SUBJECT: Final Adoption of Ordinance 1891 approving the Boulder Creek Zone Map
Amendment to rezone 0.6655 acres from R-2, Residential Two Household Medium Density
District to R-4, Residential High-Density District; 0.2146 acres from R-4, Residential High-
Density District to R-2, Residential Two Household Medium Density District; 0.1504 acres
from PLI, Public Lands and Institutions District to R-2, Residential Two Household Medium Density District and 1.3487 acres from R-2, Residential Two Household Medium
Density District to PLI, Public Lands and Institutions District. The property is described as
various portions of Lot 3A of Minor Subdivision No. 201A, located in the S½ of Section 4,
Township 2S, Range 5E, of P.M.M, City of Bozeman, Gallatin County, Montana. The
project is generally located between Durston Road and W. Oak Street (as extended), east of Laurel Parkway and north of Annie Street (as extended). Application Z14030

AGENDA ITEM TYPE: Consent
RECOMMENDATION: That the City Commission finally approve Ordinance 1891 for the
Boulder Creek Zone Map Amendment.
BACKGROUND: The property owner/applicant Four Corners Construction, LLC, with
representative C&H Engineering and Surveying, Inc., received preliminary approval for this
zone map amendment from the City Commission on April 7, 2014. The applicant has submitted
the final paperwork and it now requires the implementing ordinance to be approved. The
Commission’s approval of this consent item incorporates the findings made for the zone map amendment with the Commission’s unanimous approval on April 7, 2014. The Commission
provisionally approved this Ordinance at the June 9, 2014 City Commission meeting. The
Ordinance now requires final approval.
UNRESOLVED ISSUES: None at this time.
ALTERNATIVES: 1. Adopt the ordinance as provided by staff 2. Adopt a modified ordinance as directed by the City Commission
3. Not adopt the ordinance

FISCAL EFFECTS: No immediate fiscal impacts are expected from this action. Future
development will generate both costs and revenues dependent on the nature of the development.

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP TO REZONE 0.6655
ACRES FROM R-2 (RESIDENTIAL TWO-HOUSEHOLD MEDIUM DENSITY
DISTRICT) TO R-4 (RESIDENTIAL HIGH DENSITY DISTRICT); 0.2146 ACRES
FROM R-4 (RESIDENTIAL HIGH DENSITY DISTRICT) TO R-2 (RESIDENTIAL
TWO-HOUSEHOLD MEDIUM DENSITY DISTRICT); 0.1504 ACRES FROM PLI
(PUBLIC LANDS AND INSTITUTIONS DISTRICT) TO R-2 (RESIDENTIAL TWO-
HOUSEHOLD MEDIUM DENSITY DISTRICT) AND 1.3487 ACRES FROM R-2
(RESIDENTIAL TWO-HOUSEHOLD MEDIUM DISTRIT) TO PLI (PUBLIC LANDS
AND INSTITUTIONS DISTRICT) FOR PROPERTY WHICH IS DESCRIBED AS
VARIOUS PORTIONS OF LOT 3A OF MINOR SUBDIVISION NO. 201A, LOCATED
IN THE SOUTH ONE-HALF (S ½) OF SECTION 4, TOWNSHIP TWO SOUTH (2S),
RANGE FIVE EAST (5E), OF PMM, CITY OF BOZEMAN, GALLATIN COUNTY,
MONTANA.
WHEREAS, the City of Bozeman has adopted zoning regulations and a zoning map
pursuant to Sections 76-2-301 and 76-2-302, Mont. Code Ann.; and
WHEREAS, Section 76-2-305, Mont. Code Ann. allows local governments to amend
zoning maps if a public hearing is held and official notice is provided; and
WHEREAS, Section 76-2-307, Mont. Code Ann.; states that the Zoning Commission
must conduct a public hearing and submit a report to the City Commission for all zoning map
amendment requests; and
WHEREAS, the City of Bozeman Zoning Commission has been created by Resolution
of the Bozeman City Commission as provided for in Section 76-2-307, Mont. Code Ann.; and
WHEREAS, Chapter 38, Article 37 of the Bozeman Unified Development Code sets
forth the procedures and review criteria for zoning map amendments; and

WHEREAS, the proposed zone map amendment to amend the City of Bozeman Zone
Map to rezone 0.6655 acres from R-2, Residential Two Household Medium Density District to
R-4, Residential High-Density District; 0.2146 acres from R-4, Residential High-Density District
to R-2, Residential Two Household Medium Density District; 0.1504 acres from PLI, Public
Lands and Institutions District to R-2, Residential Two Household Medium Density District and
1.3487 acres from R-2, Residential Two Household Medium Density District to PLI, Public
Lands and Institutions District has been properly submitted, reviewed and advertised; and
WHEREAS, the Bozeman Zoning Commission held a public hearing on March 18,
2014, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the Bozeman Zoning Commission unanimously recommended to the
Bozeman City Commission that the zone map amendment be approved with the findings
presented in the Community Development Department staff report for said zone map
amendment; and
WHEREAS, after proper notice, the City Commission held its public hearing on April 7,
2014, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the City Commission has reviewed and considered the eleven (11) zone
map amendment criteria established in Section 76-2-304, Mont. Code Ann., and found that the
proposed zone map amendment would be in compliance with the eleven (11) criteria; and
WHEREAS, at its meeting held on April 7, 2014, the City Commission found that the
proposed zone map amendment would be in compliance with Bozeman’s adopted growth policy
and would be in the public interest.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOZEMAN, MONTANA:
Section 1
That the zoning district designations of the following-described properties are hereby
amended as follows (and as shown on Exhibit A – Boulder Creek Zone Map Amendment):

(ZONE MAP AMENDMENT AREA A, R-2 TO R-4)
That part of Lot 3A of Minor Subdivision No. 201A, according to the plat thereof on file and of record in the office of the Clerk and Recorder, Gallatin County, Montana, and located in the
South Half of Section 4, Township 2 South, Range 5 East of Principal Meridian, Montana,
described as follows:
Commencing at the East quarter corner of said Section 4; thence westerly 269°18'14", assumed azimuth from the north, 1,324.86 feet along the north line of the Southeast Quarter of said
Section 4 to the Northeast Corner of said Minor Subdivision 201A; thence westerly 269°18'14"
azimuth, a distance of 452.97 feet to the Point of Beginning of the property to be described;
thence southerly 180°00'00" azimuth, a distance of 445.89 feet; thence on the following courses
along the centerline of Abigail Lane: northwesterly 336°59'29" azimuth, a distance of 155.24 feet; northerly 120.47 feet on a tangential curve concave to the east, radius 300.00 feet and
central angle 23°00'31"; thence northerly 000°00'00" azimuth, a distance of 184.71 feet; thence
easterly 089°18'14" azimuth, a distance of 84.55 feet along the north line of said Lot 3A to the
Point of Beginning.
Area = 28,991 square feet, 0.6655 acres or 2,693.4 square meters. Subject to existing easements,
and in particular a utility and road easement along the north and south line of the above

That part of Lot 3A of Minor Subdivision No. 201A, according to the plat thereof on file and of record in the office of the Clerk and Recorder, Gallatin County, Montana, and located in the
South Half of Section 4, Township 2 South, Range 5 East of Principal Meridian, Montana,
described as follows:
Commencing at the East quarter corner of said Section 4; thence westerly 269°18'14", assumed azimuth from the north, 1,324.86 feet along the north line of the Southeast Quarter of said Section 4 to the Northeast Corner of said Minor Subdivision 201A; thence westerly 269°18'14"
azimuth, a length of 452.97 feet along the north line of said Lot 3A; thence southerly 180°00'00"

Section 2
Repealer.
All provisions of the ordinances of the City of Bozeman in conflict with the provisions of
this ordinance are, and the same are hereby, repealed and all other provisions of the ordinances
of the City of Bozeman not in conflict with the provisions of this ordinance shall remain in full
force and effect.
Section 3
Savings Provision.
This ordinance does not affect the rights and duties that matured, penalties that were
incurred or proceedings that were begun before the effective date of this ordinance. All other
provisions of the Bozeman Municipal Code not amended by this Ordinance shall remain in full
force and effect.
Section 4
Severability.
That should any sentence, paragraph, subdivision, clause, phrase or section of this
ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect
the validity of this ordinance as a whole, or any part or provision thereof, other than the part so
decided to be invalid, illegal or unconstitutional, and shall not affect the validity of the Bozeman
Municipal Code as a whole.
Section 5
Codification.
This Ordinance shall not be codified but shall be kept by the City Clerk and entered into a
disposition list in numerical order with all other ordinances of the City and shall be organized in
a category entitled “Zoning Map Amendments.”

Section 6
Effective Date.
This ordinance shall be in full force and effect thirty (30) days after final adoption.
PROVISIONALLY ADOPTED by the City Commission of the City of Bozeman,
Montana, on first reading at a regular session held on the 9th of June, 2014.

FINALLY PASSED, ADOPTED AND APPROVED by the City Commission of the
City of Bozeman, Montana on second reading at a regular session thereof held on the 23rd of
