HomeMy WebLinkAboutResolution 934 Abandon SID 6 ')f)~ ~ ) (~.U COMMISSION RESOLUTION NO. 934 A RESOLUTION OF' TEE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF' SAID COMMISSION TO ABANDON CITY OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 6 AND TO ABANDON Tl-I...E MAINTENANCE OF' STREET PARKING THEREUNDER, AND DIRECTING THE CLERK OF THE CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLl~ION, ALL PUR- SUANT TO THE STATUTES IN SUCH CASF.S MADE AND PROVIDED WHEREAS, a petition was filed with the City of Bozeman on October 31, 1958. by owners of pro- I perty in S~cial Improvement District No.6. of the City of Bozeman, praying for the abandonment of said District, and WHEREAS, it appears for the best interest of the City of Bozeman and the property owners wi thin said Special Imprvvement District No. 6 that said District be abandoned. NOW, THEREFDRE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN. SECTION 1. DECLARATION OF' INTEN TION. It is hereby dedlared to be the intention of the Oi ty Commission of the City -of Bozeman, Montana, to abandon Special Improvement District No. 6 of said City and to abandon the maintenance of any street parking improvement therein. SECTlpN 2. BOUNDARIES OF DISTRICT. The boundaries of said Special Improvement District No. 6 are as followst Beginning at a point in the center line of W. Babcock St. where the same is intersected by the extension of the center line of the alleyin Block A, Alderson's Addition to Bozeman; Thence South along the center line of said alley and the extension thereof to the center line of W. College St; Thence West along the center line of said W. College St. to the extension of the center line of the alley in Block B. of' Alderson's Amendment to F'airview Addition. Thence North a.long the center line of said alley through said Block B., through Blocks 11, B, 5 and 2 of Fairview AddHion and through Blocks H, E, and B of Alderson's Addition, to the center line of said W. Babcock St.; Thence East along the center line of said W. Babcock St. to the place of beginning. SECTION 3. BENEFITS DECLARED. It is hereby declared by the Commission of the City of Bozeman that all of the land within the boundaries of said Special Improvement District No.6 will be specially benefited by such abandonment, and that it is to the best interest of the City of Bozeman and the owners of property within the said District that the District be abandoned. I SECTION 4. EFFECTS OF' ABANDONMENT. Should said Special Improvement District No. 6 be abandoned in conformance to this Resolution and the Notice to be published pursuant thereto, it shall be the duty of the owners of the property abutting on the property involved to maintain the same after such abandon- ment . and such abandonment shall not relieve said property owners from the assessment and payment of , a sufficient amount to liquidate all charges existing against said District prior to the date of abandon. mente SECTION 5. TIME FDR PROTESTS. That the regular session of' the City Commission of the City of Bozeman to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday. the 26th day of November A. D. 1958, at the hour of ltOO o'clock p.m. of said day. is the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the proposed abandonment of said Special Improvement District No.6. SECTION 6. CLERK TO GIVE NOTICE. That the Clerk of the City Commission be, and he is hereby, directed to give notice in the manner and for the time as by law required, of the adoption of' this Resolution of Intention. Notice is hereby given that on the 12th day of November A. D. 1958, at a regular session of the Commission of the City of Bozeman, Commission Resolution No. 934 entitled. A RESOLUTION OF' THE CITY COMMISSION OF' THE CITY OF BOZEMAN, MONTP~A, DECLARING IT TO BE THE INTENTION OB SAID COMMISSION TO ABANDON CITY OF' BOZEMAN SPECIAL IMPROVE- MENT DIS(PRICT NO. 6 AND TO ABANroN THE MAINTENANCE OF STREET PA:RKINGS THEREUNDER, AND DIRECTING THE CLERK 0 F THE CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION, ALL PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED was passed and adopted. I Baboook St.; Thence East along the center line of said W. Babcock St. to the place of beginning. That Wednesday, tile 26th day of November A. D. 1958, at 1:00 o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana, is the date, time and place set for the hearing of protests against the abandonment of said Special nnprovement Distriot No. 6 and for the passage of the resolution of abandonment. That unless forty (40) percent of the property owners of said Special nnprovement District No. 6 fila written protests with the Clerk of the City Commission before the above specified date and time, a resolution of abandonment of said Speoial nnprovement District No. 6 will be by the City Commission passed. That should said Special nnprovement District No. 6 be abandoned in conformance to this Resolution and the Notice to be published pursuant thereto, it shall be the duty of the owners of the property abutting on the property involved to maintain the same after such abandonment, and such abandonment shall not relieve said property owners from the assessment and payment of a sufficient amount to liquidate all charges existing against said District prior to the date of abandonment. This notice is given pursuant to the provisions of Chapter 38 of the laws of the 32nd Legislative Assenilily, State of Montana. Dated this 12th day of November 1958.
