COMMISSION RESOLUTION NO. 989
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF
BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE
KNOWN AS SPECIAL INPROVEMENT SPRINKLING DISTRICT NO. 4
FOR THE PURPOSE OF SPRINKLING WATER, OIL, SALT, OR
ANY
OTHER DUST PALLIATIVE UPON PARTS AND PORTIONS OF WEST

MAIN STREET IN THE CITY OF BOZEMAN; ENUMERATING THE
STREETS, ALLEYS AND PUBLIC PLACES TO BE INCLUDED WITHIN
SAID SPRINKLING DISTRICT; PROVIDING THE MANNER TO BE EM-
PLoYED IN SPRINKLING SAID STREEIDS; ESTIMATING THE COST
OF SPRINKLING IN SAID DISTRICT AND PROVIDING FOR THE
METHOD OF ASSESSMENT OF THE PROPERTY TO BE BENEFITED BY
SAID SPRINKLING DISTRICT
WHEREAS, it is the intention of the City Commission of the City of Bo~eman,
Montana, to provide for the sprinkling of certain portions and parts of streets
hereinafter designated.
NOW, THEREFORE, BE IT REBOL VED BY THE CITY COMMISSION OF THE
CITY OF BOZEMAN:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to
create a special improvement sprinkling distriot to be known as Speoial Improve-
ment Sprinkling Distriot No.4 of the City of Bozeman, Montana, for the purpose
of sprinkling water, 011, salt or any other dust palliative upon the streets
and alleys hereinafter enumerated:
West Main Street from the west property line of vacated
Fourth Avenue to the west property line of South Eighth

Method of Sprinkling
That it is the intention of the City of Bozeman, Montana, to sprinkle the
streets and alleys in said sprinkling distriot by foroes employed by the City.

Es tima te of Cost
The estimated annual cost of said sprinkling is $810.59. The City of Boze-
man will pay twnety-five (25) percent of this cost, and the owners of property
fronting upon the streets or avenues upon whiCh sprinkling is done will pay the
remaining seventy-five (75) percent of the cost.
Section 4
Method of Assessment
The assessment for the cost and expense of sprinkling said streets and
avenues shall be made upon a frontage basis with each lot or parcel of land with-
in such sprinkling district abutting upon some street or avenue upon which sprink-
ling is done to be assessed for that part of the whole cost which its street front-
age bears to the street frontage of the entire sprinkling district. On this basis,
the lineal frontage of the distriot is 2,432.0 feet, and the estimated rate of
assessment Is $.25 per fron foot.

The total front footage of property fronting upon streets and avenues upon
which sprinkling is to be done 1s 2,432.0 lineal feet and protests against the
proposed work will be considered by the City Commission on a frontage basis.

Protests and Notioe
That the regular session of the City Commission of the City of Bozeman, to

be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on
Thursday, the 13th day of October A. D. 196u, at the hour of one o'clock p.m.
of said day, is the time and place,
when and where the City Commission will hear
and pass upon all protests duly and regularly made and filed against the creation
of said proposed special Improvement Sprinkling District fio. 4; and the Clerk of
the City Commission, be, and he is hereby, directed to give notice in the manner
and for time time as by law required of the adoption of this resolution of
in tention.

Notice is hereby given that on the 7th day of September A. D. 1960, at a reg-
ular session of the Commission of the City of Bozeman, Commission resolution No.
I 91:39 entitled:

MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF
BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE
KNOWN AS SPECIAL IMPROVEMENT SPRINKLING DISTRICT NO.4
FOR THE PURPOSE OF SPRINKLING WATER, OIL, SALT, OR ANY
OTHER DUST PALLIATIVE UPON PARTS AND PORTIONS OF WEST

was passed and adopted;
That Thursday, the 13th day of October A. D. 196U, at one o'clock p.m. at
the Commission Room of the City Hall, Bozeman, Montana, is designated by Reso-
lution No. 989 as the time and place for hearing objections to the action pro-
posed to be taken by said resolution when and where any and all persons whose
property fronts upon the streets within said proposed Special Improvement Sprink-
ling District No.4 in the City of Bozeman, Montana, may appear and show cause,
- if any they have, against said proposed improvement.
Objections must be made in
writing and filed with the Clerk of the City Commission not later than fifteen
~ (15) days after date of the first publication of this notice.
The estimated annual cost of said sprinkling is $81U.59. The City of Boze-
man will pay 25% of this cost, and the owners of property fronting upon the streets
or avenues upon which sprinkling is done will pay the remaining 75% of the cost.

Codes of Montana, 1947.
