COMMISSION RESOLUTION NO. 940
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, ABANDONING CITY OF BOZEWJ.AN
SPECIAL IMPROVEMENT DISTRICT NO. 45 AND ABANDONING THE MAINTENANCE OF STREET PARKINGS
THEREUNDEf\, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED, AND PURSUANT TO
AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 937 AS PASSED AND AroPTED BY SAID
CITY COMMISSION ON THE 10th DAY OF DECEMBER A. D. 1958
~REREAS, the City Commission of the City of Bozeman on the lOth day of December A. D. 1958, passed
land adopted Commission Resolution No. 937 declarinG it to be the intention of said Commission to abandon
City of Bozeman Special Lmprovement District No. 45 and to abandon the ~intenance of street parkings
thereunder, which said Resolution of record and on file in the office of the Clerk of said City Commission
and open to the inspection of the public, is hereby referred to for further particulars; and
WHEREAS, due proof has been made that publication of notice of the adoption of said Resolution No. 937
wss duly made and given as by law provided; and
WHEREAS, at the time and place fixed in said Resolution No. 937 for the making and filing of protests
against the abandonment of said Special Lmprovement District No. 45, and the abandonment of the maintenance
of street parkings thereunder, to-wit, at the hour of laOO 0' clock p.m., on Wednesday, the 24th day of
December A. D. 1958, being a regular meeting time of said City Commission, at the Commission Chamber in
the City Hall building of the City of Bozeman, no protests were made or filed against the abendonment of
said Special Lmprovement District No. 45 or against the abandonment of maintenance of" street parkings
thereunder.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMANa
Section 1
That said Special Lmprovement District No. 45 of the City of Bozeman, State of Montana, and the
maintenance of street parkings thereunder be, and the s~e 1s hereby, abandoned.

It shall be the duty of the owners of property abutting said Dis trict to maintain the same from
and after the date of this Resolution and such abandonment shall not relieve said property owners from
the assessment and payment of a sufficient 8J'II.ount to liquids te all charges existing against said Dis trict
prior to the date of abandonment.
Passed and adopted by the Commission of the City of Bozeman at a regular session thereof held on
