T~IGHTH AVEJI!UE~ !JORTH NINTH JVENUE,Alm NORTH TENTE AVENUE FROM'NBST MAIN STREET 'IQ WBST BEALL STREET, M,D ONINEST Mt~DENH1iliL STREET AND WEST LAMIYJT~ STREET F'ROMNOR'rE SEVENTH AVENUE TO NORTH TENTE AV'i1-JUE, SAID PROJECT TO INCLUDE THE CONSTRUCTION IJJD INSTALLATION OF I COMBINATION CQNRETE CURBS AND GUTTERS, GRAVEL BASE COURSg, CRUSHED GRAVEL CUSHION COURSE, BITUMINOUS SURFACE COURSE, AND OTHER WORK INCIDEITAL 'rHERET8 vmEREAS, THERE HAS BEEN filed wi th the Clerk of the City Commission of the Ci ty of Bozeman, Montana., a petition in due form of certain owners of properties situated on North Eighth Avenue~ North Ninth Avenue, and North Tenth Avenue from "West Ma.in Street to INest Beall Street and on \"lest Mendenhall Street and Viest Le.mme Street from North Seventh Avenue to North Tenth Avenue in said City, asking that a special improvement district be created for the purpose of constructing and insta.lling a paV1lmlent project to include the construction aad installation of combination concrete curbs and gutters, gravel base course, crtushed gravel eushion course, bituminous surface course, and other work incidental thereto; and WHERE~S, That at a regular meeting of the City Commission of the City of Bozeman held on the 29th day of April 1959.. the aforesaid petition wes respectively considered and grantedl NOW, THEREFORE, BE IT RESOLVED BY THE CITY C01il~ISSION OF TH~ CITY OF' BQZEWANa Section 1 Declaration of Intention That it is hereby declared to be the intention of the C1 ty of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 410 of the City of Bozeman for the purpose of constructing and installing a pavement project on North Eighth Avenue, North Ninth Avenue, and North Tenth Avenue from West Main Street to West Beall Street, a.nd on West Mendenhall Street and West Lamme Street from North Seventh Avenue to North Tenth Avenue, said pavement project to include the construction and installation of combination concrete curbs and gutters.. gravel base course, crushed gravel cushion course~ bituminous surface course, and other work incidental thereto. Section 2 I Bounda.ries The boundaries of said Special Improvement District No. 410 are described as follows a Beginning at a point on the centerline of West Main Street, said poi.nt being 135 feet east of the east line of North Eighth Avenue, thence in a westerly direction along the centerline of West Main Street to a point 105 feet west of the west line of North Tenth Avenue; thence in a northerly direction 105 feet west of and parallel to the west line of North Tenth Avenue to the centerline of West Beall Street; thence in an easterly direction along the centerline of West Beall Street to a point on the centerline of the North-South Alley between North Seventh Avenue and Nor th Eighth Avenue; thence in a southerly direction along said North- South Alley to a point 100 feet North of the North line of West Lamme Street; thence in an Easterly direction 100 feet North of and parallel to the North line of West Lemme Street to the centerline of North Seventh Avenue; thence in a Southerly direction along the centerline of North Seventh Avenue to a point 150 feet South of the South line ofi"lest Menden- hall Street; thence in a westerly direction 150 feet south of and farallel to the south line 'Of West Mendenhall Street to '8- point 135 feet East of the East line of North Eighth Avenue; thence in a southerly direction 135 feet:';ast of and parallel to the East line of Nortll Eighth Avenue to the point of beginning. Section 3 Character of Improvements Construction of a pavement project on North Eighth Avenue, North Ninth Avenue, and North Tenth Avenue froIn West Main Street to iVest Beall Street, and on West Mendenhall Street and West Lamme Street from North Seventh Avenue to North Tenth Avenue.. said project to include the construction Dnd installa- I tion of combina.tion concrete curbs and gutters, gravel base course, crushed gravel cushion course, bituminous surface course, and other work indicental thereto. Section 4 Estimate of Cost The preliminary estimate of cost is $110..100.00.. including all street exca.vation, all materials, installation costs, engineering and incidentals. :~;)l Section 5 Method of Assessment The preliminary estimate of cost set forth above is to be assessed against the property within said District on an area basis as follows; Costs of the project will be assessed on an area basis. wjth the first 25 feet of each lot next adjacent to the improvement being recorded at double its actual area in computing the assessable area of I each lot. On this basis the assessable area of the District is 1.278.525 square feet. Section 6 Actual Area of District The total actual area of all property within Special Improvement District No. 410, exclusive of streets. avenues and alleys, is 688.200 square feet. which is the area on which all protests will be dec ided. Section 7 Payments That payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years. but this shall not be construed to prevent payment in fullat any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 410, as authorized by law. Such bonds will be in denominations of $100.00 each and fractions or multiples of ~lOO.OO where necessary. to be issued and chargeable against a fund to be known and de'8'ignated as Special Improvement District No. 410 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City. singly or in multiples, and in the order of their registration, whenever funds are Available for that purpose in said Special Improvement District No. 410. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed six (6) per cent fer annum, which inter}st shall be chargeable as a part of the cost of construction and installation of said improvement. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271. Revised Codes of Montena. 1947, and all ather applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments, thereof or thereto. Section 8 I Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held et the Commission Chamber, City Hall Building, Bozeman, Montane, on Wednesday, the 3rd day of June 1959, at the hour of one o'clock p.m. of seid day, is the time and ~lace, when and where the City Commission will hear and pass upon 8.11 protests duly and reGularly made and filed aga inst the creation of said proposed Special Improvement District No. 410, the improvement proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and he is hereby, directed to give notice in the manner and for the time as by law reauired, of the adoption of this Resolution of Intention. Adopted by the Commission of the City of Bozeman, Montana, at a regular and stated sestion of said Commission held on the 6th day of May A. D. 1959, at one o'clock p.m. at the Commission Room of the City liall, Bozeman, Montana, is designated by Resolution No. 947 as the time and place fo~ hear- ing objections to the action proposed to be taken by said resolution, and when ahd where any and all persons whose property is wi thinsaid proposed Special Improvement Dis trict No. 410 on North Eighth Avenue, North Nir.th Avenue, and North Tenth Avenue from ':"fest Main Street to West Beall Street, and on West Mendenhall Street and West Lemme Street from North Seventh Avenue to North Tenth Avenue in said Ci ty may a.Fpear and show cause, if any they have, against said pr9Posed improvement. Objections must be made ~l writing and filed with the clerk of the City Commission not later than fifteen (15) days after date of the first publication of this Notice. I An approximate preliminary estimate of the cost of doint; such work and making such improvements within sai. d District, including all street excavabon, all materials, installation costs, engineering and incidentals, which is to be specially assessed against the property within said District is $110,100.00. The total assessable area of all property within the said District, exclusive of streets, avenues and alleys with the 25 feet adjacent to the improvement taken at double its actual area jl 1..278,525 square feet. Property immediately adjacent to and within 25 feet of the proposed improvement is to be assessed at double the assessment against other property in the District. Payment for the improvement is to be made in twenty (20) annual installments over a period of nineteen (19) years with interest on the deferred payments not to exceed six (6) per cent fer annum, payable annually, but this shall not be construed to prevent payment ~ full at any regular payment date by any property owner. For a description of the boundaries of said Special Improvement District No. 410, reference is hereby made to Resolution No. 947 of the Commission of the City of Bozeman declaring the intention to create said District, which is on file in the office of the undersigned Clerk of said Commission in the City Hall of said City of Bozeman, State of Montane, and open for inspection to all interested parties and the public generally.
