MEETING DATE: May 21, 2007 - Consent Agenda BACKGROUND: The Ridge Subdivision & PUD, situated upon Lot 1 of Minor Sub 295 and Lot 2D of Minor Sub 365A, has received preliminary approval from the City. The applicant’s development team has provided a release and reconveyance document for portions of an existing 30’ wide park/trail easement that are no longer necessary. The 30’ wide linear park/trail easement was originally platted across Lots 1 & 2 of Minor Sub No. 295, more commonly known as Spring Creek Village Resort Subdivision. Lot 1 of said Minor Sub 295 is currently occupied by The Ridge Athletic Club and Lot 2 has undergone subsequent minor subdivision on three separate occasions, ultimately creating Lots 2B, 2C, and 2D of Minor Sub No. 365A. The existing 30’ park/trail easement presently encumbers Lot 1 of Minor 295 (The Ridge) and Lot 2B and 2C of Minor 365A (Cottonwood Condos and Vacant respectively). Abandonment of a portion of this park/trail easement was to happen with the first subsequent minor subdivision of Lot 2, but proper release and reconveyance never did occur. Engineering Staff has reviewed the release and reconveyance document and has found it acceptable. RECOMMENDATION: Engineering Staff recommends that the City Commission make a motion authorizing the City Manager to sign the Release and Reconveyance document.
