Home My WebLink AboutResolution 988 SID Sprinkling District 3 __ _m_n__ -- .- __ _.._____.u_ .1;37 COMMISSION RESOLUTION NO. 988 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVE}mNT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT SPRINKLING DISTRICT NO. 3 FOR THE PURPOSE OF SPRINKLING WATER, OIL, SALT, OR ANY OTHER DUST PALLIATIVE UPON PARTS AND PORTIONS OF MENDEN- I HALL STREET, ROUSE, BOZEMAN, BLACK, TRACY, WILLSON, GRAND AND NORTH THIRD AVENUES IN THE CITY OF BOZEMAN; ENUMERATING THE STREETS, ALLEYS AND PUBLIC PLACES TO BE INCLUDED WITHIN SAID SPRINKLING DISTRICT; PROVIDING THE MANNER TO BE EM- PLOYED IN SPRINKLING SAID STREETS; ESTIMATING THE COST OF SPRINKLING IN SAID DISTRICT AND PROVIDING FOR THE METHOD OF ASSESSMENT OF THE PROPERTY TO BE BENEFITED BY SAID SPRINKLING DISTRICT WHEREAS, it is the intention of the City Commission of the City of Bozeman, Montana, to provide for the sprinkling of certain portione and parts of streets here- inafter designated. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement sprinkiing district to be known as Special Improvement Sprink- ling District No.3 of the City of Bozeman, Montana, for the purpose of sprinkling 'water, oil, salt or any other dust palliative upon the streets and alleys hereinafter enume ra te d : Mendenhall Street from the east property line of North Rouse Avenue to the west property line of North Third Avenue including one-half (~ ) block on Rouse, Bozeman, I Black, Tracy, Willson and Grand Avenues south from Mendenhall Street and North Third Avenue between Menden- hall Street and Main Street Section 2 Method of Sprinkling That it is the intention of the City of Bozeman, Montana, to sprinkle the streets and alleys in said sprinkling district ~y forces employed by the City. Section 3 Es tima te of Cos t The estimated annual cost of said sprinkling is $2,148.05. The City of Bozeman will pay twenty-five (25) percent of this cost, and the owners of property front- ing upon the streets or avenues upon Which sprinkling is done will pay the remain- ing seventy-five (75) percent of the cost. Section 4 Method of Assessment The assessment for the cost and expense of sprinkling said streets and avenues shall be made upon a frontage basis with each lot or parcel of land within such sprinkiing district abutting upon some street or avenue upon Which sprinkling is done to be assessed for that part of the whole cost which its street frontage bears to the street frontage of the entire sprinkling district. On this basis, the lin- eal frontage of the district is 6,444.8 feet, and the estimated rate of assessment is $ .25 per front foot. ' I Section 5 Assessable Area of Distriot The total front footage of property fronting upon streets and avenues upon which sprinkling is to be done is 6,444.8 lineal feet and protests against the pro- posed work will be considered by the City Commission on a frontage basis. Section 6 Protests and Notioe That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Thursday, the 13th day of October A. D. 1960, at the hour of one o.clock p.m. of said day, .1~)8 is the time and place, when and where the City Commission will hear and pass upon all protests duly.and regularly made and filed against the creation of said pro- posed special Improvement Sprinkiing District No.3; and the Clerk of the Commis- sion be, and he is hereby, directed to give notice in the manner and for the time as by law required of the adoption of this resolution of intention. Adopted by the Commission of the City of Bozeman, Montana, at a regular and stated session of said Commission held on the 7th day of September A. D. 1960, at one o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana, is designated by Reso- lution No. 988 as the time and place for hearing objections to the action pro- posed to be taken by said resolution when and where any and all persons whose property fronts upon the streets within said proposed Special Improvement Sprinkling District No.3 in the City of Bozeman, Montana, may appear and show cause, if any they have, against said proposed improvement. Objections must be made in writing and filed with the Clerk of the City Commission not later than fifteen (15) days after date of the first publication of this notice. The estimated annual cost of said sprinkling is $2,148.06. The City of Bozeman will pay 25% of this cost, and the owners of property fronting upon the streets or avenues upon which sprinkling is done will pay the remaining 75% of the cost. The assessment for the cost and expense of sprinkling said streets and avenues shall be made upon a frontage basis with each lot or parcel of iand with- in such sprinkling district abutting upon some street or avenue upon which sprink- ling is done to be assessed for that part of the whole cost which its street frontage bears to the street frontage of the entire sprinkiing district. On th1s basis, the lineal frontage of the district is 6,444.8 feet, and the estimated I rate of assessment is $.25 per front foot. For a description of the streets included within said Special Improvement Sprinkling District No.3, reference is hereby made to Resolution No. 988 of the Commission of the City of Bozeman declaring the intention to create said district, which is on fiie in the office of the undersigned Clerk of said Commission in the City Hall of said City of Bozeman, Montana, and open for inspection to all inter- ested persons and the public generally. This notice is given pursuant to the provisions of Section il-2204, Revised Codes of Montana, 1947. Dated this 7th day of September A.
