SUBJECT: Request to award contract for CTEP Project STPE 1299(18), Milwaukee
Road Rail Trail and Library Site Enhancements
MEETING DATE: May 7, 2007
RECOMMENDATION: 1) Authorize City Manager to award the construction contract for the
Milwaukee Road Rail Trail and Library Site Improvements, STPE 1299(18) to DLM
Contracting, Inc. for the bid amount of $1,246,853.03. 2) Authorize City Manager to approve
procurement awards for “owner-supplied” items as follows:
Wheeler Lumber, Inc. for two clear-span steel bridges: $49,995.00
Northern Rockies Agency, LLC for Lumec Lighting Products: $45,620.00
BACKGROUND: In August 2005 the Federal Dept of Transportation budget bill was passed,
leading to award of a Federal Highway Administration (FHWA) Special Project Appropriation to
the City of Bozeman for pedestrian/cyclist transportation enhancements, landscaping and parking
at the site of the new Bozeman Public Library. FHWA and Montana Dept of Transportation
(MDT) passed this funding through the Community Transportation Enhancement Program
(CTEP).
In October 2005 a Consultant Services Agreement for the 2001-02 Milwaukee RD Rail
Trail CTEP project was awarded to CTA Architects / Engineers. The Milwaukee RD Rail Trail
project was to build a landscaped, paved pedestrian/cyclist pathway along Story Ditch from
Church Street to East Main.
In November 2005 MDT informed the City that the FHWA appropriation could be used
only for site enhancements and not building construction, CTA was offered a greatly expanded
CTEP project to include those Library site enhancements with the Milwaukee RD Rail Trail.
In March 2006 an initial planning meeting was held with MDT, CTA, Library contractor
Martel Construction, the Library Director and other City staff, CTEP Bureau staff and Bozeman
local project administrator, to begin the process of collaborative design and execution of this

project. Throughout 2006 CTA, CTEP and the Library Board and Construction Committee met
to define and ultimately expand the scope of CTA’s project, which was finalized in September
after five iterations.
In November 2006 bids for the project were received. Two bids were offered, but were
both more than 70% over the construction estimates and so bids were rejected. Staff worked
with CTA to reduce expected costs without sacrificing major features of the project or earned
certification points for LEED.
In January 2007 a Certificate of Appropriateness (COA #Z-04112-A) was approved for
construction of a parking lot at Peets Hill, which had been proposed starting in 2004 but not
formalized until the property had been added to the Library site and the appropriation became
available to fund it. Commission directed staff to modify lighting to reduce light trespass while
still meeting public safety needs and staying within LEED recommendations. Modifications
were presented to the Commission on February 20, 2007 with no further action directed.
The project was re-bid in March 2007, and again two bids were received. One bid is
within the budget estimates and funding designated for the project. MDT has concurred with
staff’s bid review, and has issued a Notice To Proceed to award the contract and construct the
project.
On May 1, 2007, MDT authorized reimbursement to the City for the cost of right-of-way
for the Milwaukee Trail corridor, purchase of which was made in fall 2001 as part of the CMC
land purchase for Library construction. Additional funding of $176,000.00 will offset the
“match” amount required for the appropriation, and will be taken from unallocated CTEP funds.
MDT has also committed to providing the full amount of the appropriation for construction of
the project this year, rather than allotting funds on a percentage basis throughout the life of the
current Federal transportation bill.
FISCAL EFFECTS: CTEP requires a 13.42% match for all reimbursement projects. Match
for the CTEP portion of the project is $36,622.00, and is already budgeted from Street
Improvement Funds.
ALTERNATIVES: As suggested by the Commission.
