Home My WebLink AboutResolution 959 Taxes for Sprinkling Districts, 1959 :~8il COMMISSION RESOLUTION NO. 959 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN IEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN S'IREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1959. WHEREAS, the City Council and the Commission of the City of Bozeman have h~retofore duly and I - regularly passed Council and Commission Resolutions creating Street Sprinkling Districts ~tnin the -. ~- Ci~ of Bozeman and defining the boundaries thereof and providing for the assessment of the2o~t of sprinkling the same as set forth in Resolutions hereinafter referred to; and WHEREAS, the streets within the boundaries of said Street Sprinkling Di8tr~cts have been sprinkled during the year 1959, as contemplated in said Resolutions, in accordance with the terms and conoitions thereof; and WHEREAS, the Street SfrinkU:n.g Districts and the Resolutions creating the same, the total frontage of the property within said distriot to be assessed, the total cost of said sprinkling within said districts and the proportion thereof chargeable to the property hherein is hereinafter set forth. NOW THEREFORE, pursuant to the provisions of Section 11-2263 to 11-2261 inclusive, R.C.K., 1947 and Ordinance No. 295 and said Council and Commission Resolutions oreating said Street Sprinkling Dis triots; BE IT RESOLVED AND IT IS HEREBY ORDERED-BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA, Seotionj 1. That for--the year 1959, the City of Bozeman has waived the sprinkling assessments of all street Sprinkling Distriots except.Street Sprinkling District No.1; that for the year 1959, the City of Bozeman has defrayed the cost $3,376.89 of sprinkling streets in the several street sprinkling I districts pursuant to Resolutions creating the same, and seventy-five percent of the entire cost thereof ($2,532.67) exclusive of the oost of sprinkling parks and publio places, the total number of linear feet of property to be assessed, and the rate per linear foot, is as follows, Sprinkling District No.1, created by Council Resolution No. 42~, Main Street from Wallace Ave. to Fourth Ave., a total frontage of 9355.9 feet, the sum of $2,532.67, being 75% of the entire amount, or at an apI'roximate rate per front foot of' $0.270702978. Seotion 2. That to defray seventy-five percent of the oost of sprinkling streets within said street sprinkling distriots for the year 1959, there be, and there is hereby levied and assessed a tax, upon all property in front of and bordering on said street sprinkling districts as set forth in Schedule One hereto aLtached and made a part hereof; that a particular descripti on of each lot and parcel of land with the name of the owner and the sum assessed against him or it, is set forth in the assessment lists hereto attaohed, marked Schedule No. 1 and made a part hereof; that the several sums set opposite the names of the owners, and the described lots and paroels of land be, and the same are hereby levied and assessed upon and against said lots and paroels of land; that the several sums be collected from the respective owners of said lots and parcels of land described in the said assessment lists, Sohedule One. as required by law; that said sums shall be paid and the collection thereof shall be made in the manner and in acoordance with the law govening the oolleotion of speoial improvement ,- taxes; that failure to pay suoh assessments when the same shall become due and payable shall make such persons and such lots and parcels of land liable to the penalties provided by law relative to -- delinquent taxes. .'" Seotion 3. That the regular session of the Commission of the City of Bozeman to be held on the 23rd day of September, 1959, at the Commission Chamber, City Hall Building, be, and the same is hereby designated as the time and place at which objections to be final adoption of this Resolution will be heard by the Commission. - - :f85 Section 4. That the Clerk of the Commission be, and he 1s hereby ordered and directed to publish in the Bozeman Daily Chroniole, a daily newspaper printed and published in the said City of Bozeman, a notioe signed by the Clerk of the Commission, and stating that a Resolution levying a special assessment of taxes to defray seventy-five per cent of the cost of sprinkling streets in the said Street Sprinkling Districts for the year 1959, is on file in the office of the Clerk of the Comm1ssio~, subject to inspection I for a period of five days; that said Notioe shall state the time and place at which abjeotions will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five days before the date set by the Commission tor hearing objeotions, and the final adoption of this R.solution. Provisionally passed and adopted by the Commission of the City of Bozeman at a regular session thereof held on the 16th day of September, 1969. That said Street Sprinkling Districts, and the Resolutions oreating the same and the amount of the assessments are as followsl Street Sprinkling District No.1, oreated by Resolution No. 42~, in the amount of $2,632.61. That said Resolution No. 969 is now on file in the office of the Clerk of the Commission of said City of Bozeman subjeot to inspeotion of all persons interested for a period of five days; the Wednesday, the 23rd day of Sept., 1969, at 1100 o'clook P.M. of said day at a regular session of the Commission of the City of Bozeman, Commission Room, City Hall Building, has been designated as the time and plaoe when and where said Commission will hear and pass upon any and all objections that may be made to the final adoption of said Commission Resolution No. 959, and the levying of said assessment; and that said Resolu- - -- tion will be finally passed and adopted at said regular sessioD of said Commission, subject to suoh correotions and mnendments as may be made upon objeotions made and tiled within five days limit as provided ----........ by 1 a w.
