COMMISSION RESOLUTION NO. 973
A RESOLUTION. OF THE COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AUTHORIZING THE MAYOR AND THE CLERK OF THE
CITY COMMISSION TO EXECUTE A QUIT CLAIM DEED TO A CERTAIN
STRIP OF LAND ALONG THE NORTH BOUNDARY OF EAST BABCOCK
STREET, IMMEDIATLEY ADJACENT THERETO, APPROXIMATELY 240
FEET LONG, EAST AND WEST, COMMENCING AT THE EAST LINE OF-
I SOUTH BOZEMAN AVENUE AT WHICH POINT SAID STRIP IS APPROXI-
MATELY 12.7 FEET WIDE, AND SAID STRIP BEING APPROXIW~TELY
2.33 FEET WIDE AT THE EAST END THEREOF, TO SECURI~
BUILDING, INC., A CORPORATION, THE PRESENT RECORD OWNER
OF ADJOINING LANDS
WHEREAS, on December 23, 1938, without a Resolution or Ordinance author-
izing the same, the Mayor and the Clerk of the City Commission, upon a motion
of the City Commission, executed a Bargain and Sale Deed to the following-des-
cribed property, to-wi t :
Beginning at a point in the East line of Bozeman Avenue,
South, said point being 12.7 feet South of the Southwest
corner of Block "Ctr! of the Original Townsite of said
Bozeman, Montana; thence easterly 240 feet, more or less,
to a point 19 feet south of the Southeast corner of Lot
29 of said Block "Cn; thence South 2.33 feet to the North
line of Babcock Street; thence West along the North line
of said Babcock Street 240 feet, more or less,
to the East
line of Bozeman Avenue, South; thence North 8.8
feet, more
or less, to the point of beginning.
Situate in the County
of Gallatin, Montana,
to the adjoining property owner to the North thereof, and
WHEREAS, objection has been made that the said conveyance was not author-
ized, as required by law, and,
WHEREAS, the afore-described strip of land is not now being used for a
public use or purpose, and is not being held for any public use or purpose, and,
I WHEREAS, the present record owner of the property immediately adjoining
said strip of land, to the North thereof, is Security
Building, Inc., a corp-
oration duly organized and existing under and by virtue of the laws of the State
of Montana, with its principal place of business at Bozeman, Montana, and,
VffiEREAS, it appears that the said strip of land should be properly con-
veyed to the present owner, Security Building, Inc., and that the same may be
done wi thOl..lt detriment to the public interest,
NOW, THEREFORE,
BE IT RESOLVED BY THE COM]',HSSION OF THE CITY OF BOZEMAN:
Section 1
That the Mayor and the Clerk of the City Commission are hereby author-
ized to execute a Quit Claim Deed to Security Building, Inc., a corporation,
to the following-described real property situated in the City of Bozeman,
County of GRllatin, State of Montana, as follows:
to-wit:
Beginning at a point in the East line of Bozeman Avenue, South,
said point being 12.7 feet South of the Soutwest corner of Block
"C''', of the Original Townsite of said Bozeman, Montana; thence
Easterly 240 feet, more or less, to a point 19 feet south of the
Southeast corner of Lot 29 in said Block ttctt; thence South 2.33
feet to the North line of Babcock Street; thence West along the
North line of said Babcock Street 240 feet, more or less, to
the
East line of Bozeman Avenue, South; thence North 8.8 feet, more
I or less, to the point of beginning; SAVING AND EXCEPTING THERE-
FRml1 THE PORTIONS OF SAID PROPERTY HERETOFORE GRANTED to the City
of Bozeman by the said Security Building, Inc., as easements, for
alley and street purposes in that certain Quit Claim Deed dated
October 23, 1958, and filed for record on December 10,
1958, in
Book 129 of Deeds at PaGe 348 thereof, of the records of the
County Clerk and Recorder of Gallatin County, Montana, and in that
certain Quit Claim Deed dated October 23, 1958, and filed for record
on December 10, 1958, in Book 129 of Deeds at Page 350 thereof of
the records of the County Clerk and Recorder of Gallatin County,
Montana
the City Commission being of the opinion, after due consideration,
tha t said
strip of land should be quit claimed to the adjoining property owner, Security
Building; Inc., without detriment to the public interest and should be granted
in the public interest.

Passed and adopted by the City Commission at its regular meeting held on
the 13th day of April, 1960.
