COMMISSION RESOLUTION NO. 941
A RESOLUTION OF THE CITY COMMISSION OF' THE CITY OF BOZEI\1.AN, ABANDONING CITY OF' BOZFMAN
SPECIAL IM!ffiOVEMENT DISTRICT NO. 48 AND ABKNDONING THE MAINTENANCE OF STREET PARK INGS THERE-
UNDER. PURSUANT TO TRE STATUTES IN SUCH CASES MADE AND PROVIDED, AND PURSUANT TO AND IN
CONF'ORMITYWI1'H COMMISSION RESOLUTION NO. 938 AS PASSED AND ADOPTED BY SAID CITY COM-
MISSION ON THE 10TH DAY OF DECEMBER A. D. 1958
WHEREAS. the City Commission of the City of Bozeman on the lOth day of December A. D. 1958. I
passed and adopted Commission Resolution No. 938 declaring it to be the intention of said Commission
to abandon City of Bozeman Special Improvement Distridt No. 48 and to abando~ the maintenance of street
parkings thereunder. which said Resolution of record and on file in the office of the Clerk of said
Ci ty Commission and open to the inspecti on of the public. is hereby referred to for further parti-
culars; and
WHEREAS. due proof has been made that publication of notice of the adoption of said Resolution
No. 938 was duly made and given as by law provided; and
WHEREAS. at the time and place fixed in said Resolution No. 938 for the making and filing of
protests against the abandonment of said Special Improvement Di,strict No. 48. and the abandonment of
the maintenance of street parkings thereunder. to-wit. at the hour of laOO o'clock p.m. on Wednesday
the 24th day of December A. D. 1958. being a regular meeting time of said Ci~ Commission. at the
Commission Chamber in the City Hall Building of the City of Bozeman, no protests were made or filed
against the abandonment of said Special Improvement District No. 48 or against the abandonment of
maintenance of street parkings thereunder.
NOW. THEREFORE. BE IT RESOLVED BY THE COMMISSION Of THE CITY OF' BOZEMANa

That said Special Improvement District No. 48 of the City of Bozeman. State of Montana. and
the maintenance of street parkings thereunder. be. and the same is hereby. abandoned.
Section 2
It shall be the duty of the owners of the property abutting said District to maintain the sarre
from and after the date Qf this Resolution and such abandonment shall not relieve said property
owners from the assessment and piyment of a sufficient amount to liquidate all charges existing
against said District prior to the date of abandonment.
Passed and adoftad by the Commission of the City of Bozeman at a regular session therof held I
on the 24th day of December A. D. 1958. ~~~-
