COMMISSION RESOLUTION NO. 942
A fu-r.;$OLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, ABANOONING CITY
OF BOZEMAN SPECIAL IMFROVEMBNT DISTRICT NO. 77 AND ABANDONING THE MAINTENANCE
OF STREET FARKINGS THEREUNDER, PURSUANT TO THE STATUTBS IN SUCH CASES MADE AND PROVIDED,
AND PURSUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 939 .AS PASSED AND
ADOPTED BY SAID CITY COMMISSION ON THE 10TH DAY OF DECEMBER A. D. 1958
I WHEREAS, the City Commission of the City of Bozeman on the lOth day of December A. D. 1958, passed
and adopted Commission Resolution No. 939 declaring it to be the intention of said Commission to abendon
Ci ty of Bozeman Special Improvement District No. 77 and to abandon the maintenance of street parle ings
thereunder, which said Resolution of record and on file in the of tic e of the Clerk of said City Commission
and open to the inspection of the public, is hereby referred to for further particulars; and
VVHEREAS, due proof has been made that publication of notice of the adoption of said Resolution
No. 939 was duly made and given as by law provided; and
WHEREAS, At the time and place fixed in said Resolution No. 939 for the making and filing of
protests against the aoondomnent of said Special Improvement Dis trict No. 77, and the abandonment of the
maintenance of street parkings thereunder, to-wit, at the hour of 1.00 o'clock p.m., on Wednesday,
the
24th day of December A. D. 1958, being a regular meeting time of said Ci tv Commission, at the Commission
Chamber in the City Hall building of the City of Bozeman, no protests were made or filed against the
abandonment of said Special Improvement District No. 77 or against the abandonment of maintenance of
street parkings thereunder.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF' THE CITY OF BOZEMAN.
Section 1
That said Special Improvement District No. 77 of the City of Bozeman, State of Montana, and the
maintenance of street parkings thereunder, be, and the same is hereby, abandoned.
Section 2
It shall be the duty of the owners of property abutting said District to maintain the same fro:mr,and
after the date of this Resolution and such abandonment shall not relieve said property owners from the
assessment and payment of a sufficient amount to liquidate all charges existing against said District
prior to the date of abandonment.
I Passed and adopted by the Commission of the City of Bozeman at a regular session thereof held on
the 24th day of December A. D. 1958.
