Home My WebLink AboutResolution 967 SID's Due and Payable ------.-.- - .......u.____ ,1n;1 COMMISSION RESOLUTION NO. 967 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING CERTAIN SPECIAL ASSESSMENTS AND INSTALLMENTS OF SPECIAL ASSESS- MENTS, DUE AND PAYABLE NOVEMBER 30TH, 1959, AND UNPAID AS OF THAT DATE AND CERTIN OTHER SPECIAL ASSESSMENTS AND INSTALLMENTS OF SPECIAL ASSESS~1ENTS, DUE AND PAYABLE NOVEMBER 30TH, 1959, AND UN- PAID, DELINGQUENT, AS PROVIDED BY ORDINANCE NO. 594, ENTITLED: "AN ORDINANCE PROVIDING FOR THE COLLECTION OF TAXES :BX JlD ]1]1, AND THE COLLECTION OF SPECIAL ASSESSMENTS XXX xx" AND SECTION I 11-2233, POLITIaAL CODE, R. C. M., 1947. See tion 1. WHEREAS, pursuant to the provisions of Section 10, Ordinance No. 594, entitled: "An ordinance providing for the collection of taxes xx xxx and for the collection of special assessments xx xxx" the Director of Finance has prepared and filed with the Commission of the City of Bozeman a report showing the special assessments and installments of special assess- ments, due and payable November 30th, 1959, and unpaid as of that date; and Section 2, WHEREAS, The Commission having examined said report marked Schedule "A", and ~ Section 3, WHEREAS, The Commission of The City of Bozeman deems-it necessary - and proper, in order that the interests of The City of Bozeman and those persons hoId~ ing Special Improvement District Bonds of the several Improvement Districts wherein special assessments are unpaid, as herein set forth, shall be properly protected, that all such special assessments and/or installments of such special assessments, which are unpaid, as herein set forth, and all such special assessments and/or installments of such special assessments, which are due and payable, shall be declared delinquent, and I certified to the County Clerk & Recorder and the County Treasurer of the County of Gallatin for collection as other delinquent taxes, and the property and/or properties may be sold the same as other property is sold for taxes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMA N : Section 4. That all special assessments and installments of special assessments, due and payable November 30th, 1959, and unpaid as of that date, as set forth in sched- ule "AIt hereto a ttached and made a part hereof, be and the same are hereby, declared delinquent; Section 5. That the Flrector of Finance be, and he is hereby directed to certify all special assessments and installments of special a~se-ssme~te, delinquent, as herein provided and as shown by said "Schedule Art, to the ~ounty Clerk & Recorder and County Treasurer of the County of Gallatin for collection a~ other deLinquent taxes, as pro- vided by law; - See tion 6. That within ten (10) days from a:dd/after the filing of' said certificate, - - - as aforesaid the Direc tor of Finance shall publish in-'one issue of the Bozeman Daily I Chronicle, a Notice as provided by Section 13 of said Ordinance No. 594; Section 7. That the County Treasurer shall proceed to the collection of all spe- cial assessments or ins tallments of speciala-ssessments, a s set forth in said Schedule "A"'; that the same shaLl be spread upon the delinquent tax list of the County of Gallatin for the year 1959, and the same shR..il be collected as other delinquent taxes; and that in case the same are not paid, th~n~the whole prQperty or properties shall be sold the ,- - same as other property or preopertre~ 1st ~old for taxes; Section 8. That the special assessments and installments of special assessments, ------- ---- .10,1 delinquent as hereIn set forth, shall be collected by the County Treasurer of the County of Gallatin as provided by Section 84-4101 and 84-4104 and Section 11-2233, Political Code, R. C. M. 1947. . Section 9. That the Director of Finance, under the direction of the City Manager, shall attend at the time and place of the sale of the property for delinquent taxes, as provided by Section 15 of said Ordinance No. 594; I Section 10. Tha t a copy of this Reso lu tion toge ther wi th Schedule "A,r attached and made a part thereof, shall on or before the lOth day of December, 1959 be filed with the County Clerk & Recorder and the County Treasurer of the County of Gallatin; Section 11. That attached thereto and made a part thereof shall be a certificate of the Director of Finance as provided by Section 12 of said Ordinance No. 594. I That this certificate and the Schedule "A" hereto attached, are made pursuant to and conform with, Section 21, of Ordinance No. 594, of the City of Bozeman, Montana.
