HomeMy WebLinkAbout06-25-07 Packet_Approve Lincoln Park Condos Dedication of Street R_4 Report compiled on June 20, 2007 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Jody Sanford, Senior Planner SUBJECT: Lincoln Park Condos – Dedication of Street Right-of-Way MEETING DATE: Monday, June 25, 2007 CONSENT AGENDA ITEM BACKGROUND: The owners of the subject property have claimed a subdivision exemption for a realignment of a common boundary line between a single lot within a platted subdivision and adjoining land outside of a platted subdivision (76-3-207.1.e., M.C.A.) and for the relocation of a common boundary between five or fewer lots within a platted subdivision. These exemptions would facilitate the redevelopment of the subject property with a condo development (Lincoln Park Condos) which was approved by the City Commission in 2006. The applicants have submitted the attached amended plat for the subdivision exemption, and the Planning Director has already accepted the use of the claimed exemption. However, the applicants are also proposing to dedicate street right-of-way to the City of Bozeman for Lincoln Street and Maple Lane with this amended plat. The City Commission must accept such dedications. The amended plat has been revised so that the City is not responsible for maintaining Maple Lane since it is a substandard right- of-way. UNRESOLVED ISSUES: There are no unresolved issues at this time. RECOMMENDATION: The City Commission accepts the dedication of street right-of-way for Lincoln Street and Maple Lane, and directs the Director of Public Service to sign the amended plat on the governing body’s behalf. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from annexation of the property, and costs from additional service demand.
