WHEREAS, the ::;ity Commission of the City of Bozeman did on the 8th day of Ja.nuary, 1940, I duly and re~11ar1y nass Ordinance No. 696, entitled: AN ORDINANCE DE}~INING GARBAGE FOR 'nIE T'URPOSE OF ffEIS OHDINANCE, PROVIDI NG POR 'tHE COLLECTION AND DISPOSITION THER OP BY AND UNDER THE SUPERVISION AND CONrrROL OF frEE DEPI'l.RTMENT OP PUPLIC WELFARE AND POR DEFRAYING 'l'HE COS'l' OF SUCH COLLECTION AND DISPOSI'rION BY 0PECIAL ASSESSNIENT AGAINST THE PROPERTY TO W1-:ICH S'CH S~HVICE I S RENDERED, AND PROVIDING PENALTIES B'OR VIOLATION OF' THIS OHDINANCE. .. .. - -~ which Ordinance No. 696, passed as aforesaid is hereby referred to and mad~ a part of th53 Resolution for further particulars in respect to the basis and method of .assessing the Q01Jt aga.inst the property herein assessed, and \iVHEREAS, said expense incurred by said Ci ty in the collection and disposition of gar- bage :in accordance with said Ordinance is hereby estimated by tbe Commission of the City of Bozeman to he the sum of FIFTY-SIX THOUSAND NINE HUNDRED SIXTY AND 60/l00tl: s toLLARS $56,960.60)- - - - - - - - - - - - - - - - - - - - - - - - - - - ... - - - - ~ - - - ~ - ~ - for the year 1959, over and aOTT'~ L'lJ 'nO~:1eY3 collected from business and professional con- c erns, or combined re~"Jidence and business or residences and professional business concerns in accordance with said Ordinance No. 696, and WHEREAS, in order to raise said sum to defray the said cost, it is necessary to es- I tablish the basic unit rate~ as defined in said Ordinance No. 696, at Seventeen Dollars ($17.00) NOV'l, T'HEH~PORE, pursuant to the provisions of said Ordinance No. 696, . End the law s of the State of Montana, BE IT HESOLVED AND IT IS HEREBY ORDERED BY THE COTM,nSSION OF 'THE CITY OF BOZEMAN, STNrE OF MON'I'ANA: Section 1. 'l'hat to defray the estim.ated cost and expense of' collecting and disposing of garba8e in the City of Bozeman for the year 1959, there is hereby levied and assessed against the property and the several lots, pieces and parcels of land thereof within the City of Bozeman as set l'ort2'l in Schedule itA", which is attached hereto and made a part here- of, a tax; that a particular description of each lot and parcel of land with the name of the oVlner and/or owners and t:'1e sum assessed against the same is set forth in the assess- ment list in said Schedule "A"; that the several sums set opposite the names of said owners and the described lots and parcels of land, be, and the same are hereby levied and assessed upon and against said lots and parcels of land for saia purpose; that the several sums be collected from the respective owners 01' said lots and parcels of land descrlbed in said assessment list and owned by them; that the sald sums shall be paid and the collection thereof be made in the manner and in accordnnce wi th Ordinance No. 696 of the City of Boze- man". .Mont ana, and the laws of the State of Montana governing the collection of special im- provement taxes; that failure to pay such assessment when the same shall become due and payable shall make such persons and such lots and parcels of' land lia1:::le to the penalties provided by law relat:i.78 to delinquent tax.es.
