ViliEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman,
Monte.ua, e peti ti on in due form of certain owners of properties situated Qn those streets and
evenues in said Oi ty of Bozeman, lying between North Rouse Avenue and North Grand Avenue extending
from East Mendenhall Street to Tamarack Street, asking that a special improvement district be
created for the purpose of co:nstructin~~ and installing a storm drainage system to serve the eres
within the city limits of the City of Bozeman, to include necessery pipe lines, manholes, drain
inlets Bnd other necessary apputenances and work incidental thereto; and
WHERF..AS. that st a regular meeting of the Citv' Commission of the City of Bozeman held on
the 17th day of June A. D. 1959, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COM~JIISSION OF THE CITY Of' BOZF.Jv1AN:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to creete a special
improvement district to be known and designated as Special Improvement District No. 413 of the City
of Bozeman for the purpose of constructing and installing 8 storm drainage system to serve the area
witnin the city limits of the City of Bozeman, situate on tllose streets and avenues lyin~
betweer..
North Rouse .Avenue and North Grand Avenue extending from East Mendenhall Street to Tamarack Street,
to include necessary pipe lines, manholes, drain inlets and other necessary appurtenances and work
incidental thereto.

Boundaries
The boundaries of said Special Improvement District No. 413 are described as followsl

Beginning at the foint of intersection of the Mat-west alley in Block H,
original Townsite of Bozeman, Montana, and North Bozeman Avenue, tbence from
said point of be~inning; and in a westerly direction along; the centerl ine of
the east-west alley in Block If and Block G, Original Townsite of Bozeman and
Block A, Tracy's Second Addition to the cel1terl ine of North Willson Avmue;
thence Northerly along the centerline of North Willson Avenue to the center-
line of West Le:rrme Street; thence westerly along the centerline of West Lamme
Street to a Foint 140 feet west of the west line of North Willson Avenue;

a period of nineteen (19) years, but this shell not be construed to prevent payment in full at any regular
payment date by en~T property owner who desires t^J do so. It is proposed to pay the entire
cost and ex-
pense of the construction end ins tellation of said improvements with cash to lJ8 obta ined from the s8.1e
of bonds of said Special Improvement District No. 413, as authorized by law. Such bonds
will be in
denomint'ltions of ~,lOO.OO each and fractj ons or multiples of $100.00 where necessary, to be issued and
chargeable aGainst a fund to be known and designeted as "Sfecisl Improvement District !lo. 413 :Fund"
of tl.e Ci.ty of Bozeman. The bonds will be redeemable at tlJe option of the Ci-qy, singly or in
multiples,
and iT. the order of tl,eir registration, whenever funds are a_veilable for that Purl)ose in tp.id Specie 1
IIllrrovement District No. 413. Said bonds shall draw a simr1e interest frow the de.te of their
reGistration
until celled for payment, at 11 rai;e not exc8':ding six (6) per cent per annum, which intere$t shall be

will te issued and sold in accordance wi tJl the provisions of Section 11-2232 and Section 11-2271, Revised

Room of the City Hall, Bozema.n, Montena is designated by sa.id Resolution No. 953 as the time and place
for hearing objections to the action proposed to be taken by said resolution, and when and where any
and all persons whose property is wi.thin said proposed Special Improvement District No. 413 situate
on tr.ose streets and avenues in the said City of Bozeman lyinG between North Rouse Avenue and North
Grand Avenue extending from East Mendenhall Street to Tamara.ck Street, in se..id City, may aPFear and
show cause, if any they hav!'!, against said proposed improvement. Objections must be made in writing
and filed with the Clerk of the City Commission not later than fifteen (15) days a.fter date of the
first pub1 ice ti on of this Notice. I
An approximate prelimina.ry estimate of the cost of doing such work and making such improvement
within said District, including all trench excavation and b!"ckfill, all materials, installation cost,
