D. 1959, the said Commission duly passed Commission Resolution No. 9i5 of the said City for the purpose of oonstroting and installing an oxidation pond for the treatment of raw sewage, for the oonstruotion of a sewerage system to provide sanitary sewers for all lots within the distriot, with the exoeption of Lot 1 in Block 13 and Lot 1 in Blook 14, and for the purpose of oonstroting and installing a pavement project on Highland Boulevard from Mountain View Boulevard to the North Boundary of the New Hyalite View Subdivision, Cherry Drive from Highland Boulevard to and inoluding the oul-de-sao in Block Fifteen (16) of said Subdivision, South Spruoe Drive from Highland Boulevard to North Spruoe Drive, North Spruoe Drive from Highland Boulevard to South Spruce Drive, South Cedarview Drive from Highland Boulevard to North Cedarview Drive, North Cedarview Drive from Highland Boulevard to South Cedarview Drive, South Pinecrest Drive from High~and Boulevard to North Pineorest Drive, North Pineorest Drive from Highland I Boulevard to South Pineorest Drive, Holly Drive from Highland Boulevard to Cherry Drive, Ash Drive from Holly Drive to and inoluding the oul-de-sao in Block Sixteen (16) of the New Hyalite View Subdivision of the City of Bozeman, Montana, and to speoially assess the entire oost and expense of making said improve- ments against the property within said Distriot under and by virtue of the provisions of the laws of the State of Montana in such case made and provided, and said Commission Resolution No. 955 is hereby referred to and made a part hereof for further particulars in respeot to the boundaries of said Special Improvement District No. 414, the estimated cost of said improvements and the method of assessing the same against the property of said District, and WHEREAS, notice of the passage of said Commission Resolution No. 955 was duly published, as re- quired by law, in the Bozanan Daily Chroniole, a daily newspaper of general oirculation printed and pub- lished in the City of Bozeman, Montana, and by .ending a oopy of such notice by U. S. Mail to each person, firm or oorporation having property within the proposed District at his or its last known address, upon the same date that such notioe was first published as aforesaid, and due proof having been made of the pub- lication and service of said notice; am. WHEREAS, within the time provided by law and said published and served notioe there were not suf- -I ficient protests against the creation of said proposed Special Improvement District No. 414, and the City Commdssion was in regular session on the 5th day of August A. D. 1969, at one o'clock p.m. of said day, at the Commission Chamber in the City Hall Building in the said City of Bozeman, the same being the time and place designated in said notice for passing upon all protests, if any, against the proposed work or against the oreation or extent of said District, or both or either) and it further appearing that all of the proceedings for the creation of said District have been lawful and regular; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMANa Section 1 That said Special ]mprovement District No. 414 of the City of Bozeman, State of Montana, be, and .~._~ ...~. Section 2 That said speoial improvements be, and the same are, hereby ordered to be made in said Special Improvement District No. 414 as follows. CONSTRUCTION AND INSTALLATION OF AN OXIDATION POND FOR THE TREATMENT OF RAW SEWAGE, I SAID PROJECT TO mCLUDE ALL APPURTENANTWORKJ CONSTRUCTION OF A SEWER.AGE SYSTEM TO PROVIDE SANITARY SEWERS FOR ALL LOTS WITHIN mE DISTRICT WITH THE EXBEPTION OF LOT ONE (1) IN BLOCK THIRTEEN (13) AND LOT ONE (1) IN BLOCK FOURTEEN (14), SAID PROJECT TO INCLUDE ALL NECESSARY PIPE, MANHOLES, AND OTHER APPURTENANCESJ AND THE CONSTRUC TION OF A PAVEMENT PROJECT ON HIGHLAND BOULEVARD FROM MOUNTAIN VIEW BOULg... VARD TO THE NORTH BOUNDARY OF THE NEW HYALlTE VIEW SUBDIVISION, CHERRY DRIVE FROM HIGHLAND BOULEVARD TO AND INCLUDING THE CUL-DE-SAC IN BLOCK FIFTEEN (15) OF SAID SUBDIVISION, SOUTH SPRUCE DRIVE FROM HIGHLAND BOULEVARD TO NORTH SPRUCE DRIVE, NORTH SPRUCE DRIVE FROM HIGHL>>JD BOULEVARD TO SOUTH SPRUCE DRIVE, SOUTH OEDARVIEW DRIVE FROM HIGHLAND BOULEVARD TO NORTH CEDARVIEW DRIVE, NORTH CEDARVIEW DRIVE FROM HIGHLAND BOULEVARD TO SOUTH CEDARVIEW DRIVE, SOUTH FINECREST DRIVE FROM HIGHLAND BOULEVARD TO NORTH PINECREST DRIVE, NORTH PINECREST DRIVE FROM HIGHLAND BOULEVARD TO SOUTH PINECREST DRIVE, HOLLY DRIVE FROM HIGHLAND BOULEVARD TO CHERRY DRIVE, ASH DRIVE FROM HOLLY DRIVE TO AND INCLUDING THE CUL DE SAC IN BLOCK SIXTEEN (1') OF THE NEW HYALITE VIEW SUBDIVISION OF THE CITY OF BOZEMAN, MONTANA, SAID PAVEMENT PROJECT TO INCLUDE COMBINATION CONCRETE CURBI AND GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, BITUMINOUS SURFACE COURSE, AND OTHER WORK INCIDENT- AL THERETO Seotion 3 That the entire cost and expense of making the special imppvvements herein referred to in said Speoial nnprovement District No. 414 shall be paid by Special ~provement District Coupon Bonds, as authorized by the laws of the State of Montana, which bonds shall be in the denomination of One Hundred Dollars ($100.00) eaoh, and fractions or multiples thereof where neoessary, to be issued and chargeable against a fund to be known as "Special Improvement District No. 414 Fund", said bonds to be redeemable at the option of the City of Bozeman, Montana, whenever funds are available for that purpose from said I Speoial Improvement District No. 414 Fund. said bonds shall draw interest at a rate not to exceed six percent (6%) per annum, whioh shall be ohargeable 8S a part of the cost of said improvements and shall run from the date of the registration of said bonds until said bonds are paid. To I})ay said bonds, and the interest thereon, representing the cost of said improvements, a special assessment shall be levied against all of the lands within said Special Improvement District No. 414 as in said Resolu- tion of Intention No. 965 defined. Seotion 4 Said Assessment and taxes shall be payable in twenty (20) annual installments extending over a period of nineteen (19) years, with interest on deferred paymentsJ but this provision shall not be construed to prevent full payment at any time. Seo tion 6 That pursuant to the provisions and authority oonferred by Section 11..2232, Revised Codes of Montana, 1947, said bonds may be sold to the highest and best bidder therefor for cash, and the pro.. ceeds of suoh sale used in making payment to the oontractor, or contractors, for such work, and such payment may be made either from time to time on estimates made by the engineer in charge of such imprawements for the City, or upon the entire completion of the improvements and the aooeptance there.. Seotion 7 That upon completion of plans and speoifications by the City Engineer for the doing of said work and the making of said improvements, the Clerk of the City Commission of the City of Bozeman, be, and is hereby, directed to publish a notice inviting proposals for the making of said improvements on said Speoial Improvement District No. 414, which notioe shall refer to the plans and specifications on file, by publishing such notice in two (2) issues of the Bozeman Deily Chroniole, a daily newspaper Resolution Nol 958 . :JS:J printed and published in the City of Bozeman, not less than ten (IO) days before the time such bids will be opened. Passed and adopted by the Commission of the City of Bozeman at a regular session thereof held on the 5th day of August A.
