increase in robberies, hostage situations, methamphetamine and drug related occurrences, and other additional violent crimes. The Special Response Team is used in situations that require specialized training and equipment to successfully mitigate the situation. This team is comprised of County Deputies and City Officers. They are trained to respond to high risk warrant services, hostage situations, barricaded subjects, Active Shooter situations and other high risk situations that require a coordinated and specialized response. In order for these situations to be mitigated it is of the utmost importance that all team responders be outfitted with the proper protective equipment and the proper tools. This request includes the following purchases: (16) Level 3A ballistic helmets - $3,760.00 (1) Level 3A ballistic blanket - $1,531.00 (20) Flash bangs - $1,200.00 (1) Case of Flash bang charge - $750.00 (1) Wall bang entry tool - $1,200.00 (1) Enforcement Technology Group DL-800 Throw phone - $8,250.00 (1) Remington Eye Camera - $4,800.00 (1) Chemical Munitions Vest - $140.00 Indirect costs - $1,804.00 This is a total of $23,435.00. The local increase in service expectations is counter balanced by a pressure to keep local tax assessments low. Life/safety and emergency response issues however, remain the primary service delivery local government must meet. Financial resources for law enforcement are severely limited. Our proposal requests the ability to utilize the $23,435.00 available through JAG to purchase newer and specialized equipment needed for the Special Response Team. We are hopeful you will find that the circumstances outlined in this proposal comply with the need to justify circumstance, which make the use of JAG funds for specialized equipment necessary.
