WHEREAS, there has been filed wi th the Clerk of the City Commission of the City of Bozeman, Monte-na,
a petition in due form of cert~in owners of prolJerties situated on West Beall Street from Nortb Fifth
Avenue to North Seventh Avenue in said City, esking that a specia.! improvement district be created for the
purpose of constructing Hnd installing a pavement project to include the construction and installation of
combination concr€te curbs and gutters, gravel base course, crushed gravel cushion course, bi twninous
surface course, and otller work incidental thereto; and
WHERF..AS, that at a regulp,r meetinG of the City Commission of the City of Bozeman held on the 17th
day of June A. D. 1959, the aforesaid petition was respectively considered and e;ranted;

That it is hereby declared to be the intention of the C::ty of Bozeman to create e spedal improvemer:t
district to be known and designated as Special Improvement District No. 412 of the City of Bozeman for
the purpose of constructing; and insblling; a pavement project on West Beall Street from North Fifth Avenue
to North Seventh Avenue, said pavement Froject to include the construction and installation of
combination
concrete curbs and Gutters, gravel base course, crushed gravel cushion course, bituminous surface course,

The bounda.ries of said Special Improvement District No. 412 are described as follows J
I Beginning at a point on the centerline
of North Fifth Avenue, said
point being 98.0 feet south of the south line of West Beall
Street,
thence from said point of beginning and in a westerly direction
98.0 feet south of and parallel to the south line of West
Beall
Street to a point on the centerline of North
Seventh Avenue; thence
northerly along the centerline of North Seventh
Avenue to a
point 98.0 feet north of the north line of
West Beall Street;
thence easterly, 98.0 feet north of and parallel

Cha
racter of Improvements
Construction of a pavement project on West Beall Street from North Fifth Avenue to North Seventh
Avenue, said project to include the construction and installation of combination concrete curbs and gutters,
e;ravel base course, crushed gravel cushion course, bituminous surface course, and other work incidental
thereto.

ima te of Cost
The preliminary estiID8te of cost is $14.267.50, including all street
excavation, all materials,
installation costs, engineering and incidentals.

Method of Assessment
The preliminary estimate of cost set forth above is to be assessed against the property within
said Distrjct on an area basis as follows:
Costs of the project will be assessed on an area basis, with the first 25 feet of each lot next
edjacent to the improvement being recorded at double its actual area in computing the assessable area of
each lot. On this basis, the assessable aree of the district is 135.892.65 square feet.

ual Area of District
The total actual area of all proFerty witnin Special Improvement District No. 412, excluding Str~ets,
avenues 8.nd alleys, is 107,455.15 square feet, which is the area on which all protests will be decided.

Sec tion 7
Payments
That payments for said improvements shall be made in twenty (20) annual installments extending
over a period of nineteen (19) years, but "this shall not be construed to }revent payment in full at any
regular payment date by any property owner who desires to do so. It is proposed to Fay the entire cost
and expense of the construction and installation of said improvements with cash to be obtained from the
sale of bonds of' said Special Improvement DistriCt No. 412, as authorized by law. Such bonds will be
in denominations of' UOO.OO each and fractions or 001 tiples of $100.00 where necessary, to be issued

and chargeable against a fund to be known and designated as Special Improvement District No. 412 Fund
of the City of Bozeman. The bonds will be redeemable at the option of the Ci~,
singly or in multiples,
and in the order of their registration, wheeever funds are av~dlable for that purpose in said Special
Improvement District No. 412. Said bonds shall draw a simple interest fr~n the date of their registra-
tion until called for payment, at a rate not to exceed six (6) per cent per annum, which interest shall
be chargeable as a part of the cost of construction and ins l;a11a tion of said improvement. The
bonds
will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Re-
vised Codes of Montana, 1957, and all other applicable provisions of Title 11 of the Revised Codes of
Montana, 1947, relating to special improvement districts in cities and towns, and any amen~ents there-
of or thereto.

That the regular session of the Ciiy Commission of the City of Bozeman, to be held at the Com-
mission Chamber, Ci~ Hall Building. Bozeman. Montana, on 1iednesde.y,
the lEth day of July A. D. 1959,
at the hour of one o'clock p.m. of said day, is the time and place, when and where the City Commission
will hear and pass upon all protests duly and regularly mace and filed against the creation of sa id
proposed Special Improvement District No. 412, the Improvement proposed to be made pprsuant thereto
and the extent and character thereof, or either thereof; and the Clerk of the City Commission be,
and he is hereby, directed to give notice in the manner and for the time as by law required. of the
adoption of this resolution of intention.

Adopted by the Corrunission of the Ci ~ of Bozeman, Montana, at a regular and stated session of

hereby wade to Resolution No. 952 of the COTnmiss1on of the City of Bozeman declaring the intention to
create said District, which is on file in the office of the undersigned Clerk of said Commission in the
City Hall of seid City of 2ozeman, State of Montanal and open for ins:pection to all interested parties
and the public generally.
