'j t COMMISSION RESOLUTION NO. 963 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALL.ATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND INSTALLING AND/OR REPAIRING MISCElLANEOUS .IDEWALKS AND CURBS DURING THE YEAR 1969 WHEREAS, the Commission of the Cit,y of Bozeman, pursuant to the provisions of Ordinanoe No. 561, I entitleda "AN ORDINANCE GOVENING THE CONSTRUCTION AND INSTALLATION OF CONCRETE CURBS AND SIDEWALKS IN THE CITY OF BOZEMAN, PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE AND RE- PEALING OtIDINANCES NOS. 366, 314, 426, 441, 449, and 461, AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES OF THE CITY OF BOZEMAN IN CONFLICT HEREWITH", and the provisions of Section 11-2226, Political Code,R.C.M. 1941, provided for the construction of side. walks and ourbs in the City of Bozeman during the year 1969, without the formation of a Special Improvement DistrictJ WHEREAS, prooeedings were had for the construction and installation and/or repair of Miscellaneous Sidewalks and Curbs in the City of Bozeman for the year 1969, and WHEREAS, misoellaneous Sidewalks and Curbs were constructed and installed and/or repaired bordering on various properties in the City of Bozeman, pursuant to Ordinanoe No. 561, Section 11-2226, Political Code, R.C.M., 1941, which are hereby referred to and made a part of this Resolution, and WHEREAS, the said Miscellaneous Sidewalks and Curbs have been constructed and completed an~or re- paired in aocordanoe with the terms and conditions of said prooeedings, and the City Engineer has duly certi- fied to the Commission a Sohedule showing the sidewalks and Curbs whioh have been construoted and installed an~or repaired, and the properties whioh are subject to assessment thereunder and the total oost of said oonstruction and installation an~or repairing is the sum of One thousan4 three hundred twenty-eight dollar~ _ I fifty oent.. <.1,328.50). . whioh SChedule, marked Sohedule "A", is hereto attaohed and made a part hereof. NOW, THEREFORE, pursuant to the proviwions of Ordinance No. 661 as aforesaid, and Seotion 11-2228, Politioal Code, R.C.M. 1941, as aforesaid, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, MONTANAa Seotion 1. That to defray the cost of oonstruoting and installing and/or repairing Misoellaneous Sidewalks and Curbs as set forth in Sohedule "A", hereto attached and made a part hereof, there is hereby levied and assessed a tax wmounting to the sum of One thousand three hundred twenty-eight dollars and fifty cents ($1,328.60) . Seotion 2. That a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such oonstruction and installation and/or repair and the amount of each payment to be made and the day when the same shall become delinquent is set forth in the assessment list hereto attached marked Sohedule "A" and made a part hereof; that the several sums set opposite the name of the owner and the description of the lots and parcels of land be, and the same are hereby respeotively levied and assessed upon said lots and parcels of land to defray the cost and expense of constructing and I installing an~or repairing said Sidewalks and Curbs; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list as required by law; that the payment of said sums shall be made in six installments; that the payment-of said installments shall be made on or before the 30th day of November of eaoh year until payment of all installments together with the interest thereon, shall be made; that said sums shall be paid and the ~olleotion thereof shall be made in the manner and in accordance with the law tovening the collection of Special Improvement taxes; - that - failure to pay suoh assessments when the same shall become due and payable sha:U: make such persons and uid lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. That the regular session of the Commission of the City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 7th day of Ootober, 1959, at laOO o'clock P.M. be, and the same is here designated as the time and plaoe at which objections to the final adoption of this R,solution will be heard by said Commission. Section 4. That the Clerk of the Commission of the City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the I said City of Bozeman, 8 notice sitned by the Clerk of the Commission and stating that a Resolution levying and assessing a speoial assessment of taxes to defray the oost and expense of constructing and installing an~or repairing Sidewalks and Curbs in the City of Bozeman for the year 1959 is on file in the office of the Clerk of the Commission subject to inspection for a period of five (5) days; that said Notioe shall state the time and plaoe at which objections will be ~eard by the Commission to the final adoption of this Resolution; that it shall be published at least five (5) days before the date set by the Commission for the hearing of objeotions and the final adoption of this Resolution. Provisionally -passed and adopted by the Commission of the City of Bozeman at a regular session thereof, held on the 30th day of September, 1959. CONSTRUCTION AND INSTM..LATION AND/OR REPAIR MISCElLANEOUS SIDEWALKS AND CURBS IN THE CITY OF BOZEMAN DUR- ING THE YEAR 1959. . NOTICE IS HEREBY GIVEN, that a regular session of the Commission of the City of Bozeman held on Wednesday, the 30th day of September, 1959, Commission Resolution No. 963 was provisionally passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon certain lots and parcels of land in front, or on the side of whioh, sidewalks and ourbs have been construoted and/or repaired pursuant to the provisions of Ordinance No. 561 and Seotion 11-2226. Political Code, R.C.M., 1947, to defray the cost and expense of constructing and installing and/or repeiring said Sidewalks and Curbs. That said Commission Resolution is now on file in the office of the Clerk of the Commission, subjeot to inspection for a period of five (5) days by any persons interested. That Wednesday the 7th day of Ootober, 1959, at laOO P.M. of said day, at the regular session of the said Commission of the City of Bozeman at the Co:rmnission Chamber, City Hall Building of said City, has been designated 88 the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and. ..adoPtion of said Resolution No. 930 and the levying of said assessment, and that I said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to said Ordinance No. 561, and the Commissioner's prooeedings for the construction an~or repair of Miscellaneous Sidewalks and Curbs, in front of or on the side of lots and parcels of land within the City of Bozeman for the year 1959 without the formation of a Speoial Improvement Distriot.
