REPORT TO: Honorable Mayor and City Commission

SUBJECT: The Knolls at Hillcrest Planned Unit Development, #P-07007
MEETING DATE: Monday, April 16, 2007 (Continued from March 26, 2007)
RECOMMENDATION: The City Commission approves this application, with revisions as shown on the
attached Conceptual Plan for The Knolls East/Highland South, and the following condition:
1. The applicant is advised that unmet code provisions, or code provisions that are not specifically listed
as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful
requirements of the Bozeman Municipal Code or state law.
BACKGROUND: This is an application for a Planned Unit Development (PUD) with relaxations to allow
concurrent construction for an 80-lot major subdivision that received preliminary plat approval on July 24,
2006. This application would also permanently protect 3.7 acres of open space in the Bozeman Creek
Neighborhood Plan planning area. The Bozeman Deaconess Health Services Subarea Plan, which was
adopted by the City Commission on August 28, 2006, would be slightly amended by adding residential
building lots in locations previously planned for open space. The Planning Board held a public hearing on
March 6, 2007 and voted 4-1 to unofficially recommend conditional approval of the application. The City
Commission held a public hearing on March 26, 2007, and decided to continue the application so that the
applicant and community stakeholders could reach a compromise regarding amendments to the BDHS
Subarea Plan. The stakeholders did meet and the resulting proposal is attached.
UNRESOLVED ISSUES: 1.Whether to approve the requested relaxation from 18.74.020.B.4.a
(Improvement Procedure) and 18.74.030.D.3 of the UDO to allow street improvements to be financially
guaranteed based on submitted plans rather than approved plans. Staff recommended that this relaxation be
denied based on the arguments presented in Bob Murray’s memo dated February 22, 2007. 2. Whether to
allow the requested amendment to the adopted Bozeman Deaconess Health Services Subarea Plan. Staff is
supportive of the amendment.
FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax
revenues, along with increased costs to deliver municipal services to the property, when the property is
developed.
