HomeMy WebLinkAboutProvisionally adopt Ordinance 1697, Bridger Creek _5 Report compiled on February 12, 2007 Commission Memorandum REPORT TO: Honorable Mayor & City Commission FROM: Martin Knight, Assistant Planner SUBJECT: Zone Map Amendment Ordinance 1697, for Bridger Creek Phase 1 ZMA, #Z-07002 Consent Item MEETING DATE: Monday, April 23rd, 2007 RECOMMENDATION: The City Commission provisionally adopt Ordinance 1697 for the Bridger Creek Phase 1 Zone Map Amendment. BACKGROUND: The applicant is proposing to amend the City of Bozeman Zoning Map to establish a municipal zoning designation of R-3 (Residential Medium Density District) on 7.65 acres of land located at 2401, 2404, and 2405 Birdie Drive. The City Commission approved the requested zone map amendment application on Monday, February 20th, 2007. UNRESOLVED ISSUES: The Department of Planning is not aware of any unresolved issues for the proposed development at this time. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues, along with increased costs to deliver municipal services to the property, when the property is developed. APPROVED BY: Andrew Epple, Planning Director Chris Kukulski, City Manager 38 ORDINANCE NO. 1697 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP FROM “B-1” (NEIGHBORHOOD BUSINESS DISTRICT) TO “R-3” (RESIDENTIAL MEDIUM DENSITY DISTRICT) FOR 7.65 ACRES ON PROPERTY DESCRIBED AS LOTS 56 & 57 OF BRIDGER CREEK SUBDIVISION PHASE 1 AND LOT 58A OF THE AMENDED SUBDIVISION PLAT OF LOTS 62, 58, AND THE COMMON OPEN SPACE/LINEAR TRAIL CORRIDOR OF BRIDER CREEK SUBDIVISION PHASE 1, SITUATED IN THE SE 1/4 OF SECTION 31, T1S, R6E, PMM, CITY OF BOZEMAN, GALLATIN COUNTY, MONTANA. WHEREAS, the proposed zone map amendment to grant a zoning designation of "R-3" (Residential Medium Density District) has been properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Zoning Commission held a public hearing on February 6, 2007, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved as proposed; and WHEREAS, after proper notice, the City Commission held its public hearing on February 20, 2007, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone map amendment criteria established in Section 76-2-304, M.C.A., and found that the proposed zone map amendment would be in compliance with the twelve criteria; and WHEREAS, at its meeting held on February 20, 2007, the City Commission found that the proposed zone map amendment would be in compliance with Bozeman’s 1 39 adopted growth policy and would be in the public interest. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby designated as "R-3" (Residential Medium Density District): Lots 56 & 57 of Bridger Creek Subdivision Phase 1 and lot 58a of the amended subdivision plat of lots 62, 58, and the common open space/linear trail corridor of Bridger Creek Subdivision Phase 1, situated in the SE ¼ of Section 31, T1S, R6E, PMM, City of Bozeman, Gallatin County, Montana. Beginning at the southeast corner of said Lot 56; thence along the south line of said Lot 56, across the Birdie Drive right-of-way, and along the south line of said Lot 57 South 87°48'37" a distance of 1013.21 feet to the southwest corner of said Lot 57; thence along the west line of said Lot 57 North 35°57'40" West a distance of 214.77 feet to the northwest corner of said Lot 57; thence along the north line of said Lot 57 North 87°56’40” East a distance of 160.72 feet to the southwest corner of said Lot 58A; thence along the west line of said Lot 58A, across the Birdie Drive right- of-way, and along the north line of said Lot 56 North 86°22’25” East a distance of 594.20 feet to the northeast corner of said Lot 56; thence along the east line of said Lot 56 South 35°27’35” East a distance of 473.76 feet to the point of beginning. Said parcel containing 7.65 acres more or less.
